The EU’s expected tariffs on Chinese electric cars became definitive duties in October 2024. The European Commission set additional countervailing duty rates from 7.8% to 35.3% on covered new battery-electric passenger vehicles originating in China, with the measure set to last five years. The rates depend on the exporter; they are not a direct forecast of how much a buyer’s showroom price will rise.
When did the EU tariffs on Chinese EVs take effect?
On 4 October 2024, the European Commission said EU Member States had given the proposal the necessary support and that the definitive regulation had to be published by 30 October at the latest. The Commission finalized the duties on 29 October 2024 and said they would apply from the day after publication in the Official Journal. The legal instrument is Commission Implementing Regulation (EU) 2024/2754. The Commission’s announcement said the definitive duties would be collected once in force; provisional duties imposed on 4 July 2024 would not be collected.
In January 2026, the Commission described the countervailing duties as in place and published guidance for possible exporter price-undertaking offers. That guidance did not announce that an offer had been accepted. The Commission’s 4 October 2024 statement, its 29 October 2024 decision announcement and its 12 January 2026 guidance set out these milestones.
What are the tariff rates by exporter?
The Commission announced the following definitive countervailing duty rates. A company-specific rate is distinct from the rate applied to cooperating companies as a group or to non-cooperating companies.

These are the Commission’s announced duty rates, not a calculation of the total customs burden: no baseline tariff or importer-specific customs calculation is included here. Nor does a duty rate establish an equal percentage change in a vehicle’s retail price. What buyers ultimately pay can depend on importer pricing, the model and market, and applicable taxes. The Commission’s 29 October 2024 announcement gives the rates and says the measure would be imposed for five years.
Which vehicles are covered?
The measure applies to new battery-electric vehicles designed for passenger transport and originating in China. It should not be read as a tariff on every vehicle associated with a Chinese-owned brand, or as a duty on hybrids generally. The relevant distinction is the vehicle’s product category and origin, not simply the nationality of a brand’s owner.

Why did the Commission impose the duties?
The Commission said its anti-subsidy investigation found that China’s battery-electric vehicle value chain benefited from unfair subsidization that threatened economic injury to EU BEV producers. That is the Commission’s stated finding behind the measure. It said interested parties, including the Chinese government and exporters, had opportunities to submit comments, evidence and arguments.

The Commission said in October 2024 that it remained open to an effective, WTO-compatible alternative. In guidance published on 12 January 2026, it described how exporters could submit possible price-undertaking offers while the duties were in place. The guidance covered minimum import prices, sales channels, cross-compensation and future EU investment; offers remained subject to legal criteria and objective, fair and non-discriminatory assessment under WTO rules.
