A lawyer handling a semi-truck accident case may investigate how the crash happened, identify people or companies that could be responsible, preserve and assess evidence, document your losses, and deal with insurers. If a fair settlement is not possible, the lawyer may pursue a lawsuit. What claims are available and what rules apply depend on the facts and the state where the case is handled.
What to do after a semi-truck accident
Put safety and medical care first. Once immediate needs are addressed, a few practical steps can help protect your health and preserve information that may matter later:
- Get medical attention, even if symptoms seem minor. Follow clinicians’ instructions and keep records of appointments, treatment, and expenses.
- Report the collision to law enforcement and obtain the report number or instructions for getting a copy.
- If you can do so safely, photograph the vehicles, road, traffic controls, visible injuries, and relevant conditions. Collect contact details for witnesses.
- Keep documents related to the crash, including medical bills, repair estimates, insurance correspondence, and receipts for out-of-pocket costs.
- Be cautious about giving recorded statements, signing releases, or accepting a settlement before you understand what it covers. You can ask an attorney in the relevant state for advice before responding.
A lawyer can help assess next steps and send requests to preserve potentially relevant evidence. The specific procedures for obtaining records depend on the circumstances and applicable law.
What a truck-accident lawyer may do
Investigate the collision
Counsel may gather and review available evidence, such as crash-scene information, police records, photographs, witness accounts, and records maintained by a carrier. The goal is to develop a case-specific account of what happened, not to assume that a particular party or factor caused the crash.

Federal regulations require certain carrier records. For example, under 49 CFR § 390.15, a motor carrier must maintain an accident register for three years. The register includes specified information, such as the date and location, driver, injuries or fatalities, and hazardous-material release when applicable. The rule also addresses making accident records and information available to specified authorized investigators. It is a carrier recordkeeping requirement—not a deadline for an injured person to file a claim—and it does not mean every record is automatically available to a claimant.
Assess electronic and supporting records
For carriers and drivers subject to the applicable electronic logging device (ELD) rules, a carrier must retain a backup copy of ELD records for six months under 49 CFR § 395.22. 49 CFR § 395.30 sets requirements for ELD records, including restrictions on altering or erasing original information and source data streams. The rules also cover supporting documents connected with drivers’ records of duty status; 49 CFR § 395.11 prohibits destroying or altering existing information in a supporting document.

These rules do not establish that every truck has the same data systems, that every potentially relevant record exists, or that records will remain available. A lawyer can evaluate what may exist and, where appropriate, seek preservation and use discovery or other procedures to request records. Access and procedure depend on the case and applicable law.
Identify potential claims and responsible parties
The truck driver may be one potential defendant, but the investigation may also examine a motor carrier or another person or company if evidence supports a claim against it. Depending on the facts, relevant questions might include who controlled the vehicle or work, what conduct contributed to the collision, and whether a product or maintenance issue played a role. A shipper, maintenance provider, manufacturer, or carrier is not liable simply because it was connected to the truck; responsibility must be supported by evidence and the governing law.

Document injuries and financial losses
A lawyer may organize medical records and bills, employment and income information, repair or replacement costs, and other evidence of the effects of the crash. The kinds of damages that can be pursued—and how they are evaluated—depend on the facts and applicable state law. A claim’s value cannot be determined from the type of collision alone.
Handle insurers and pursue a resolution
Counsel may communicate with insurers, assess settlement proposals, and negotiate on the client’s behalf. If settlement is not appropriate or cannot be reached, the lawyer may file suit and pursue the case through litigation. These are possible services and steps, not a promise of compensation or a particular result.

How long do you have to file a truck-accident claim?
There is no single nationwide filing deadline that can be determined from the fact that a crash involved a semi-truck. The applicable deadline and any notice requirements depend on the state, the date and circumstances of the crash, who is bringing the claim, and potentially whether a government entity is involved. Other rules—such as comparative-fault rules, damages law, and court procedures—can also affect a case.
The three-year accident-register period and six-month ELD-backup period described above are federal carrier recordkeeping duties; neither is the injured person’s lawsuit deadline. Contact a lawyer licensed in the relevant jurisdiction promptly so they can assess the actual deadlines and any steps that may need to be taken.

Do you need a lawyer after a semi-truck accident?
Not every collision requires hiring counsel, and a lawyer cannot guarantee a recovery. Legal help may be particularly useful when injuries are serious, responsibility is disputed, several people or companies may be involved, an insurer is requesting statements or offering a settlement, or there are questions about preserving or obtaining records. Whether to hire counsel is an individual decision; consider the complexity of the case and the consequences of deadlines and settlement terms.
How to evaluate a truck-accident lawyer
Ask questions that help you understand who will handle the matter, what work may be needed, and the financial terms. Confirm all answers and terms directly with the lawyer.
- What experience do you have with commercial-truck collision cases?
- Who will investigate and handle my matter, and who will communicate with me?
- What records, experts, or other investigation may be needed in this case?
- How and how often will you provide updates?
- What fee agreement applies? What costs may be charged, and how are they handled if there is no recovery?
- Are there conflicts of interest or other limitations that could affect your representation?
What the national truck-crash figures do—and do not—show
NHTSA reported that 5,788 people died in U.S. traffic crashes involving large trucks in 2021, and that 72% of those fatalities were occupants of vehicles other than the large truck. Those figures describe 2021, in material published by NHTSA in March 2023; they are not a current-year estimate. See NHTSA’s report on large-truck crash fatalities and injury severity.
NHTSA’s Fatality Analysis Reporting System (FARS) is a database of qualifying fatal crashes, compiled using state and other records, including police crash reports. It is useful for understanding fatal-crash patterns, not a substitute for investigating an individual collision. Public FARS data do not include personal identifying information.
