A truck being 25 years old may satisfy a federal safety condition, but it does not automatically satisfy EPA emissions rules, state road-use rules, or an insurer’s underwriting requirements.
Start by documenting the truck’s exact manufacture date, chassis and engine configuration, Japanese ownership and export records, and U.S. customs declarations. Then obtain written guidance from the destination state’s motor-vehicle agency and confirmation from an insurer before you ship or drive the truck.

What must be approved before you drive the truck
Federal import clearance, a state title, a registration card, permission to use particular roads, and insurance are related but separate decisions. A Customs release does not guarantee a title. A title does not guarantee that every public road is legal for the vehicle. Proof of insurance does not prove that the federal import declaration was correct.
- Federal safety: The National Highway Traffic Safety Administration (NHTSA) applies the Federal Motor Vehicle Safety Standards (FMVSS) and importation rules.
- Federal emissions: The Environmental Protection Agency (EPA) applies a separate Clean Air Act process.
- State title and registration: The state DMV decides what ownership evidence, inspections, classifications, and use restrictions apply.
- Insurance: A carrier decides whether it will insure the exact truck, in the exact state, for the exact use and value.
Make these determinations in that order. Buying a truck first and attempting to solve eligibility afterward can leave you with a vehicle that cannot be lawfully imported, titled, driven, or insured.

Step 1: Establish the truck’s exact identity
Before relying on an age exemption or a seller’s description such as “kei truck,” record the permanent identification and configuration details.
Record the manufacture date, not just the model year
NHTSA’s general FMVSS age exemption is measured from the vehicle’s date of manufacture. Model year alone is not enough. Photograph the manufacturer’s date label and retain the original label location and wording. If no permanent date label exists, NHTSA identifies documents such as a first-sale invoice or registration evidence as possible proof of age. Ask the seller for records that establish the month and year and keep the originals.
Match every identifying number
Write down the chassis or frame number, VIN if one exists, make, model, body style, cab configuration, gross-weight information, engine number, displacement, transmission, and drive system. Compare those numbers with the Japanese registration, export certificate, bill of sale, auction sheet, shipping documents, and customs entry. A mismatch can stop a state inspection even when the truck itself is otherwise eligible.

Document the original engine and physical configuration
EPA’s over-21-year emissions pathway described in its current guidance depends on the engine being identical to the one originally installed. Preserve evidence of the original engine specification and disclose any replacement engine, turbocharger, fuel-system change, speed modification, emissions equipment removal, or body alteration. The truck’s ability to exceed a speed threshold can also affect whether a mini-truck is treated as a nonroad vehicle or a regulated motor vehicle.
Step 2: Determine the federal safety route
Truck manufactured at least 25 years ago
NHTSA states that a motor vehicle at least 25 years old may be imported without regard to FMVSS compliance. The 25-year period runs from the manufacture date, not the model-year label. The exemption addresses FMVSS compliance; it does not waive EPA requirements or state requirements.
Keep the evidence used to calculate the 25 years with the import file. Customs, a DMV, or an inspector may need to see why the vehicle was declared under an age-based route. Preserve the NHTSA HS-7 declaration and the supporting age records.

Truck younger than 25 years
A younger vehicle that was not originally built and certified to U.S. standards generally cannot be permanently imported unless NHTSA determines that it is eligible under an applicable process. An eligible nonconforming vehicle may need to enter through a NHTSA-registered importer, which can be responsible for required modifications, testing, and certification. Confirm eligibility for the exact make, model, year, and configuration before shipment; do not assume that a similar truck has the same status.
What the safety decision does not answer
Even a truck that qualifies for the 25-year FMVSS exemption still needs an EPA emissions determination, customs documentation, state approval, and insurance. Treat the safety exemption as one box on the checklist rather than as a general road-legal certificate.
Step 3: Determine the EPA emissions route
Use the separate EPA age and engine test
EPA describes an emissions pathway for vehicles more than 21 years old when the engine is identical to the one originally installed. That is a different threshold and a different test from NHTSA’s 25-year safety rule. The truck must still meet the conditions and declaration instructions in the EPA guidance in effect when it is imported. EPA recommends contacting its Imports Hotline when the vehicle’s status is uncertain.
When a conformity importer is required
EPA states that a nonconforming vehicle must generally be modified, tested, and certified by an Independent Commercial Importer (ICI), unless a valid exemption applies. ICI authority is usually limited to particular makes and models. Contact an ICI with the exact chassis, model, model year, engine, and intended import date and obtain confirmation that it is authorized to handle that vehicle before arranging shipping.
Complete the correct declaration
EPA identifies Form 3520-1 for passenger vehicles, highway motorcycles, and corresponding engines. Use the current form and instructions for the vehicle-specific applicability and declaration code. Keep a copy of the completed form with the customs entry, commercial invoice, bill of lading, and any ICI or exemption documents. An old explanation of a form or code may not reflect current instructions.
Kei and Japanese mini-truck cautions
“Kei,” “mini-truck,” and “off-road” are descriptions, not automatic federal exemptions. EPA guidance warns that many Japanese mini-trucks and vans have been imported in violation of emissions requirements.

The nonroad treatment described by EPA is conditional. The vehicle must have permanent physical attributes that keep it within the applicable speed limit in the guidance. A vehicle capable of exceeding 25 mph is treated as a motor vehicle under the described Clean Air Act rules. Only modifications approved in writing or consistent with EPA guidance are sufficient for the exclusion.
Before purchase, ask for documentary proof of the actual emissions and import basis: the applicable EPA declaration, written exemption or guidance basis, ICI acceptance, and records of any permanent speed or equipment modifications. A seller’s statement that the truck is “for farm use” or “off-road only” is not a substitute for the federal determination.
Step 4: Preserve the ownership and customs file
Build one paper and digital file before the truck leaves Japan. State agencies commonly require both proof of ownership and proof of lawful U.S. entry.

- Original Japanese title, registration, export certificate, or other ownership record accepted by the destination state.
- Bill of sale showing buyer, seller, date, price, vehicle identifiers, and signatures.
- Certified English translations when a state requires them. Delaware and Texas, for example, require certified translation of non-English ownership evidence.
- Any auction, lien-release, or transfer documents needed to show an unbroken chain of ownership.
Federal entry and declaration records
- U.S. Customs and Border Protection entry and release documents, including CBP Forms 7501 and 3461 when applicable.
- NHTSA Form HS-7 and the evidence supporting the selected safety declaration.
- EPA Form 3520-1 and the documentation supporting the emissions code, exemption, or ICI route.
- Bill of lading, commercial invoice, freight receipt, and broker correspondence.
Keep the originals and several copies. A DMV may retain a copy, while an insurer, customs broker, or later buyer may need to see the same history.
Step 5: Ask the destination DMV for a written checklist
State rules are not interchangeable. Before buying or shipping, send the DMV the exact year, make, model, chassis or VIN, foreign ownership records, federal forms, intended use, and destination address. Ask what it will title and register, which inspection is required, what vehicle class will appear on the title, and what roads or purposes that class permits.
Ask the agency to identify requirements in writing or by a reference to its current form or statute. Confirm whether it accepts a frame number instead of a 17-character VIN, whether translations must be certified, whether a bonded title is possible, and whether the truck must be physically present for verification.

The following official state examples demonstrate the types of requirements that may apply. They are not a nationwide checklist and do not predict the result in your state.

These examples show why a federal import approval cannot be presented as state road approval. State Kei classifications and road-use permissions can change, and a registration class may restrict speed, roads, purpose, or operating area.
Step 6: Complete the state inspection and title process
- Confirm the appointment or inspection location. Ask whether the agency requires a VIN or frame-number verification, safety inspection, emissions inspection, weight certificate, or all of these.
- Bring the complete file. Carry original ownership records, translations, CBP documents, HS-7, EPA 3520-1, bill of sale, customs release, and proof of insurance if required.
- Present the truck exactly as declared. Unreported speed, engine, lighting, or body modifications can create a discrepancy between the vehicle and the federal or state paperwork.
- Submit the title application and fees. Check that the proposed title class, odometer statement, vehicle weight, and identifier are accurate before signing.
- Read the issued title and registration restrictions. Look for terms such as off-road, restricted, low-speed, farm, collector, or other use limitations. Ask the DMV what each term allows before driving on public roads.
Step 7: Obtain insurance before operating the truck
Some states require proof of insurance during registration, but state forms do not prove that a particular insurer will cover a Japanese import truck. No carrier should be assumed to accept every Kei model, right-hand-drive truck, unusual chassis, or restricted title.
Give the insurer complete information
- Exact make, model, manufacture date, chassis or VIN, engine, and body configuration.
- Japanese ownership and export history, U.S. customs entry, federal declarations, and state title status.
- Intended use: public-road transportation, farm property, business deliveries, shows, recreation, or limited nonroad operation.
- Annual mileage, garaging address, drivers, security arrangements, and any modifications.
- Requested value basis, such as agreed value, stated value, or actual cash value, if the carrier offers those choices.
Ask questions that expose exclusions
- Does the policy cover the exact truck and the intended public-road use in the destination state?
- Does a restricted, reconstructed, bonded, or nonstandard title change eligibility or claims handling?
- Are right-hand-drive vehicles, imported parts, replacement engines, or speed modifications excluded?
- Are there mileage, road, cargo, business-use, or driver restrictions?
- What documents are needed to establish the insured value after a total loss?
Request the insurer’s acceptance and policy terms in writing before relying on coverage. Keep the binder or policy with the registration documents and verify that the vehicle description matches the title and chassis number.
Federal clearance, state registration, road use, and insurance: four different outcomes

A positive answer in one row does not create a positive answer in another. Plan for all four decisions.
Common failure points and how to correct them
The seller uses the model year as proof of age
Request the manufacture-date label or acceptable documentary proof. Recalculate the 25-year period from manufacture, not the model year.

The truck is 25 years old, so EPA paperwork is ignored
Apply the separate EPA test. Determine whether the over-21 pathway’s identical-engine condition applies or whether an ICI or another valid exemption is required.
An “off-road” label is treated as a federal exemption
Verify the permanent physical attributes, speed limitation, and written EPA basis for the exact configuration. Do not rely on advertising language.
The customs file is incomplete
Obtain copies of CBP entry documents, HS-7, EPA 3520-1, invoices, translations, and release records from the broker or importer before approaching the DMV.

The DMV rejects a foreign-language title
Ask whether a certified translation, translator affidavit, or specific form is required. Do not submit an informal translation when the state requires certification.
An insurer quotes a similar vehicle but not the actual truck
Provide the exact chassis, title class, use, mileage, modifications, and value. Ask for written confirmation that the policy covers public-road operation in your state.
The registration is issued with a restriction
Read the restriction and obtain the DMV’s explanation of permitted roads, speed, hours, and purpose. Do not infer unrestricted use from having a plate.
A practical pre-purchase checklist
- Photograph and authenticate the manufacture-date label.
- Match chassis, engine, and ownership identifiers across every record.
- Determine the NHTSA safety route: 25-year manufacture-date exemption or an eligibility and Registered Importer process.
- Determine the EPA route: qualifying over-21 identical-engine pathway, ICI, or another documented exemption.
- Verify any Kei or mini-truck nonroad claim against the actual permanent configuration and speed capability.
- Collect Japanese ownership and export records and certified translations where required.
- Preserve CBP entry forms, HS-7, EPA 3520-1, invoices, and release records.
- Send the complete vehicle description to the destination DMV and obtain its title, inspection, weight, and use requirements.
- Ask an insurer to accept the exact truck and intended use in writing.
- Ship or operate the vehicle only after the federal, state, road-use, and insurance decisions are all favorable.
Federal and state forms, agency guidance, and underwriting rules can change. Recheck NHTSA, EPA, the destination DMV, and the insurer close to the transaction and before the truck is driven.
