Sometimes, but not automatically. Uninsured-motorist property-damage (UMPD) coverage can pay a luxury car’s post-repair diminished value in some states and under some policy forms. Whether you can recover anything depends on your state’s law, whether you bought UMPD, the exact definition of covered damage, policy limits and deductibles, and your evidence that the repaired car is worth less.
Luxury status can increase the dollar amount of a provable market loss because the car’s pre-accident value is part of the valuation. It does not create a separate coverage right, guarantee payment, or make an ordinary collision claim equivalent to a UMPD claim.

What coverage could pay diminished value?
There are usually three possible payment paths after an uninsured driver damages your car. They are legally and contractually different, so ask the insurer which one is handling your claim.

UMPD is an optional or separately selected part of uninsured-motorist coverage in many policies. It is designed to respond when the at-fault driver has no liability insurance, subject to the policy’s conditions. Some UMPD wording treats covered damages broadly enough to include a loss in market value after repairs. Other policies exclude diminished value or limit payment to repair costs, actual cash value, or a stated property-damage limit.

The National Association of Insurance Commissioners’ Journal of Insurance Regulation describes UMPD availability and first-party diminished-value treatment as inconsistent among states and policies. In some jurisdictions, property-damage UM coverage must be requested rather than assumed to be included.
Collision coverage
Your collision coverage may pay to repair damage caused by the uninsured driver, less the collision deductible. That does not mean it will also pay a separate amount for the car’s reduced resale value. Texas Department of Insurance Bulletin B-0027-00, dated April 6, 2000, says standard first-party collision and comprehensive terms generally do not require diminished-value payment when a vehicle is completely repaired to its pre-damage condition. The same bulletin distinguishes UM/UIM coverage, under which an insurer may still owe a first-party claimant for loss of market value.
The other driver’s liability coverage
If the driver was insured, a diminished-value claim may be presented to that driver’s liability insurer where state law permits. That is a third-party claim, not a UMPD claim. When the driver is uninsured, there is no liability policy to make that payment, which is why the terms of your own UM coverage become important.

Why a luxury car’s status matters, and what it does not change
Diminished value is a market-loss question: what would a willing buyer have paid for the same vehicle immediately before the crash compared with the repaired vehicle afterward? A higher pre-accident value can produce a larger dollar difference if the percentage loss is similar. Distinctive options, limited production, documented service history, mileage, prior damage, and the quality and visibility of the repairs can affect the comparison.

Those factors affect the amount of loss you must prove, not whether coverage exists. Neither the NAIC discussion nor the state guidance identified a nationwide rule giving luxury vehicles special UMPD rights. A high price tag alone does not establish that the car lost value, and a low-dollar repair does not prove that it did not.
High-value vehicles can also be harder to value because there may be fewer genuinely comparable sales. A qualified appraiser who understands the relevant model, options, market and accident history may therefore be useful, especially when the claimed loss is substantial. An appraisal is evidence; it does not override an exclusion, create coverage, or guarantee settlement.
Compare the possible claim routes
| Claim route | Coverage source | What may be paid | Questions to answer |
|---|---|---|---|
| UMPD | Your uninsured-motorist property-damage coverage | Repair cost, actual cash value, diminished value, or another amount only as the policy and state law allow | Was UMPD selected? Is diminished value included? What limit, deductible and exclusions apply? |
| Collision | Your own collision coverage | Usually the covered physical damage, subject to the collision deductible and policy terms | Does the form exclude a separate market-value loss after complete repairs? |
| Third-party liability | The at-fault driver’s liability insurer | Damages recognized under the applicable state law and liability policy | Was the driver insured, and does local law recognize this type of loss? |
Do not let an adjuster’s use of the word property damage obscure the coverage part being applied. Request the answer in writing, including the policy provision and state rule the insurer believes controls.

- Read the declarations page. Look for uninsured-motorist property damage, uninsured-motorist coverage, or a similar property-damage designation. Record the limit and deductible.
- Read the endorsements and definitions. Search for terms such as diminished value, loss of market value, actual cash value, repair, betterment, exclusion, appraisal and property damage. The declarations page alone may not contain the operative wording.
- Confirm whether UMPD was elected. Some policies include it automatically; others require a selection or rejection. Do not infer coverage from having bodily-injury UM limits.
- Check notice requirements. Policies commonly impose prompt-reporting, cooperation and proof-of-loss duties. Follow the instructions even while coverage is being investigated.
- Ask the insurer to identify the route. Send a written question: Is the claim being adjusted under UMPD, collision, or another coverage? Which clause addresses diminished value? What deductible and limit will be used?
- Obtain the repair documentation. Keep the estimate, supplement history, final invoice, parts information, alignment or calibration records, photographs and any warranty paperwork.
- Preserve condition and value evidence. Gather pre-loss service records, photographs, purchase or appraisal documents, mileage, equipment lists and comparable market listings. Keep records showing the vehicle’s post-repair condition.
- Submit a specific demand. State the amount claimed, explain the valuation method used, attach supporting records and identify the policy section under which payment is requested. Separate repair costs from diminished value so the adjuster cannot treat them as one unexplained figure.
How to prove that repairs left a market loss
The claimant generally bears the burden of proving diminished value. Florida’s Department of Financial Services describes the loss as subjective and says Florida has no definitive statutory calculation method. That illustrates why a conclusory percentage or an online calculator may be challenged.

Build a before-and-after record
- Document the vehicle’s pre-crash mileage, condition, options, maintenance and prior accidents.
- Identify the exact damaged components and whether repairs used original, aftermarket or recycled parts, where that information is relevant under the policy or market.
- Record paint, panel, structural, sensor, alignment and fit-and-finish issues that remain after repair, if any.
- Preserve the vehicle-history information a potential buyer would see, including the accident entry and repair description.
- Use comparable vehicles with similar model year, mileage, trim, equipment, condition and location rather than broad luxury-car averages.
Consider an independent appraisal
The NAIC-published article notes that a professional appraiser may be needed. Choose someone who can explain the comparable sales, adjustments and assumptions in a written report. Ask in advance whether the appraiser has experience with the particular model and whether the fee is refundable or potentially recoverable; the cited guidance does not promise that an insurer will pay the appraisal fee.
An appraiser cannot fix a coverage problem. If the policy excludes diminished value, a persuasive valuation report may still result in a denial. Conversely, a policy that covers market loss may require better proof than a repair invoice alone.
What state examples show about the rules
Texas
Texas Department of Insurance consumer guidance, last updated October 14, 2024, lists diminished value when a car is worth less after an accident among possible UM/UIM benefits. That guidance describes a $250 property-damage deductible for the Texas UM/UIM coverage discussed and says coverage can generally be increased in $5,000 increments. Those figures are Texas-specific and do not establish a national deductible or limit.

Texas Bulletin B-0027-00 draws a separate line between ordinary first-party collision and UM/UIM. It says an insurer generally is not obligated under standard collision or comprehensive terms to pay diminished value when repairs restore the vehicle to its pre-damage condition. It also says an insurer may be obligated under UM/UIM provisions to pay a first-party claimant for loss of market value regardless of how complete the repair is. The bulletin is from 2000, so current policy language and current Texas law still need to be checked.

Maryland
A Maryland appellate opinion recounts a State Farm UM property-damage provision that defined damages to include repair costs, actual cash value and diminished value, if any. That is an example of wording in a particular dispute, not a rule that every Maryland policy or every state follows. The operative form for your policy controls.
North Carolina
North Carolina has a statutory appraisal procedure for certain disputed motor-vehicle diminution-in-value estimates. The procedure applies only when liability for coverage is not disputed, the estimates satisfy the statute’s conditions, and a party makes a written demand. The disagreement threshold is tied to $2,000 or 25% of the vehicle’s pre-accident fair-market retail value, whichever is less. It is a state-specific process, not a nationwide claim threshold or valuation formula.
Florida
Florida’s Department of Financial Services says diminished value is subjective, places the burden of proof on the claimant and does not identify a definitive statutory calculation method. A Florida claimant should therefore expect the quality of the evidence and the policy wording to matter more than an assumed standard percentage.
Idaho
Idaho’s Department of Insurance says an insurer is not obligated to pay diminished value unless the policy says otherwise. This is a direct reminder to read the contract rather than assume that a general idea of fairness creates coverage.

Why an insurer may deny or reduce the claim
- No UMPD coverage: The policy may contain UM bodily-injury coverage but no property-damage protection.
- Exclusion or narrow definition: The form may cover repair expense or actual cash value without covering a separate post-repair market loss.
- Deductible and limit: A deductible can absorb a small claim, while a property-damage limit can cap a larger one.
- Insufficient proof: A demand that states only a percentage, without vehicle-specific evidence, may not establish the loss.
- Pre-existing damage: Prior accidents, wear, modifications or title issues can reduce the amount attributable to this crash.
- Untimely notice or incomplete cooperation: Failure to meet policy procedures can create a separate coverage dispute.
- Liability or causation dispute: Some appraisal procedures, including North Carolina’s, are available only when coverage liability is not disputed.
Ask for a written explanation that identifies the exact exclusion, limit, deductible, factual assumption or state rule being used. Correct factual errors with documents rather than relying on a telephone conversation.
What to do if the amount is disputed
- Request the insurer’s written position and the policy language supporting it.
- Ask whether the dispute concerns coverage, the amount of loss, causation, or documentation. Each issue requires different evidence.
- Review the policy’s appraisal or arbitration clause. An appraisal clause may address the amount of loss while leaving coverage questions for another process.
- Check for a state procedure. North Carolina’s written-demand process is an example, but its conditions do not transfer to other states.
- Provide a focused appraisal report or supplemental evidence addressing the insurer’s stated objection.
- File a complaint with the state insurance regulator if the handling appears inconsistent with the policy or applicable claims rules.
- Consult a lawyer who handles insurance or diminished-value disputes when the claimed amount is significant, the policy language is unclear, or a deadline is approaching.
Do not sign a release that includes diminished-value claims until you understand exactly which damages it settles. A payment for repairs may not resolve a separate market-value claim, but the release language can affect that question.
Illustrative example: why the numbers cannot be assumed
Suppose an uninsured driver damages a high-value sedan. The car is repaired, but the accident appears in its history. An appraiser might compare the vehicle’s documented pre-crash condition and equipment with sales of similarly equipped, similarly driven vehicles that have and have not sustained comparable damage. The resulting estimate could be accepted, negotiated or rejected depending on the policy and state law.
The example does not establish a percentage, a guaranteed payment or a universal formula. A different model, prior accident history, repair quality, market or policy could produce a different result. The useful lesson is to separate three questions: is there coverage, is there a provable loss, and what procedure resolves disagreement?
Checklist before you submit a diminished-value demand
- Police or incident report identifying the other driver and insurance status.
- Declarations page and complete policy endorsements showing UM/UMPD selections.
- Policy limit, deductible, exclusions and notice requirements.
- Repair estimate, supplements, final invoice and photographs.
- Pre-accident service, condition, mileage and equipment records.
- Post-repair inspection and any remaining defect documentation.
- Vehicle-specific comparable sales or a qualified appraisal.
- A written explanation of the amount claimed and the method used.
- A copy of every submission, email, estimate and insurer response.
Bottom line
UMPD may pay a luxury car’s diminished value after an uninsured-driver crash, but only when the applicable state law and policy terms allow it and the owner proves a market loss. Luxury status can influence the amount, not create coverage. Verify the coverage part, limit, deductible, exclusions and dispute procedure before relying on a diminished-value claim.
