For federal clean-vehicle credits, a vehicle acquired after September 30, 2025 is not eligible for the new, previously owned or qualified commercial clean vehicle credit. An acquisition on or before that date can still qualify if the vehicle is placed in service later and every applicable requirement is met. State, local and utility incentives follow separate rules, so verify each offer with the agency or utility that administers it before you sign a purchase contract.
1. Check the federal cutoff before doing anything else
The Internal Revenue Service (IRS) states in its 2026 Form 8936 instructions that a clean vehicle cannot qualify for the federal credit if it was acquired after September 30, 2025. This applies to the new clean vehicle, previously owned clean vehicle and qualified commercial clean vehicle credits. The rule is based on when the vehicle was acquired, not the model year, the date you began shopping or the date a dealer advertised an offer.
As an Amazon Associate I earn from qualifying purchases.
A vehicle acquired by September 30, 2025 may still be eligible when it is placed in service later, provided it satisfies the vehicle, buyer, income, price, use and documentation rules for the applicable credit. The IRS used-vehicle guidance says the acquisition must have occurred by the cutoff; a binding written contract and payment by that date can be important evidence. Because tax treatment depends on the precise transaction, keep the contract, payment records and delivery documents.
- Acquired after September 30, 2025: do not expect a federal clean-vehicle credit.
- Acquired on or before September 30, 2025: continue checking the detailed requirements and the vehicle’s place-in-service date.
- Unclear acquisition date: ask the dealer or tax professional when the binding sale occurred and what payment was required, rather than relying on an order date or a refundable deposit.
2. Gather the facts that determine eligibility
Before comparing incentives, write down the transaction facts. Vehicle eligibility and buyer eligibility are separate tests, and a qualifying vehicle does not automatically make every buyer eligible.

Record the vehicle and transaction
- New or previously owned vehicle.
- Manufacturer, model, trim and vehicle identification number (VIN).
- Purchase or lease, and whether the arrangement is personal or business use.
- Sale price and, where the rule uses it, the manufacturer’s suggested retail price (MSRP).
- Contract date, required payment date, delivery date and date placed in service.
- Whether the vehicle is being acquired by an individual, business or tax-exempt organization.
Record the buyer’s tax and household facts
- Federal tax year in which the vehicle was placed in service.
- Filing status and the income measure required by the applicable IRS instructions.
- Whether the buyer has enough federal tax liability for a nonrefundable credit, unless a transfer mechanism applies under the rules for that transaction.
- For a used vehicle, whether the buyer and vehicle meet the additional previously owned vehicle conditions, including any purchase-frequency and seller restrictions.
Do not infer eligibility from a window sticker, a salesperson’s estimate or a listing that says “tax credit eligible.” Confirm the exact VIN and the rules for the tax year of delivery.
3. Ask the dealer for the IRS time-of-sale record
For an applicable individual clean-vehicle credit, the seller must complete the IRS reporting process. Ask for a copy of the accepted time-of-sale report before relying on a credit or a point-of-sale transfer.
- Ask whether the seller is registered with the IRS for clean-vehicle reporting.
- Request the time-of-sale report showing the buyer, VIN, sale information and the credit amount, if one applies.
- Check that the VIN on the report exactly matches the VIN on the vehicle and purchase documents.
- Confirm that the IRS accepted the report, not merely that the dealer submitted an unverified form.
- Keep the report, contract, buyer’s order, proof of payment and delivery record with your tax files.
The IRS instructions say to file Form 8936 for the tax year in which you took delivery, including a transaction in which the credit was transferred at the time of sale. A dealer’s reduction of the price does not eliminate the reporting requirement. If the dealer will not provide the required record, pause the transaction and ask the dealer’s compliance contact or a tax professional to explain why.
4. Understand how a federal credit is delivered
“Tax credit,” “point-of-sale transfer,” “rebate” and “utility incentive” are not interchangeable. The federal clean-vehicle credit is a tax provision. In applicable earlier transactions, IRS rules may allow an eligible buyer to transfer the credit through a registered dealer and receive the benefit at the sale, but the transaction still has to be reported and satisfy the credit rules.
| Benefit label | Who administers it | How the buyer may receive it | What to verify |
|---|---|---|---|
| Federal clean-vehicle credit | IRS | Claimed on the federal return for the delivery year, or transferred at sale when the applicable rules allow | Acquisition date, vehicle and buyer requirements, VIN, accepted seller report and Form 8936 filing |
| State or local rebate | State agency, air district, city, county or similar program | Program-specific payment after purchase, at purchase or through an approved dealer | Residency, vehicle type, income, price cap, application deadline, funding and required documents |
| Utility incentive | Electric utility or its program administrator | Rebate, bill credit or incentive for a vehicle, charger or related activity, depending on the program | Service territory, customer status, eligible item, installation or purchase date and remaining funds |
Never assume that a state rebate can be taken on a federal return, that a utility payment is available nationwide or that two programs can be stacked. Read the live rules for the exact transaction.
5. Search state and local incentives by location
Use the U.S. Department of Energy’s Alternative Fuels Data Center (AFDC) “Federal and State Laws and Incentives” directory as a starting point. Select the buyer’s state and the relevant incentive category, then open the administering agency’s current page. The directory can identify programs run by a state agency, air district, city or county, but the listing is not a guarantee that money remains or that a particular vehicle qualifies.
AFDC itself cautions: “This information provides an overview of laws and incentives and should not be your only source of information for making decisions about vehicle purchases, taxes, or other binding agreements.” Treat that warning as a practical instruction: use the directory to find the program, then use the administrator’s page or written confirmation to make the decision.

Check these conditions on the program page
- Jurisdiction and residency: confirm the applicant’s address and whether the vehicle must be registered in that jurisdiction.
- Vehicle status: determine whether the offer covers new vehicles, used vehicles, plug-in hybrids, leases or purchases.
- Price and income limits: look for MSRP, purchase-price and household-income caps, and learn which date and income definition the program uses.
- Timing: check eligible purchase or lease dates, pre-approval rules, application deadlines and whether applications are accepted before funds run out.
- Dealer and documentation rules: identify approved dealers, proof of registration, contract, income documents, scrappage records or other required evidence.
- Funding status: confirm that the program is open and has funds when you apply, not merely that it appears in a directory.
- Stacking: ask whether the benefit can be combined with another state, local, federal or utility incentive.
For example, an AFDC listing for Delaware describes rebates for new or pre-owned electric vehicles and plug-in hybrids and directs applicants to the Delaware Department of Natural Resources and Environmental Control for requirements. That example shows how to follow a listing to the administrator; it does not establish eligibility for another state.

6. Check your electric utility separately
A utility incentive is tied to the electric account or service territory, not simply to the state where the vehicle is purchased. Use the AFDC utility incentive resource or contact the utility named on the electric bill.
Distinguish the eligible activity
Utility directories may include separate categories for a new-EV rebate and for charging equipment or installation. A program that pays for a home charger may not pay anything toward the vehicle, and a vehicle rebate may require the applicant to be a current customer. Confirm the exact item, purchase or installation date, approved equipment, contractor rules and application process.
Confirm funding and timing
Ask the utility whether funds are currently available, whether pre-approval is required and whether the incentive is issued as a bill credit, check or other payment. Obtain the answer in writing if the incentive affects your purchase budget.

When several offers appear possible, put them in a table rather than comparing advertising language. The following fields expose the differences that most often change the result.
| Comparison field | Questions to answer |
|---|---|
| Jurisdiction | Where must the buyer live, register the vehicle or receive electric service? |
| Vehicle | Which make, model, trim, VIN, fuel type and battery configuration qualify? |
| New, used or lease | Is the offer limited to purchases, or does it include used vehicles and leases? |
| Price or MSRP | Is there a purchase-price or MSRP ceiling, and how is it calculated? |
| Income | Is there an income band, what household definition applies and which tax year is used? |
| Dates | What acquisition, delivery, registration and application dates control? |
| Benefit and timing | Is it a tax-return credit, dealer transfer, rebate, bill credit or charging-equipment payment? |
| Participation | Must the seller, installer or dealer be approved or registered? |
| Documents | Which contract, VIN, income, residency, registration or scrappage records are required? |
| Funding | Is the program open, capped, wait-listed or subject to depletion without notice? |
| Stacking | Can it be combined with other incentives, and in what order must applications be made? |
If a program page does not state a comparable value, record “not stated” and ask the administrator. Do not fill an unknown amount with a national average; no stable, nationwide rebate amount is established by the official listings.
8. Get a written eligibility file before you commit
Ask the dealer, agency or utility to confirm the details that apply to your transaction. Your file should contain:
- VIN, make, model, trim and new or used status.
- Buyer name, address, residency or utility-account confirmation.
- Contract, required payment, delivery and placed-in-service dates.
- Sale price or MSRP calculation used by the program.
- Income or filing-status documentation, if required.
- Dealer registration or approval confirmation.
- Accepted IRS time-of-sale report for an applicable federal transaction.
- Application deadline, submission method and a list of required attachments.
- Written confirmation that funds are available and whether the offer can be combined with another incentive.
Save screenshots or PDFs of the rules in effect when you apply, along with confirmation numbers and correspondence. Program pages can change when funding is exhausted or an agency revises its forms.

Using an order date as proof of acquisition
An online order or refundable deposit may not establish the required acquisition. Ask what made the contract binding and when payment was made, especially for a used vehicle.
Assuming a dealer discount is a government credit
A promotional discount can be withdrawn or have conditions unrelated to tax law. Require the IRS report for an applicable federal transfer and the administering agency’s approval for a state or local rebate.
Checking only one database
AFDC is a directory, not a final eligibility decision. Open the current agency or utility page and verify funding, dates and documents.

Ignoring the lease distinction
Lease incentives can be governed by rules different from a purchase. Ask who owns the vehicle, who applies for the benefit and whether the contract passes any value to you.
Failing to preserve VIN-level evidence
Keep the accepted report and all sale documents. A general statement that a model qualifies is not a substitute for the VIN and transaction record tied to your purchase.

New vehicle acquired after September 30, 2025
The federal clean-vehicle credit is unavailable under the IRS cutoff. You can still investigate state, local and utility programs, but each must be checked independently for the vehicle, buyer, location, funding and deadline.
Used vehicle acquired by the cutoff but delivered later
Keep the binding written contract and proof of payment showing acquisition by September 30, 2025. Confirm that the vehicle and buyer satisfy the previously owned credit rules, obtain the required seller record and use the tax-year filing instructions for the year of delivery.
Vehicle appears in a state database listing
Follow the listing to the administering agency. Confirm whether the exact trim and purchase type qualify, whether income or price limits apply, and whether funds remain before signing.

Utility advertises an EV incentive
Verify that your address is in the service territory and that the incentive covers the vehicle rather than only a charger or installation. Ask about pre-approval and funding before purchasing equipment or the car.
11. A quick decision checklist
- Is the vehicle acquisition on or before September 30, 2025? If not, stop expecting a federal clean-vehicle credit.
- Do you have the exact VIN, vehicle status, price, buyer type and delivery information?
- For an applicable federal transaction, has the registered seller produced an accepted IRS time-of-sale report?
- Have you identified the correct tax year and retained documents for Form 8936?
- Have you searched AFDC for your state and opened the administering agency’s current rules?
- Have you checked your electric utility’s territory-specific programs separately?
- Are funding, deadlines, income, residency, price, dealer and stacking rules confirmed in writing?
If any answer is no, treat the incentive as unconfirmed and do not include it in the purchase budget.
Frequently asked questions
Can a vehicle acquired before the federal cutoff qualify if delivery happened later?
Possibly. The IRS allows certain pre-cutoff acquisitions to remain eligible when placed in service later, but the vehicle and buyer requirements still apply. The acquisition date must be documented.
Does a state rebate have the same deadline as the federal credit?
No. State, local and utility programs set their own eligible dates, deadlines and funding limits. Verify the live rule with the administering organization.
What if the dealer says the VIN qualifies but will not provide an IRS report?
Do not rely on the statement alone. For an applicable federal transaction, request the accepted time-of-sale report and correct any VIN or sale-information error before filing.
Is a charger rebate evidence that the car purchase qualifies?
No. A utility may incentivize charging equipment or installation under a separate program. Confirm that the listed benefit covers the vehicle purchase you intend to make.
