Maryland bill of sale: what you need before writing anything
A Maryland bill of sale documents the terms of a private transaction. It helps the buyer prove the price paid, supports the tax calculation, and gives both parties a signed record of the handoff. It is separate from the ownership transfer on the certificate of title.

Confirm that this is a private-party transaction
These instructions cover a Maryland resident buying from another private owner. Dealer sales, leased vehicles, inherited vehicles, gifts, salvage vehicles, and some out-of-state or specialty transactions can use different procedures. If the vehicle or ownership situation falls outside an ordinary private sale, confirm the required documents with MVA before signing.
Prepare the information and documents
- The original Maryland title, with every owner shown on it identified.
- The vehicle identification number (VIN), year, make, model, and body style.
- The buyer’s and seller’s legal names and addresses.
- The actual agreed sale price and payment details.
- The odometer reading in whole miles and the correct exception, if one applies.
- The sale date and the names of any co-sellers or co-buyers.
- Any lien-release document, if a lien appears on the title.
- A way for each party to retain a legible copy of every signed page.
Check the VIN on the vehicle against the VIN on the title and VR-181 before either party signs. A single incorrect character can cause the title application to be held for correction.
How to complete Maryland Form VR-181 step by step
Write legibly in permanent ink, or type into an official fillable version if MVA provides one. Do not leave a required field blank; use the form’s stated exception or explanation area when a field does not apply.

1. Enter the vehicle description
Copy the year, make, model, body style, and complete VIN exactly as shown on the title and vehicle. The body style is the vehicle type identified on the title, such as sedan, coupe, pickup, van, or motorcycle. Do not substitute a marketing trim name for the model or shorten the VIN.
2. Identify the buyer
Enter the buyer’s full legal name and address. If two people are purchasing the vehicle, use the co-buyer fields provided by the form and make sure the names match the ownership information that will be submitted for titling. A nickname or an informal name can create a mismatch with the buyer’s identification and title application.
3. State the actual sale price
Enter the total consideration the buyer and seller actually agreed to, in U.S. dollars. Include the amount paid by cash, check, electronic transfer, financing, or another agreed form of consideration. Do not lower the stated price to reduce tax and do not describe a sale as a gift unless it genuinely qualifies as one.

If the vehicle sold for substantially less than ordinary market value, use the form’s explanation space to describe the factual reason, such as documented collision damage, mechanical defects, a non-running condition, or missing equipment. Keep supporting records with the bill of sale.
4. Record the odometer reading
Enter the odometer reading in whole miles as of the sale. Do not add decimal fractions or estimate a reading. Select or enter the odometer exception only when it accurately describes the vehicle, such as an exempt age category, an odometer that exceeds its mechanical limit, or a reading that is not the vehicle’s actual mileage. If none applies, report the actual reading as required by the form.
5. Add the sale date
Use the date on which the parties completed the sale and transferred ownership documents. Write the month, day, and year clearly. The date on the bill of sale should agree with the sale date entered on the title assignment and with any payment record.
6. Complete seller information and signatures
Each seller listed as an owner must print their name, sign, and date the form. Use the co-seller fields when more than one owner is involved. The title controls how signatures are handled: all owners must sign unless the title specifically shows “OR.” Do not assume that one owner can sign for another without proper authority.
7. Complete buyer information and signatures
Each buyer should print their name, sign, and date in the buyer section. Verify the spelling against the identification that will be used for titling. Read the certification before signing. VR-181 states: “I/we certify under penalty of perjury that the statements made are true and correct to the best of my/our knowledge, information and belief.”
8. Review every field before exchanging documents
Compare the completed VR-181 with the title, payment record, and identification. Correct errors before signing when possible. If a signed form contains an error, do not erase or alter it in a way that makes the change questionable; complete a clean form and have all required parties sign the replacement.

Complete the title assignment separately
The bill of sale is not the ownership document. The seller must assign the original certificate of title to the buyer. On the back of the title, enter the buyer’s name and address, sale price, odometer reading, and sale date in the designated assignment fields. The seller or sellers then sign exactly as their names appear on the title.
All owners shown on the title must sign unless the ownership designation is “OR.” If a lien is listed, obtain the required lien release before the buyer submits the title application. Do not give the buyer only a photocopy, a bill of sale, or a promise that the original title will arrive later; the assigned original title is normally needed for titling.
Before handing over the paperwork, make a copy or clear scan of the completed title assignment and the signed VR-181. Keep the copies with payment records, repair records, and any written explanation of an unusually low price.

Does a Maryland bill of sale need to be notarized?
For private sales of vehicles less than seven years old, Maryland’s rule changed effective October 1, 2026. The Maryland Motor Vehicle Administration stated in its September 15, 2026 bulletin, SB125 / HB251- Repeal of Notarized Bill of Sale Requirement: “Effective October 1, 2026, a notarized bill of sale is no longer required for vehicles less than 7 years old sold by a private party.”
The current VR-181 revised 10-26 contains signature and date fields but no notary block. Therefore, a notary is not required for a qualifying private sale completed on or after the effective date. Older web pages and forms may describe the former rule; date-stamp your advice and paperwork because the policy recently changed.
The bulletin’s quoted change is specific to private sales of vehicles less than seven years old. It does not establish a blanket rule for every vehicle age or transaction type. For a vehicle that is seven years old or older, or for an unusual ownership situation, confirm the current requirement with MVA before relying on the no-notary rule.

What if the sale price is below MVA’s value?
MVA may compare the reported price with the NADA value returned by its system for the vehicle. If the system value is more than $500 above the reported sale price, MVA says the buyer may be taxed using that NADA value or may submit evidence supporting the lower price.

| Evidence that can support the reported price | How it helps |
|---|---|
| Vehicle-condition records | Shows damage, mechanical defects, high wear, or other facts that reduced the price. |
| Canceled check, bank statement, or loan documents | Confirms the money actually paid or financed. |
| Vehicle advertisement or seller communications | Shows the asking price, disclosed defects, negotiation, and agreed consideration. |
| A listing from another national valuation publication | Provides an additional market reference for the vehicle’s condition and region. |
| Signed bill of sale | Documents the parties’ stated consideration and any written explanation for the discount. |
Keep the evidence consistent with the amount written on VR-181 and the title. Do not change the stated price after the fact or create a document that does not reflect the real transaction. If MVA’s system returns no NADA value, or the parties dispute the value, the matter goes to MVA agent review through the agency’s portal.
Signatures, copies, and the handoff
Seller’s handoff checklist
- Sign the title assignment in every required owner signature line.
- Give the buyer the assigned original title, completed VR-181, lien release if applicable, and any inspection or repair records being provided.
- Give the buyer copies or let both parties scan the completed documents before leaving.
- Remove the Maryland license plates from the vehicle. The seller should return the plates to MVA rather than leave them on the car.
- Keep proof of the sale, including the date, buyer identity, price, and copies of signed documents.
Buyer’s handoff checklist
- Confirm that the VIN on the vehicle, title, and VR-181 matches.
- Confirm that every required seller signed the title and bill of sale.
- Collect the original assigned title, not merely a photocopy.
- Collect any lien release and evidence supporting a below-value price.
- Arrange insurance and follow Maryland’s registration and inspection requirements before operating the vehicle as required by law.
What the buyer needs to title the used car
The buyer submits the title application and supporting documents under MVA’s private-party titling process. Requirements can vary with the vehicle and ownership history, but the buyer should be prepared to provide the following:
| Item | Purpose | When it matters |
|---|---|---|
| Assigned original title | Transfers ownership from the seller to the buyer. | Required for a normal used-car title application. |
| VR-181 and other proof-of-price documents | Documents the consideration and supports tax calculation. | Use the bill of sale when applicable and retain evidence for a low-price review. |
| Maryland inspection certificate | Shows that the vehicle passed the applicable safety inspection. | Required when the transaction and vehicle category call for inspection. |
| Identification | Confirms the buyer’s identity and legal name. | Bring the identification used for the title application. |
| Lien release | Shows that a prior secured interest was satisfied. | Needed when a lien appears on the title or MVA record. |
| Taxes and fees | Pays the charges due for titling and registration. | Amount depends on the transaction and vehicle details. |
The bill of sale is recommended and useful, and it may be applicable to titling, but it is not invariably required in every Maryland title transaction. The assigned original title remains the central ownership document. If the buyer’s paperwork does not fit the ordinary checklist, contact MVA or an authorized tag-and-title service before submitting an incomplete application.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. How responsibilities are divided after the sale
Seller
The seller signs the title and VR-181, provides the original ownership documents, removes the plates, and returns the plates to MVA. The seller should not leave active plates on a vehicle that has been sold. Retain copies in case a later question arises about the date or terms of the sale.
Buyer
The buyer submits the title application, pays applicable taxes and fees, obtains the required inspection certificate, arranges insurance, and completes registration. The buyer should use the exact names and vehicle identifiers from the signed documents and resolve any lien or valuation issue before the application is finalized.

Common Maryland bill-of-sale problems and fixes
The VIN does not match
Stop the transaction paperwork and compare the VIN on the dashboard or door label, the title, and VR-181. If the title itself contains an error, ask MVA how to correct the title before completing the sale. Never guess at a missing character.
A co-owner is unavailable
Do not omit a listed owner. All owners must sign unless the title shows “OR.” Obtain the required signature or formal authority before assigning the title.
The price was negotiated after a draft was prepared
Prepare a new VR-181 and correct the title assignment so both show the final agreed price. The payment record, bill of sale, and title should tell the same story.
Quick wins for a faster PC:
Clear out junk files and repair common Windows errorsFree Scan →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Repair Windows errors before they cause bigger problemsFix Now →The vehicle sold far below the system value
Keep contemporaneous evidence: the advertisement, messages, photographs, repair estimates, payment proof, and a clear explanation of the condition. Submit that evidence if MVA questions the price. Accepting taxation at the system value is another option, but it does not change the actual sale price that must be reported.
An old website says notarization is mandatory
Check the publication date and transaction date. For a qualifying private sale of a vehicle less than seven years old effective October 1, 2026 or later, the MVA bulletin says notarization is no longer required and the current VR-181 has no notary section. For older vehicles or nonstandard transactions, verify the rule with MVA instead of applying the newer exemption broadly.
The buyer has only a bill of sale
A bill of sale alone does not replace the original assigned title. The seller must provide the properly assigned title, and the buyer should resolve a missing or defective title before paying in full whenever possible.
Worked example
Suppose a Maryland seller transfers a 2021 sedan to a buyer on November 5, 2026 for $8,200. The parties copy the year, make, model, body style, and VIN from the title into VR-181, enter the buyer’s legal name and address, report an 86,412-mile odometer reading in whole miles, and write $8,200 as the actual price. The seller explains that a documented transmission problem reduced the price and attaches the repair estimate and listing messages.
Both parties sign and date VR-181. The seller also enters the buyer’s name and address, $8,200, 86,412 miles, and November 5, 2026 on the back of the title, then signs the assignment. Because the vehicle is less than seven years old and the sale is effective after October 1, 2026, the parties do not need a notarized bill of sale under the MVA bulletin. They scan the signed documents, the seller removes the plates, and the buyer submits the assigned original title, VR-181, the inspection certificate, identification, any lien release, and required taxes and fees.
Accuracy matters more than finding a shortcut
VR-181 certifies the truth of the statements under penalty of perjury. The form warns that a false statement is a misdemeanor punishable by a fine of up to $500, imprisonment for up to two months, or both. Report the real consideration, the real odometer reading, and the real condition-related reason for a discount. A truthful, internally consistent packet is the fastest way to prevent a tax review or title delay.
