Hawaii Has No State Highway Patrol—but You Can Still Be Pulled Over

Hawaii’s DOT Highway Division has no enforcement branch, but county police departments enforce traffic and safety rules. Here’s what that means for roadside stops and camera citations.

Yes. You can still be pulled over in Hawaii. The state’s Department of Transportation Highway Division has no enforcement branch; county police departments enforce traffic and safety rules. “No highway patrol” describes how enforcement is organized, not an exemption from traffic laws.

Why Hawaii has no state highway patrol

Hawaii’s Highway Division is part of the state Department of Transportation, but it is not a state police force. A Hawaii Senate committee report on HB 601 HD2 says the Highway Division “does not have an enforcement branch and relies on county police departments to enforce traffic and safety violations.” Read the committee report.

That is an organizational distinction: the state highway agency does not maintain its own highway-patrol enforcement branch. It does not mean there are no traffic officers or that traffic rules stop applying on state highways.

Who enforces traffic rules and gives tickets?

County police departments have an enforcement role. Hawaii DOT describes road-safety partnerships with the four county police departments on its Safe Communities page.

A DOT State Highway Enforcement Program report dated December 18, 2020, says that all four county police departments continued to issue citations for illegally parked vehicles. It also describes highway no-parking and towing signs coordinated with Maui County and Maui Police Department. Those examples show county involvement on state-highway matters, but the report is dated and focuses on its described program; it is not a current, comprehensive guide to every county department’s authority or enforcement activity. So if you are asking whether a driver can be stopped by police in Hawaii, the answer is yes. The absence of a state highway patrol does not establish that only state officers could make a stop, nor does it settle the precise legal authority for every kind of stop. The sources cited here describe the enforcement structure, not every circumstance in which an officer may stop a vehicle.

How roadside stops differ from red-light camera tickets

Hawaii also has an automated red-light enforcement program at listed Honolulu intersections. That is a separate process from a roadside stop:

What the sources do—and do not—establish about statewide authority

A statewide traffic rule can apply on a state highway even when county officers carry out enforcement. But a 2025 bill should not be treated as proof of current law: SB 662 CD1 proposed language stating that each county police officer could enforce the statewide traffic code on federal, state, or county streets, roads, and highways. The bill text alone does not establish that the proposal became law. View SB 662 CD1.

Accordingly, this article does not present that proposed provision as enacted law or claim to resolve every officer’s legal authority in every situation. For a specific legal question, consult current Hawaii law or a qualified Hawaii attorney.
