House Rejects Funding Block for Vehicle “Kill Switch” Mandate; Privacy Questions Remain

The House rejected a January 2026 attempt to block FY2026 funds for the 2021 vehicle impaired-driving mandate. That vote did not create a remote government kill switch, and NHTSA has not completed the required safety standard.

The House’s January 2026 vote did not create a new vehicle “kill switch” law. It rejected an amendment that would have barred funds in that appropriations act from being used to implement a 2021 requirement for future vehicle safety standards on impaired-driving prevention. The underlying law remains in place, but the technology, standard and privacy rules are not settled.

What did the House vote on in January 2026?

On January 22, Representative Thomas Massie offered an amendment to FY2026 appropriations legislation that would have prohibited funds provided by that act from being used to implement section 24220 of the Infrastructure Investment and Jobs Act. The House rejected the amendment. The vote therefore left the existing mandate intact; it did not enact a new mandate or itself order a new system installed in cars.

The amendment’s scope appears in the House Rules Committee report, and the Congressional Record documents the debate and proceedings. The disagreement was partly about how to describe the technology. Critics used “kill switch” to warn that a system might wrongly restrict a driver and raise privacy or liberty concerns. Massie called the prospect of a car becoming “your judge, your jury, and your executioner.” Supporters emphasized preventing impaired-driving deaths and argued that privacy should be addressed as the standard is developed. That phrase is political shorthand, not the name used in the statute.

What does the law actually require?

Section 24220, enacted on November 15, 2021, directs the Transportation Secretary, acting through the National Highway Traffic Safety Administration (NHTSA), to prescribe a Federal Motor Vehicle Safety Standard for covered new passenger vehicles. The statute calls the technology “advanced drunk and impaired driving prevention technology.” It describes two possible functional approaches:

The statute sets out functions, not a particular camera, breath sensor, touch sensor or other design. Its text does not say that the government may remotely switch off any car. The legal mechanism is a future safety standard specifying what covered vehicles must do. The law also allows extensions if the Secretary determines that the standard cannot meet the relevant statutory requirements on schedule.

The law’s findings cite 10,142 alcohol-impaired-driving fatalities in 2019 involving drivers with a blood-alcohol concentration of at least 0.08. That is a historical figure included in the 2021 statute, not a current annual fatality count.

Are new cars required to have an impaired-driving detector now?

Not under a completed NHTSA standard. In its 2026 report to Congress, NHTSA said it had found no commercially available technology in the evidence it reviewed that accurately and passively detects driver alcohol impairment. The agency also reported that no production-vehicle system could then passively measure blood-alcohol concentration or breath-alcohol concentration at or above 0.08 g/dL, and that available systems had not demonstrated the precision, speed and reliability needed to meet the statute or the Safety Act.

NHTSA said development and testing were continuing. As of that report, it had not completed the vehicle standard, established the necessary accuracy threshold, independently verified a production-ready system or finished relevant test procedures. The cited material does not establish a deployment date.

How do the two detection approaches differ?

The statute describes two broad routes to the same intended outcome: detect impairment passively, then prevent or limit operation. Their practical and policy questions are not identical.

Whether the measurement is accurate near the threshold across people and conditions, genuinely passive in use, and reliable enough to avoid both incorrect restrictions and missed detections.

NHTSA’s 2026 assessment described test methods and reliable countermeasures as works in progress. The statute does not select one approach or settle how a vehicle should respond if a system detects a concern after the vehicle is already moving.

Why are error rates a central safety issue?

A system can harm safety in either direction: a false positive could incorrectly restrict a sober driver, while a false negative could fail to detect an impaired driver. NHTSA cited an estimate of 227 billion U.S. driving trips annually from the AAA Foundation for Traffic Safety’s 2022 American Driving Survey. Against that scale, the agency said that even a hypothetical 99.9% detection accuracy could result in millions to tens of millions of annual instances of an incorrect restriction or missed detection.

The 99.9% figure is an illustration discussed by NHTSA, not measured performance of a product. The agency wrote, “Currently, detection technology around the legal limit continues to have an error rate that would be unacceptably high.” It also said it knew of no technology claiming accuracy close to what would be needed to minimize false positives and false negatives, and that no such capability had been independently verified at the time of the report.

What privacy concerns remain unresolved?

Depending on design, passive monitoring might use cameras, eye or head movement, breath or touch sensors, or vehicle behavior. Critics ask what data would be generated, whether it would be retained, and whether it could be transmitted beyond the vehicle. Section 24220 defines system functions but does not itself provide a detailed privacy or data-retention regime.

That statutory silence does not establish that every possible data type will be collected or sent to the cloud. Nor does the passive-safety framing establish that privacy questions are resolved. NHTSA’s standard-setting work will have to specify performance, and the materials available by the agency’s 2026 report and the September 2026 House update do not establish the eventual system design or complete privacy protections.

What other repeal or funding efforts are pending?

A September 2026 House office update said the full House had not yet taken up the bill. Would bar use of FY2027 funds to implement the mandate; it is a proposed funding restriction, not a repeal of section 24220.

These are distinct from the January 2026 House vote. A committee-approved amendment is not an enacted restriction, just as an introduced repeal bill is not a repeal.

What the House vote means for drivers

The January vote preserved the possibility of funding implementation under existing law by rejecting a proposed block on FY2026 funds. It did not establish that cars can be remotely disabled by the government, nor did it settle what an eventual system may detect, how accurately it must operate, how it handles a suspected impairment while driving, or what information it may retain or transmit. Those questions depend on the future NHTSA standard and remain open in the cited 2026 materials.
