The published reports do not independently verify her account, and the Ninth Circuit’s 2025 ruling did not decide whether the alleged threat or a brake-related defect occurred.
What did Cristina Balan say happened?
In an April 20, 2025 report, Electrek described Balan as a former Tesla engineer and reported that she said she raised a concern in 2014 about Model S floor mats curling near the brake pedal and potentially interfering with braking.
Balan said she tried to bring the issue to Elon Musk after he had invited Tesla employees in a 2013 company-wide email to contact anyone at the company to solve problems. Electrek reproduces the email as saying: “Anyone at Tesla can and should email/talk to anyone else according to what they think is the fastest way to solve a problem for the benefit of the whole company.” It also reproduces the next sentence: “Moreover, you should consider yourself obligated to do so until the right thing happens.” These are the words as quoted by Electrek; the original email was not separately examined for this account.
Balan alleged that, in a meeting after she sought to raise the concern with Musk, a Tesla lawyer threatened that members of her team whose green-card applications were pending would be deported unless she resigned. The report attributes the alleged threat to the lawyer—not to Musk personally. Balan’s reported description of Musk as “pure evil” is her opinion, not a court finding.

Was the allegation independently confirmed?
No independent confirmation is established by the cited coverage. InsideEVs reported on April 21, 2025, that it had not independently confirmed Balan’s account and had not spoken with her; it said it had reached out to Tesla. The allegation should therefore be understood as Balan’s account, not as an established finding.
What did the Ninth Circuit decide?
On April 14, 2025, the Ninth Circuit issued its opinion in Tesla Motors, Inc. v. Balan, No. 22-16623. The court vacated a district court order confirming a zero-dollar arbitration award in favor of Tesla and Musk, concluding that the district court lacked subject-matter jurisdiction to confirm the award under the Federal Arbitration Act. It remanded with instructions to dismiss that confirmation action.

That was a ruling about the court’s jurisdiction over the confirmation action. It did not decide whether Balan’s account of the lawyer’s alleged threat was true or whether the floor mats presented a safety defect. The appellate court did not find that Tesla threatened deportation, and its decision should not be described as Balan winning the underlying dispute.

The Ninth Circuit’s opinion recounts that an arbitrator had dismissed Balan’s defamation claims against Tesla and Musk under California’s one-year statute of limitations and issued an award in their favor. That limitations ruling and the appellate decision address different questions: the arbitrator’s ruling concerned whether the defamation claims were timely, while the Ninth Circuit considered whether the district court had jurisdiction to confirm the resulting award. The appellate court vacated the confirmation order; it did not decide the truth of the underlying allegations.
