Do not pay a car deposit until the order identifies the vehicle, total price, amount paid, and a usable delivery deadline. If the dealer cannot promise an exact day, put a calendar “outside date” in the signed agreement and state that you may cancel for a full refund if the vehicle is not supplied by then. Get a receipt and a complete copy of every signed page. A deposit is not automatically refundable: your rights depend on the wording of the contract and the law where you buy.
Secure the contract before transferring any money
A deposit usually sits inside a sales contract, not in a separate protective account. The document determines what vehicle the dealer must supply, what you must pay, when delivery is due, and what happens if either side does not perform. Read the entire order form and every incorporated term before paying.

Identify the parties and the exact vehicle
- Use the dealer’s full legal name, address, telephone number and email, plus your legal name and contact details.
- Record the make, model, model year, body style, drivetrain and trim. Add the vehicle identification number, factory order number or stock number when available.
- List every agreed option, package, color, accessory and dealer-installed item. If an item is not included, do not rely on a salesperson’s verbal assurance.
State the money precisely
- Write the total vehicle price and itemize taxes, freight, documentation charges, accessories and other fees.
- State the deposit amount, the date it is paid, the payment method and whether it is credited toward the purchase price.
- Require a receipt that identifies the vehicle and order, not merely a generic card slip or cash acknowledgment. Consumer Affairs Victoria’s guidance puts the practical point plainly: “Make sure you get a receipt for this money.”
Do not sign an incomplete form
Never sign a blank contract, leave a price or date for later completion, or accept a promise that the dealer will “fill in the details.” Consumer Affairs Victoria advises against signing blank contracts and recommends itemized costs. Ask for a complete copy, including the reverse side, terms and conditions, finance documents, trade-in schedule and any page incorporated by reference.
Replace an uncertain estimate with an enforceable outside date
If production or transport makes an exact delivery day impossible, negotiate a latest acceptable date instead. The agreement should say what happens if the vehicle has not been delivered by that date. A useful clause identifies:

- the calendar date by which the dealer must tender the specified vehicle;
- what event counts as a material delay (for example, no vehicle available for inspection or registration by the outside date);
- your right to cancel by written notice after that date;
- the method for giving notice; and
- the deadline for returning the entire deposit.
Ask the dealer to write the date into the order itself, rather than sending it only by text or email. Keep any email that explains how the date was chosen, but make the signed contract the controlling record.
Reject vague delivery language
Terms such as “as soon as possible,” “priority delivery” and “in 4 to 6 months” do not tell you when you may walk away. Québec’s Office de la protection du consommateur specifically warns consumers not to settle for those formulations. A range can be useful as an estimate only when it is paired with a final date and a remedy for missing it.
Separate an estimate from a deadline
Ask the dealer to label each date. “Estimated arrival: September” is information, not necessarily a contractual promise. “Delivery no later than September 30; buyer may cancel for a full refund if missed” is a deadline with a stated consequence. If the dealer refuses any outside date, decide whether the vehicle is worth exposing your money to an open-ended wait; do not assume a court or consumer agency will create a deadline for you.

These are drafting protections, not a universal legal rule. Québec consumer guidance recommends confirming that the contract reflects the merchant’s promises and includes the vehicle, delivery date, total price and down payment. Your local law may require additional language or may limit what a dealer can enforce.

Negotiate refund triggers before you agree to the deposit
“Deposit” can describe different arrangements: a credit toward a purchase, a security for a specially ordered vehicle, or a payment subject to statutory cancellation rights. Ask the dealer to state in writing whether it is refundable and under exactly which circumstances.
Dealer-side events
Request a full refund if the dealer cannot supply the specified vehicle, changes the agreed price without your written acceptance, or misses the outside date. If a replacement vehicle is offered, say whether you may reject it and recover the deposit when its specification, equipment or price differs from the order.
Buyer-side events
Address financing approval, trade-in changes and your own cancellation. If the purchase depends on financing, identify the lender or approval conditions and the date by which approval must occur. If financing fails under the stated conditions, the contract should say whether the deposit is returned. Do not assume that simply changing your mind gives you a refund.

New South Wales consumer guidance warns that a signed order form and deposit create a legal contract. Depending on the terms, a seller may be entitled to keep the deposit and charge a cancellation fee when the buyer withdraws. That is why a negotiated refund clause matters before signature.

Price changes and extensions
Read clauses allowing the dealer or manufacturer to vary the price, specifications or delivery date. NSW guidance notes that some contracts permit delivery extensions and price variations. Québec guidance also cautions consumers about price-increase provisions. Ask for a right to cancel for a full refund if the delivered price or material specification changes, rather than accepting an extension or increase by default.
Preserve proof of the order and payment
Keep a single folder containing the signed contract, receipt, payment confirmation, vehicle specification, price worksheet, finance approval, trade-in valuation, delivery updates and every email or message. Save files in their original form and note the date, time and person spoken to after telephone calls.
- Before paying, photograph or download every signed page and attachment.
- After paying, check that the receipt names the dealer, amount, date and order or vehicle reference.
- When a salesperson makes a promise verbally, send a short written confirmation and ask the dealer to correct it if it is wrong.
- Do not surrender your only copy of a trade-in title, finance document or signed order.
Good records do not create a refund right by themselves, but they make the agreed right provable and give a consumer authority or court a clear chronology.
Compare dealer offers by risk, not just by price
Two dealers can quote the same vehicle and deposit while exposing you to very different waiting and refund risks. Compare the written terms on these points:

A lower deposit does not compensate for an unlimited delivery period, a broad price-variation clause or no stated refund process. Evaluate the whole contract.
What to do when the delivery date passes
- Read the exact deadline. Determine whether the date was a binding promise, an outside date, an estimate, or no date at all. Check extension and force-majeure language.
- Ask for status in writing. Request the vehicle’s order status, the reason for delay and a firm proposed delivery date. Keep the request factual and attach the relevant contract page.
- State your chosen remedy. If you will wait, give a written additional period and say what information you require. If you will not wait, invoke the contract’s cancellation clause and request the deposit by the stated deadline.
- Preserve the response. Save emails, letters, screenshots and delivery promises. Record missed calls and the dates of any promised updates.
- Escalate through the proper local channel. If the dealer refuses the contractual remedy, contact the consumer-protection authority or qualified legal adviser in the place of purchase with the complete file.
Do not simply stop payments, refuse a scheduled finance obligation or announce a verbal cancellation without checking the contract. NSW guidance cautions that a buyer who changes their mind after signing may face deposit retention or a cancellation fee, and that delay rights depend on the agreement.

These rules do not establish a worldwide refund standard. The result can also depend on whether the vehicle was custom ordered, whether financing is conditional, whether the dealer or manufacturer caused the delay, and what remedies the signed agreement provides.

Recognize the difference between a late dealer and a changing buyer
The dealer misses a contractual deadline
You have a stronger basis for cancellation when the order states a delivery deadline and a refund remedy, or when a local rule supplies a remedy for a missed date. Follow the required notice and any opportunity to allow additional time.
You change your mind before delivery
This is usually analyzed under the cancellation clause, not the late-delivery rules. A dealer may claim the deposit or a cancellation fee if the contract permits it. Ask for a written settlement rather than assuming the deposit is recoverable.
The dealer cannot supply the specified vehicle
Compare the offered substitute with the signed specification. If the model, equipment, price or timing differs, use the contract’s substitution and refund language. Do not accept “equivalent” as a conclusion without checking the details.

Apply the finance condition exactly as written, including approval deadlines and notice requirements. If no condition exists, a failed loan may not automatically release you from the purchase.
Red flags that justify pausing the payment
- The dealer will accept money but will not identify the vehicle or provide an order number.
- The only delivery promise is “soon,” “priority,” a broad range or a statement that the date is subject to change.
- The salesperson refuses to state when you can cancel or how quickly a refund will be issued.
- The price can increase for any reason and you have no right to reject the change.
- You are asked to sign an incomplete form, a document with blank pages, or terms you are not allowed to take away.
- The receipt does not name the dealer, amount, date or vehicle order.
Ask for the missing term in writing. If the dealer will not provide it, the safest way to protect the deposit is not to transfer it until you understand and accept the risk.
When professional help is worthwhile
Contact the relevant consumer-protection authority or a qualified lawyer when the dealer refuses to honor a written cancellation right, disputes the amount paid, invokes an unfamiliar extension or force-majeure clause, threatens a large cancellation charge, or keeps changing the vehicle and price. Bring the signed contract, receipt, chronology and all correspondence. A local adviser can determine whether a statutory rule overrides the contract and which notice, complaint or court process applies.
The practical rule
Treat the deposit as exposed money until the signed order gives you an identifiable vehicle, a total price, a calendar deadline, a clear cancellation trigger and a refund process. Keep the receipt and every page. If delivery becomes late, use a written notice based on the contract and local law rather than relying on a verbal promise or an assumption that deposits are always refundable.
