Yes. Fisker Group Inc. filed for Chapter 11 bankruptcy on June 17, 2024; Fisker Inc. and its other U.S. subsidiaries filed two days later. The court confirmed a liquidation plan on October 16, 2024. The plan documents a sale of Fisker’s vehicle fleet and arrangements related to some recall repairs and the Ocean’s connected services, but it does not guarantee that every owner can obtain repairs, warranty coverage, or working software features.
Did Fisker file for bankruptcy?
Yes. Fisker Group Inc., a subsidiary of Fisker Inc., filed a voluntary Chapter 11 case in the U.S. Bankruptcy Court for the District of Delaware on June 17, 2024. Fisker Inc. and its other U.S. subsidiaries filed on June 19. The cases were jointly administered as In re: Fisker Inc., et al., Case No. 24-11390 (TMH). The SEC filing records the filing dates and case details.
Chapter 11 initially allowed the debtors to operate as debtors in possession while the cases proceeded. That describes the opening posture of the bankruptcy, not evidence that Fisker continues to operate normally today.
What happened after the filing?
The court confirmed a liquidation plan
On October 16, 2024, the court confirmed Fisker’s joint Chapter 11 plan of liquidation. The confirmation order and attached plan document a sale of the vehicle fleet to American Lease, along with liquidation-related trusts and transactions. The case therefore moved toward winding down and resolving claims, rather than a confirmed reorganization of Fisker into a continuing automaker. The court confirmation materials are available through the case record.

Case administration continued into 2026
A docket index lists filings through September 21, 2026, including post-confirmation motions involving the liquidating trustee. That shows the case administration continued after plan confirmation; it does not establish when the case will close or how much any particular creditor will receive. The docket index lists the subsequent activity.
Filing estimates were not final recoveries
Fisker Group’s 2024 filing estimated assets of $500 million to $1 billion and liabilities of $100 million to $500 million, and listed a creditor-count range of 200 to 999. The Associated Press reported those filing figures; they are estimates and a range, not final sale proceeds or creditor recoveries. The AP report gives the filing estimates and Fisker’s statement at the time.

What happens to Fisker Ocean owners after bankruptcy?
The plan records limited arrangements affecting some owner support, but it does not promise that every Ocean owner will have access to a working repair channel or connected feature. The practical effect depends on the particular issue, the applicable plan terms, and whether a relevant service provider is available to that owner.
Recall-related repairs
The confirmed plan provides a process for owners to seek certain recall-related repairs through an authorized dealer or another service provider. That is a defined category and process, not a blanket commitment that all repairs are available everywhere or that all mechanical and software problems qualify. Owners should verify that a proposed provider can work on the Ocean and can perform the specific repair in their area.

Is my Fisker Ocean warranty still valid?
The plan says the debtors are not assuming specified warranty obligations under rejected contracts, while separately preserving certain warranties provided to or for the benefit of the debtors. Those provisions do not establish a universal answer for every warranty or every owner’s legal rights. Check the warranty language and the circumstances of the claim; the plan’s general wording alone does not resolve an individual dispute.
Will Fisker Ocean software updates still work?
The confirmation materials include an October 11, 2024 agreement for a five-year, non-exclusive license covering the Fisker Ocean connected environment. Its stated term runs from January 1, 2025, through December 31, 2029. The agreement describes the environment as provided “as is” and sets support obligations within its scope, including an exclusion for vehicles whose owners elect not to remain under the connected environment. The term sheet and related confirmation documents are in the court materials.

The license establishes an arrangement, not that a particular feature is currently functioning, that updates will be delivered, or that every owner has equal access. The term sheet’s “as is,” “where is” language and disclaimers apply to that license arrangement; they do not necessarily determine every separate relationship between an owner and another party.

In an SEC filing signed August 15, 2024, Fisker Inc. said it expected its existing common stock to be cancelled and holders to receive no amounts through the Chapter 11 cases. That is the company’s stated expectation in that filing, not a determination of an individual investor’s legal position or a statement of current trading status. The SEC filing contains the company’s statement about common shares.
