The Supreme Court’s 17 December 2025 order protects owners of BS-IV and newer vehicles from coercive action based solely on age: the 10-year threshold for diesel vehicles and the 15-year threshold for petrol vehicles. It does not grant every old vehicle blanket permission to drive. The Ministry of Road Transport and Highways confirmed this limited scope in a Rajya Sabha answer on 25 March 2026. The latest court order available for this update listed the case for 6 January 2026; whether a later order changed the position has not been established.
What the Supreme Court order means for your vehicle
The answer depends on the vehicle’s fuel, emission standard and the reason an authority is taking action. The December order’s protection is against coercive steps on the ground of age, and only for BS-IV or later emission versions.

The order is not a general declaration that all qualifying vehicles may be driven in every circumstance. It does not establish that registration, fitness, pollution-control documentation, restrictions under a particular GRAP stage or other applicable directions cease to matter. Check the current requirements that apply to your vehicle and route.
Why there is an age rule, and how the court changed its position
The age thresholds originated in an NGT order of 7 April 2015, which restricted diesel vehicles more than 10 years old and petrol vehicles more than 15 years old from plying in the NCR. The Supreme Court affirmed that restriction in M.C. Mehta v. Union of India, W.P.(C) 13029/1985, on 29 October 2018. The Ministry of Road Transport and Highways recounted this history in its Rajya Sabha answer of 25 March 2026.

The operative December wording says “no coercive steps be taken against the owners of the vehicles of BS-IV and later emission versions” on the specified age grounds. This is an interim enforcement direction, not an unconditional cancellation of the underlying age restriction for every vehicle.
Age-based action is not the same as fuel denial
CAQM Direction No. 89 is a separate mechanism concerning end-of-life vehicles and denial of fuel. On 17 October 2025, CAQM said implementation of that direction was in abeyance until further orders, citing the Supreme Court’s 12 August order. That statement predates the Court’s 17 December modification. The subsequent status of Direction No. 89 has not been established here, so do not assume the October abeyance notice settles its present operation.

Earlier, on 8 July 2025, CAQM announced revised fuel-denial implementation dates: 1 November 2025 for Delhi and five high-vehicle-density NCR districts, and 1 April 2026 for the rest of NCR. That announcement came before the October abeyance and is not, on its own, evidence of the current timetable. Delhi had reported implementation challenges including technical glitches, camera placement and incomplete integration with neighbouring states’ databases.
How to check which situation applies to your car
- Confirm the fuel and age. The underlying thresholds differ: more than 10 years for diesel and more than 15 years for petrol. The Supreme Court’s December protection addresses those thresholds.
- Verify the emission standard. Check the vehicle’s registration and other official vehicle records to establish whether it is BS-IV or later. The interim protection is limited to those emission versions.
- Identify the stated reason for any enforcement. The order concerns coercive steps based on age. Ask which rule or direction is being applied if the issue is fitness, registration, pollution-control documentation, GRAP or another ground.
- Check current official notices before driving. Consult the latest Supreme Court order and the relevant transport or CAQM notice for Delhi-NCR. The case was listed for 6 January 2026, but a later court order is not established by the available materials.
- Keep fitness and registration documents current. The Ministry describes fitness testing under the Motor Vehicles Act and Central Motor Vehicles Rules. If a vehicle is found unfit, registered vehicle scrapping facilities are among the options described in the national framework.
National measures such as Automated Testing Stations and Registered Vehicle Scrapping Facilities address vehicle fitness and fleet modernization; they do not, by themselves, repeal NCR-specific court directions.

What the published vehicle counts do—and do not—show
A December 2025 parliamentary committee report recorded 28,370 end-of-life vehicles impounded through 30 June 2025, according to the Government of NCT of Delhi. The Ministry of Road Transport and Highways also reported approximately 2.2 crore vehicles with valid registration and fitness in Delhi-NCR, including about 2.8 lakh identified as non-compliant with the age rule. These are dated figures reported in that context, not current totals or a basis for estimating today’s share of affected vehicles.
