How Classic-Car Smog Exemptions Differ by State

Classic, antique and collector labels do not create one nationwide smog exemption. See how California, Texas and New York separate model-year cutoffs, emissions tests, safety inspections, registration, county rules and use conditions.

A classic-car label does not make a vehicle automatically exempt from emissions testing. In the United States, “classic,” “antique,” and “collector” are not nationwide emissions-law categories, and there is no single federal age cutoff. Each state can base its rule on model year, fuel type, vehicle class, registration designation, mileage, insurance, county, or the kind of inspection involved.

California, Texas, and New York show why two cars of the same age can face different requirements. Before buying, registering, transferring, or modifying an older vehicle, confirm the current rule with your state motor-vehicle and environmental agencies. Ask specifically about emissions testing, safety inspection, registration status, and the county where the car is operated.

What determines whether an old car is smog-exempt?

States generally decide eligibility using several separate tests rather than one definition of “classic.” The relevant questions are:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Model year or age: Some rules identify a specific model year; others use an age threshold that changes each calendar year.
  • Inspection type: An emissions or Smog Check exemption may not remove a safety inspection, equipment inspection, or registration requirement.
  • Fuel and engine: Gasoline, diesel, alternative-fuel, heavy-duty, and specially classified vehicles may be treated differently.
  • Registration designation: Antique, historical, classic, collector, or ordinary plates can carry different conditions—or have no effect on emissions testing.
  • Location: A vehicle may be subject to an emissions program only in certain counties or metropolitan areas.
  • Use and mileage: Limited-use rules, annual mileage caps, parades, exhibitions, and personal-use restrictions can affect eligibility.
  • Insurance: Some collector classifications require a qualifying collector-car policy.
  • Timing: Requirements can differ at first registration, ownership transfer, annual renewal, or a later phase-in date.

Because these factors can overlap, “How old does a car have to be to be smog exempt?” has no nationwide answer. The correct answer is the one in the state program that applies to that vehicle and use.

State comparison: California, Texas, and New York

State and agency Age or model-year rule What is actually exempt Other conditions and cautions
California Department of Motor Vehicles (DMV) and Bureau of Automotive Repair (BAR) DMV guidance lists gasoline-powered model-year 1975 and older vehicles as not needing a smog inspection. BAR guidance says collector cars from model year 1976 onward require a Smog Check. The DMV statement concerns the smog inspection. It does not by itself eliminate every registration or safety obligation. A September 16, 2026 governor’s announcement about SB 1392 describes a phased exemption for qualifying 1976–1985 collector cars. Conditions described include collector-car insurance or driving fewer than 1,000 miles per year. Verify the effective dates and agency implementation before relying on it.
Texas Department of Public Safety (DPS) and emissions statute No single “classic” age rule answers every question. DPS says antique-registered vehicles are exempt from the annual inspection; classic-registered vehicles require an annual safety inspection. That is an inspection distinction, not a blanket emissions exemption. Texas law separately permits waivers of emissions-program requirements in specified situations, including certain low-mileage vehicles and vehicles not primarily operated in a covered emissions county.
New York Department of Environmental Conservation (DEC) and Department of Motor Vehicles (DMV) DEC describes vehicles 25 model years and older as exempt from OBD and low-enhanced emissions inspections. Its calendar-year-2024 example was model year 1999 and older. The cited exemption is for those emissions-test categories. It does not establish that safety inspection, registration, or every other inspection requirement ends. Apply the live model-year calculation for the current calendar year rather than treating the 2024 example as permanent.

These examples illustrate the differences; they are not a 50-state survey. A state not listed here may use a different age, registration, mileage, county, or inspection rule.

California: a model-year cutoff, plus a 2026 collector-car change

Current DMV and BAR guidance

California DMV guidance lists gasoline-powered vehicles from model year 1975 and older among vehicles that do not need a smog inspection. The cutoff is based on model year, not simply the date the car was first registered or the number of years since purchase.

BAR guidance says collector cars from model year 1976 and newer require a Smog Check. That means a car marketed or insured as a collector vehicle is not automatically outside the emissions program. A 1978 vehicle, for example, cannot rely on the word “collector” alone to avoid a Smog Check under that guidance.

What the September 2026 announcement changes

On September 16, 2026, the California governor announced the signing of SB 1392 and described a phased exemption for qualifying collector cars from model years 1976 through 1985. The announcement identified conditions including collector-car insurance or driving fewer than 1,000 miles per year.

An announcement is not a substitute for the detailed DMV and BAR instructions that determine how a registration transaction is processed. Before calling a particular car exempt, check the current implementation details, phase-in dates, definitions of qualifying collector use, proof requirements, and whether the condition is checked at renewal, transfer, or another transaction.

California questions to ask

  • Is the vehicle gasoline-powered, and what is its exact model year?
  • Is the vehicle covered by the 1975-and-older DMV category or by a newer collector-car phase-in?
  • Does the owner have the required collector-car insurance, or can annual use be documented as fewer than 1,000 miles?
  • Is a Smog Check required for the specific registration or ownership transaction being performed?

Texas: antique plates, classic plates, safety inspections, and emissions waivers

Antique registration is not the same as a smog exemption

Texas DPS says vehicles with antique registration are exempt from the annual inspection. A vehicle registered as a classic still requires an annual safety inspection. The distinction concerns the inspection program described by DPS; it should not be rewritten as “all antique vehicles are exempt from emissions testing” or “classic vehicles never need inspection.”

Emissions-program rules are separate

Texas law allows waivers of emissions-program requirements for specified vehicles and owners. The statute includes situations involving qualifying low mileage and vehicles that are not primarily operated in a county covered by the emissions program. Eligibility depends on the implementing rule and the facts for the particular vehicle, including where it is principally used and how mileage is documented.

For a Texas car, determine the answers in this order:

  1. Identify whether the vehicle has ordinary, antique, or classic registration.
  2. Check whether its county is inside the applicable emissions-program area.
  3. Determine whether the vehicle is required to receive an emissions test, a safety inspection, both, or a waiver review.
  4. Collect proof of mileage, use, registration status, and any other documents required by the current program.

Do not use an antique-plate exemption from the annual inspection as proof that a separate emissions requirement has been waived.

New York: the 25-model-year emissions threshold

What the DEC exemption covers

New York DEC describes vehicles 25 model years and older as exempt from OBD and low-enhanced emissions inspections. Its example for calendar year 2024 identified model year 1999 and older. The example demonstrates how the calculation works for that year; it is not a permanent list.

For a current registration or inspection, calculate the vehicle’s model-year age under the current calendar year and then verify the result with New York DMV and DEC materials. A vehicle that qualifies for the emissions category may still have another inspection or registration obligation.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Why “25 years old” can be misleading

People often count from the vehicle’s build date or purchase date. The DEC language is expressed in model years, so a late-built vehicle can be treated according to its model year rather than the day it left the factory. Also, the exemption named by DEC is specifically for OBD and low-enhanced emissions inspections; it does not establish an exemption from every safety inspection or administrative requirement.

Smog testing and safety inspection are different questions

A safety inspection checks items such as brakes, lights, tires, steering, glazing, or other roadworthiness equipment. An emissions inspection measures pollutants or verifies emissions-control operation, often through an OBD scan, tailpipe test, visual inspection, or a combination. A state can waive one and retain the other.

That is why Texas is especially easy to misunderstand: DPS’s antique-registration exception concerns the annual inspection, while emissions-program waivers are governed separately. New York’s 25-model-year language identifies OBD and low-enhanced emissions inspections, not every possible safety requirement. California’s gasoline model-year cutoff addresses the smog inspection, not a universal exemption from registration rules.

County and operating-area rules can change the answer

Some emissions programs apply only in designated counties or metropolitan areas. A vehicle that is outside a covered county may qualify for a different process, while moving it into a covered area can create a new obligation at renewal or another transaction. Texas law specifically contemplates waivers for certain vehicles not primarily operated in a covered emissions county.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Use the address and operating pattern that the agency recognizes, not merely the location of a storage garage or the county where the car was purchased. Ask whether the rule is based on the owner’s address, the vehicle’s principal operation, the inspection station’s location, or another statutory definition.

Registration labels, mileage limits, and insurance conditions

Antique, classic, historical, and collector designations can affect plate eligibility, inspection frequency, permitted use, and documentation, but they do not have a uniform legal meaning across states. One state may use “antique” for a registration category and “classic” for another; another may use the terms differently or leave emissions testing unchanged.

Limited-use conditions deserve special attention. If an exemption depends on driving fewer than 1,000 miles per year, keep contemporaneous mileage records and confirm how the state measures the year. If collector-car insurance is required, verify that the policy satisfies the state’s definition and that its permitted use matches commuting, errands, exhibitions, and other planned driving. An insurance policy’s label alone is not proof that the motor-vehicle agency has granted an emissions exemption.

How to verify an exemption before buying or registering

  1. Write down the exact vehicle identity. Record the model year, fuel type, body or vehicle class, VIN, current registration, and the state where it will be titled.
  2. Name the inspection you are asking about. Say “emissions test,” “OBD test,” “Smog Check,” “annual safety inspection,” or “registration inspection.” Do not ask only whether the car is “exempt.”
  3. Check the official motor-vehicle agency. Look for the current page covering smog inspections, antique or collector registration, transfers, and renewals.
  4. Check the environmental agency or emissions program. Confirm county boundaries, model-year tables, test types, waiver rules, and documentation requirements.
  5. Confirm timing. Ask whether the rule applies at first registration, title transfer, annual renewal, or only after a phase-in date.
  6. Confirm use and proof requirements. Determine whether mileage logs, insurance documents, photographs, affidavits, or county-use evidence are required.
  7. Get the answer in writing. Save the agency page and any case-specific email or letter with the date checked, especially when a new law has recently been announced.

Perform this check before purchasing a car whose value depends on avoiding a test. A seller’s statement that a vehicle is “smog exempt” may refer to a different state, a different inspection, or an old rule.

Common mistakes and how to correct them

Mistake: using a nationwide age rule

There is no universal 20-, 25-, or 30-year exemption. Replace the generic rule with the exact state, model year, fuel type, and inspection category.

Mistake: treating antique plates as an emissions waiver

Registration status may change an annual inspection requirement without changing emissions-program eligibility. Check both programs independently.

Mistake: assuming “collector” means no test

California BAR guidance treats collector cars from model year 1976 onward as requiring Smog Check, subject to the newer 2026 phased-exemption announcement and its conditions. Confirm the current implementation before relying on the label.

Mistake: applying an old calendar-year example forever

New York’s model-year-1999 example was for calendar year 2024. Recalculate under the current year and verify the live agency rule.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Mistake: confusing a safety exemption with a smog exemption

Read the words after “exempt.” If the source says annual inspection, OBD inspection, low-enhanced emissions inspection, or Smog Check, preserve that exact scope when making a buying or registration decision.

Practical examples

A gasoline 1975 car in California

California DMV guidance places gasoline-powered model-year 1975 and older vehicles in the category that does not need a smog inspection. The owner must still verify any registration, title, equipment, or other applicable requirements.

A 1980 collector car in California

Under BAR’s stated guidance, a model-year-1980 collector car requires Smog Check. The September 2026 SB 1392 announcement describes a future or phased path for qualifying 1976–1985 collector cars, but the owner must verify implementation, insurance or mileage conditions, and the effective date before claiming the exemption.

An antique-registered vehicle in Texas

DPS says antique registration exempts the vehicle from the annual inspection. That does not answer whether a separate emissions-program waiver is available; county, mileage, and other statutory conditions must be checked.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A 25-model-year vehicle in New York

The DEC emissions exemption covers OBD and low-enhanced emissions inspections at 25 model years and older. The owner should still confirm whether a safety inspection or another registration requirement remains.

Bottom line for classic-car owners

“Classic,” “antique,” and “collector” are useful descriptions, not nationwide emissions-law categories. The decisive details are the state, model year, fuel and vehicle class, inspection type, county, registration designation, mileage or use limits, insurance, and transaction date. California, Texas, and New York each draw those lines differently, and California’s 2026 collector-car change adds a new implementation question for certain 1976–1985 vehicles. Verify the current rule with the responsible motor-vehicle and environmental agencies before you buy, register, transfer, modify, or drive the car under an assumed exemption.
