Fisker Inc. did not fail because electric SUVs were impossible to build. It failed after trying to launch one with thin operational foundations: unfinished software, weak customer support, limited parts planning, unresolved quality problems and leadership attention divided among ambitious future vehicles.
The company founded by Henrik Fisker and Geeta Gupta-Fisker delivered its first Ocean in 2023, paused production less than a year later and filed for Chapter 11 bankruptcy protection in June 2024. The case ultimately became a liquidation. That sequence is documented. The stronger claim implied by the original investigation—that the founders’ personal decision-making helped drive the company into the ground—comes largely from former employees and internal records reported by TechCrunch, while Fisker disputed several allegations.

Fisker Inc. was a new company, not the old Fisker Automotive
Henrik Fisker had already become a well-known automotive designer when he and Geeta Gupta-Fisker founded Fisker Inc. in 2016. Henrik served as CEO. Geeta was co-founder, CFO and COO, giving the couple unusually broad influence over both product direction and day-to-day business decisions.

This company should not be confused with Fisker Automotive, the earlier business associated with the Karma plug-in hybrid. Fisker Automotive entered bankruptcy in 2013. Fisker Inc. was a separate company, created three years later, and its first production vehicle was the all-electric Fisker Ocean SUV.

The Ocean was designed by Fisker but built by Magna Steyr in Austria under contract. That arrangement avoided the enormous cost of constructing and operating a factory, but it also meant Fisker still needed the systems that a conventional automaker depends on: supplier coordination, software validation, parts distribution, warranty administration, service training, customer support and accurate delivery records.
The Ocean reached customers before the company was ready
The first Ocean One customer delivery took place in May 2023, followed by U.S. deliveries in June. Fisker delivered approximately 4,900 Oceans during 2023, according to internal documents reported by TechCrunch. That was a long way from the scale needed to support the company’s public ambitions.
Early owners encountered issues involving door locks and handles, key fobs, software, hood bolts and other vehicle systems. TechCrunch also reported more than 100 customer-reported loss-of-power incidents in internal documents, along with complaints about braking performance. These reports did not mean every Ocean suffered every problem, but they showed the risk of putting a complex, software-dependent vehicle into customer hands before its support and validation infrastructure was mature.
The federal safety record added pressure. NHTSA documents describe investigations or recalls involving issues including:
| Issue | What was reported or documented |
|---|---|
| Exterior door handles | Handles could stick, potentially preventing occupants from entering or exiting. A June 2024 stop-sale notice identified 11,201 model-year 2023 Oceans; a later Fisker announcement covered 12,523 vehicles in North America and Europe. |
| Loss of propulsion | A condition could cause a loss of driving power and increase crash risk. |
| Braking performance | NHTSA examined complaints and reports involving reduced or unexpected braking performance. |
| Automatic emergency braking | NHTSA investigated inadvertent automatic emergency-braking events. |
| Doors that would not open | NHTSA opened a separate investigation into door-opening problems. |
These were separate investigations and campaigns, not one blanket finding that every Ocean had every defect. Owners and prospective buyers need to check the vehicle identification number and the relevant NHTSA campaign rather than rely on general statements about “the Ocean recall.”
Leadership kept looking past the difficult work
Former Fisker employees told TechCrunch that senior leadership repeatedly devoted attention to future concepts while basic automaker processes were still being built. Ideas discussed inside the company included an autonomous passenger pod, a solid-state-battery sports car, an electric pickup, a convertible grand tourer and a vehicle priced below $30,000. None reached production.
Future products are normal in the auto industry. The problem was sequencing. A startup with one vehicle on the road has little margin for distraction: every unresolved warranty claim, missing part, software defect and unanswered customer call directly affects its reputation and cash position. Employees described a company that was attempting to plan the next generation while struggling to operate the first one.

Fisker challenged several of those accounts. They should therefore be read as reported employee testimony, not as a court finding that the founders personally caused particular failures.
Customer support became a crisis after deliveries began
According to former employees, Geeta Gupta-Fisker initially resisted creating a conventional call center. The preferred approach was digital support, including a website chatbot. That may have appeared efficient on a spreadsheet, but it was a poor fit for a new vehicle with serious software and access problems.

After U.S. deliveries started, customers reportedly called sales representatives on their personal phones when they were locked out, stranded or unable to obtain help through normal channels. A vehicle company cannot treat sales staff as an emergency roadside-support network for long. Salespeople are not a substitute for trained technicians, warranty administrators and a staffed escalation system.
Fisker hired Prelude Systems in October 2023 to provide customer-service support. Prelude later sued, alleging that Fisker owed it at least $660,000. That amount was a litigation claim, not proof by itself of a final adjudicated debt.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsParts, warranty and software systems were not ready for an operating fleet
One of the most consequential reported decisions concerned spare parts. Former employees said Gupta-Fisker rejected requests for a larger stockpile, partly because electric vehicles were expected to require fewer repairs and because Magna’s build quality was expected to limit failures.
That reasoning underestimated the difference between routine powertrain maintenance and launch-period service demand. An EV may have fewer engine-related components, but it still has doors, latches, sensors, computers, screens, wiring, brakes, suspension parts and charging hardware. A defect affecting a small component can immobilize a vehicle if the replacement part is unavailable.
Employees told TechCrunch that technicians sometimes took parts from Magna’s production line or cannibalized returned and marketing vehicles to complete repairs. One allegation said parts were removed from Henrik Fisker’s Ocean. Fisker denied those claims.
Service administration created another bottleneck. Employees said technicians were expected to repair vehicles while also completing administrative work orders. Records in Salesforce allegedly remained incomplete and then had to be transferred manually into SAP. Fisker disputed that characterization and said the flow between the two systems was seamless.

Employees also told TechCrunch that Fisker had not reserved enough money for warranty repairs. That is an allegation from former staff, not an independently established accounting violation. Regardless of the accounting question, insufficient warranty capacity creates a practical problem: the manufacturer must pay for parts, labor and logistics for vehicles already sold, often while it is still trying to raise money.
Even small engineering shortcuts revealed a larger governance problem
TechCrunch reported internal emails concerning wheel spacers considered late in the Ocean’s development. The spacers would change the vehicle’s stance and appearance. Engineering personnel objected that they were being installed without proper validation and through inadequate approval channels.
Fisker said the spacers were used only on demonstration vehicles, were not sold by Fisker and had received U.S. validation from the supplier. That distinction matters: a demonstration-vehicle modification is not automatically a customer-vehicle safety defect.

The episode was still revealing because vehicle development relies on formal change control. A component that alters wheel position, suspension geometry or tire loading should be evaluated, documented and approved through the appropriate engineering process. When employees believe appearance decisions are bypassing those controls, confidence in the wider development system falls.

Outbyte PC Repair FREEClear out junk files and repair common Windows errorsFree Scan →Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →Software was an even larger problem. Separate TechCrunch reporting described underdeveloped software that contributed to launch delays and created problems during early deliveries. The Ocean depended heavily on software for access, displays, driver assistance and vehicle functions. That made software validation and over-the-air update capability as important as mechanical assembly.
Cash pressure exposed the company’s weak operating model
Fisker’s direct-sales model and outsourced manufacturing reduced some fixed costs, but they did not eliminate the need for working capital. The company still had to pay suppliers, support vehicles, handle recalls, fund warranty work, ship parts and maintain the digital infrastructure connected to the fleet.
Employees told TechCrunch that Fisker at one point had difficulty locating approximately $16 million in customer payments. This should not be described as proven theft, embezzlement or fraud. It was an employee account of an internal effort to find and reconcile payments.
That account nevertheless illustrates why financial controls matter at a startup selling expensive physical products. A customer payment that is not correctly matched to an order can delay delivery, create title problems and distort management’s understanding of available cash.
Fisker also struggled with basic delivery administration. On March 27, 2024, employees were abruptly told the company was leaving its Manhattan Beach headquarters. Staff were assigned to clear a backlog of title and registration paperwork, and some customers reportedly remained without permanent plates.
At the same time, Fisker was trying to move unsold inventory. Sales employees received a $1,000 bonus for each Ocean they directly sold, while destination and handling fees were waived. Ocean One buyers had been promised a package including a warranty extension, special tires, an upgraded infotainment computer and $1,000 in charging credits. Employees estimated the package’s promotional value at roughly $7,500, but TechCrunch reported that owners had not received those benefits at the time of publication.

The filing was not a Chapter 7 case. Fisker entered Chapter 11, but the business eventually pursued liquidation rather than a successful reorganization. The bankruptcy court approved the sale of approximately 3,321 remaining Oceans to American Lease for up to $46.25 million, with the price varying by vehicle condition. American Lease leases vehicles to ride-hail drivers.
The later liquidation plan included a licensing arrangement intended to keep essential cloud services available for Ocean vehicles. American Lease agreed to pay for access to infrastructure supporting services such as over-the-air updates. Fisker’s remaining inventory was sold, while intellectual property and other assets were transferred or liquidated through the bankruptcy process.

What happened to the SEC investigation?
Fisker disclosed an SEC investigation in a 2024 bankruptcy filing. According to TechCrunch’s February 2026 reporting, the SEC closed the investigation in September 2025. There was no public indication in that report that the closure produced an enforcement action.
That status does not erase the company’s operational failures, recalls or customer disputes. It does mean the collapse should not be presented as if regulators had publicly determined that Henrik Fisker or Geeta Gupta-Fisker were legally responsible for it.
Why Fisker collapsed
The evidence points to several failures reinforcing one another:
- An unfinished product launch: Software and vehicle-quality problems reached customers early.
- Insufficient support capacity: Customer service, warranty processing and repair escalation lagged behind deliveries.
- Weak parts planning: A small parts inventory made ordinary repairs harder and slower.
- Limited scale: Roughly 4,900 deliveries in 2023 did not provide the volume needed to spread the cost of the company’s infrastructure.
- Cash and administration problems: Payment reconciliation, title paperwork and vendor disputes consumed time while the company needed financing.
- Leadership prioritization: Employees described an emphasis on new concepts and design ambitions while the Ocean program still needed operational discipline.
None of those points requires the claim that one founder made one disastrous decision. The more persuasive explanation is cumulative: Fisker attempted to behave like an innovative automaker before it had built the unglamorous systems that make an automaker dependable.

FAQ
What caused Fisker Inc. to collapse?
Fisker’s collapse resulted from a combination of weak cash reserves, low production and delivery volume, software and quality problems, inadequate customer support, parts and warranty difficulties, and reported management-process failures. Former employees also said leadership focused heavily on future concepts while the Ocean program remained operationally immature.
Did Fisker file for Chapter 7 bankruptcy?
No. Fisker Group Inc. filed for Chapter 11 on June 17, 2024, followed by Fisker Inc. and related U.S. subsidiaries on June 19. The case later became a liquidation under a Chapter 11 plan.
How many Fisker Oceans were recalled?
The number depends on the specific defect, model year and region. A June 2024 NHTSA stop-sale notice identified 11,201 model-year 2023 Oceans affected by a door-handle issue. Fisker later announced a broader door-handle recall covering 12,523 vehicles in North America and Europe. These figures should not be treated as one universal recall number for every Ocean problem.
Can Fisker Ocean owners still use their vehicles after the bankruptcy?
Some Ocean vehicles can continue operating, but owners may face reduced access to service, parts and manufacturer support. The liquidation plan included a licensing arrangement intended to preserve essential cloud services, including support for over-the-air updates. Owners should check open recalls by VIN through NHTSA and retain all service and warranty records.
The Bottom Line
Fisker’s failure was not simply a case of a bad EV design or an unlucky funding environment. The Ocean entered service with unresolved software and quality issues, while the company lacked the customer-service, parts, warranty and financial controls needed to support a growing fleet. Former employees portrayed Henrik Fisker and Geeta Gupta-Fisker as leaders whose product ambitions repeatedly outran the company’s processes; Fisker disputed several allegations, and no public finding established that the founders were legally responsible for the collapse. The concrete outcome is clearer: Fisker Inc. went from first customer delivery in May 2023 to Chapter 11 in June 2024, and its planned automaker future ended in liquidation.
