Arizona drivers should not assume they can use red-dyed diesel in ordinary on-road vehicles. President Donald Trump’s October 5, 2026, executive order directs federal agencies to consider temporary tax-payment relief and specified penalty relief, and encourages states to act. It does not itself change Arizona’s restriction on highway use of dyed diesel. As of October 7, Arizona had not been confirmed to have adopted a broader policy.
Can you use red-dyed diesel in a truck in Arizona?
For an ordinary pickup or commercial vehicle, the answer remains no under Arizona’s published rules. Arizona Revised Statutes § 28-5649 allows highway use of dyed diesel only for specified federally exempt vehicles, including qualifying school buses, qualifying local buses and certain fire apparatus, subject to statutory requirements. The law also requires a written statement from the purchaser to the seller and the state for an allowed use. Read A.R.S. § 28-5649.
The Arizona Department of Transportation says red-dyed diesel is intended for non-highway vehicles, such as farm or road-construction equipment, and that using it in an on-highway vehicle—including a personal pickup or commercial vehicle—is illegal under Arizona law. ADOT notes that fuel taxes support Arizona roads and bridges. See ADOT’s guidance on red-dyed diesel.
The federal order encourages states to take corresponding action, but it does not amend Arizona’s statute. Arizona’s published law and ADOT guidance continued to describe the restrictions as of October 7, 2026. Arizona reporting also described ordinary on-road use as unavailable under the state’s existing rules. Arizona’s Family reported on the order’s implications in the state. A broader Arizona policy was not confirmed in the sources available by that date, so rely on an authoritative state update before treating ordinary on-road use as permitted.

What Trump’s October 5 order actually does
The order, titled “Emergency Tax Relief on Diesel Fuel,” sets out two distinct federal actions for October 5 through December 31, 2026. One concerns possible deferral of certain federal diesel-excise-tax payments; the other concerns specified federal penalties related to dyed diesel sold for or used on highways during that period. Federal tax-payment deferral is conditional
Within five days, Treasury is directed to determine whether federal law authorizes relief, including whether a qualifying event occurred and which taxpayers may be covered. If Treasury makes the required determinations, it may defer certain federal excise-tax payments incurred from October 5 through December 31, without penalties or interest to the extent authorized by law. The order also asks Treasury to issue guidance identifying covered taxpayers, locations, conditions, dates and payment deadlines. The signed order therefore does not by itself establish that every diesel purchase—or every driver—receives a tax break.

Specified federal penalties are addressed separately
The order directs the IRS to announce that it will not impose specified penalties when dyed diesel is sold for or used on highways during the stated period. That direction is federal; it is not a statement that Arizona has changed its own rules on which vehicles may use dyed fuel on state highways.
The order calls for coordination with Transportation, states, industry and labor, and asks Agriculture to coordinate with farm suppliers and rural distributors. It encourages states to take corresponding action, says implementation must remain consistent with law, and creates no enforceable right or benefit. Agency guidance and any state response are therefore separate from the fact that the order was signed.

What the order means for Arizona fuel costs
The White House said the federal diesel tax is 24.4 cents per gallon and illustrated that amount as about $60 on a 250-gallon fill. Those are administration figures, not a verified estimate of what an Arizona driver will save. The White House also said savings could exceed $100 per fill where states match the federal action; that is a projection conditional on state action, not a confirmed Arizona outcome. The order does not establish Arizona-specific pump-price pass-through, a particular driver’s savings, or whether a fuel station will sell dyed diesel for on-road use. No independently verified Arizona pump-price or household-savings figure was established in the cited sources. Trump’s public description versus the order’s legal text
While announcing the order in Nebraska, Trump said: “Tonight, I am going to sign a historic Executive Order to officially waive the off-road requirement and allow anyone to purchase tax-free red dye diesel for any reason.” The Associated Press reported on the announcement.
That is the president’s public description, not the full operative text. The signed order instead lays out conditional federal tax-payment relief, directs the IRS to announce specified penalty relief, and encourages states to act. Arizona’s separate statute remains relevant to whether a vehicle may use dyed diesel on an Arizona highway.

What Arizona drivers should do
- Do not put red-dyed diesel in an ordinary on-road truck based solely on the federal announcement; Arizona’s published rules continue to restrict that use.
- If you operate a vehicle that may qualify for an exception, check the requirements in A.R.S. § 28-5649 and the applicable ADOT guidance rather than assuming the federal order waives them.
- Before relying on a claimed Arizona change, look for an authoritative state announcement or updated guidance. As of October 7, 2026, a broader state policy was not confirmed in the cited sources.
- Do not budget around the White House’s per-gallon or per-fill illustrations as guaranteed savings for Arizona motorists.
