Possibly—but only in the narrow sense that a reported $60 million settlement proposal could have ended the case before trial if Tesla had accepted it and the agreement resolved the claims. A filing described by TechCrunch says Tesla did not accept the plaintiffs’ proposal within 30 days in May 2025. A jury later returned an award that Tesla’s 2026 quarterly filing breaks down as $129 million in compensatory damages and $200 million in punitive damages, with Tesla assigned 33% of the fault. The sequence does not establish why Tesla did not accept, or prove that settlement would certainly have prevented a verdict.
What the $60 million settlement filing says
In May 2025, the plaintiffs made a $60 million proposal for settlement, according to a filing reported by TechCrunch on August 25. The filing sought to have Tesla cover the plaintiffs’ legal fees. A representative for the plaintiffs’ attorney told TechCrunch that the proposal was rejected by default when Tesla did not accept within 30 days.
“Both Proposals for Settlement were served in compliance with and pursuant to Florida Rule of Civil Procedure 1.442 and Fla. Stat. § 768.79. Tesla did not accept Plaintiffs’ Proposals for Settlement within thirty (30) days of service. Therefore, Tesla rejected the Proposals for Settlement by operation of the rule and statute.”
That is the filing’s account as reproduced by TechCrunch—not a judicial finding that Tesla acted wrongly by declining the offer, or a ruling that accepting it would necessarily have resolved every claim. The available account does not establish Tesla’s internal reasoning for not accepting.

What happened in the crash and what claims reached trial
The crash occurred in Key Largo, Florida, on April 25, 2019. George McGee was driving a 2019 Tesla Model S equipped with Autopilot when it struck a parked Chevrolet Tahoe. The Tahoe then struck Naibel Benavides Leon, who died, and Dillon Angulo, who was injured.
Benavides Leon’s estate filed suit in 2021. Tesla removed the case to federal court, and Angulo later filed a related action that was consolidated with it. The complaint included four theories: defective design, failure to warn, defective manufacture, and negligent misrepresentation.

Not all four went to the jury. On June 25, 2025, the court granted Tesla summary judgment on defective manufacture and negligent misrepresentation. The trial addressed defective design and failure to warn. The verdict therefore should not be read as a jury decision on every claim originally asserted.
How the jury’s award adds up
The jury returned its verdict on August 1, 2025. The component figures matter because the total damages, Tesla’s share of compensatory damages, and punitive damages are different measures.

Tesla’s second-quarter 2026 Form 10-Q reports the $129 million compensatory award, the 33%/67% allocation, and the $200 million punitive award. The Associated Press summarized the result as $243 million in total damages and described Tesla’s compensatory share as $43 million. The headline figure of approximately $242.5 million reflects adding Tesla’s apportioned compensatory share to the punitive award; it is not the same as the $129 million total compensatory award.
What happened after the verdict
Tesla asked the trial court for judgment as a matter of law, a new trial, or an amendment of the judgment. On February 19, 2026, U.S. District Judge Beth Bloom denied that post-trial motion. Her order said the arguments largely repeated points the court had already considered and rejected, and that the admitted evidence supported the verdict.

“Furthermore, Tesla does not present additional arguments or controlling law that persuades this Court to alter its earlier decisions or the jury verdict.”
The quoted sentence is from Judge Bloom’s February 19 order. It explains why the trial court declined to disturb its earlier decisions or the jury verdict; it does not resolve the appeal.

Where the appeal stood as of October 8, 2026
Tesla’s Form 10-Q for the quarter ended June 30, 2026 says it filed an opening brief in the U.S. Court of Appeals for the Eleventh Circuit on July 2, 2026. The filing is the latest appeal milestone established by the sources here; they do not establish an appellate decision. Tesla says it believes the facts and law do not justify the damages and reports an immaterial accrual. Those are the company’s positions, not findings by the trial judge.
After the verdict, Tesla also said it planned to appeal “given the substantial errors of law and irregularities at trial,” as reported by TechCrunch. That phrase characterizes Tesla’s view; the court’s February 2026 order denied its request for post-trial relief.
