Not automatically. A driver in front of you may be liable if evidence shows their vehicle caused the debris to hit your car and their conduct meets the fault standard that applies where the collision happened. If the object was already on the road or its source is unclear, proving the other driver was responsible may be difficult.
What determines whether the driver is liable?
The key questions are where the debris came from, whether the lead driver caused it to strike your car, and whether that driver’s conduct was legally at fault under local law. The fact that debris hit your vehicle is not, on its own, proof that the driver ahead was negligent.
- Source: Was the object seen leaving the other vehicle, or could it have been lying on the road already?
- Causation: Is there evidence connecting that vehicle to the impact and your damage?
- Conduct: What did the driver do, and was the resulting danger reasonably foreseeable under the law where the incident occurred?
- Coverage: What do the applicable insurance rules and policy terms provide?
A West Virginia Supreme Court opinion reviewing decisions from other states illustrates why the source can matter: it distinguishes an object observed flying from a vehicle from debris of unknown origin that may have been on the road earlier. What evidence can help establish what happened?
Evidence that identifies the debris source and links it to the damage can strengthen a claim. A witness or recording may help establish what happened; photographs and repair documents can help record the impact and resulting loss. No single item guarantees that another driver is liable.

- If it is safe, note the other vehicle’s description and license plate.
- Save dashcam footage promptly so it is not overwritten.
- Photograph the damage and the scene once you are safely out of traffic.
- Write down the time and location, and collect witness names and contact details.
- Keep repair estimates, invoices, and receipts.
What should you do after debris damages your car?
- Get to safety and check for injuries. Move out of traffic if you can do so safely; seek emergency help if needed.
- Preserve evidence. Save recordings and document the scene and damage when it is safe.
- Exchange information and follow local reporting requirements. Rules and deadlines depend on where the incident occurred.
- Notify your insurer. Ask what coverage may apply and what evidence or forms it needs. Payment by the other driver’s insurer is not assured unless responsibility and coverage are established.
Oregon example: collision duties and reporting are separate from liability
The legal requirements depend on location. In Oregon, ORS § 811.700 addresses a driver’s duties when the driver knows or has reason to believe their vehicle was involved in a property-damage collision. It expressly includes property damage caused by the motion of a vehicle or its load on a highway or premises open to the public. That is a rule about duties after a collision; it does not by itself prove that a particular leading driver caused your damage. See Oregon Revised Statutes § 811.700.
Oregon DMV says a Traffic Collision and Insurance Report must be submitted within 72 hours when its stated conditions apply. Its guidance also says to stop, exchange information, and report qualifying collisions; if the 72-hour period has passed, file as soon as possible. These are Oregon-specific instructions, not a nationwide deadline or a decision about fault. Check the requirements for the place where your incident happened.
