Car Accident Attorneys: When to Hire One and What to Expect

A practical guide to deciding whether to consult a car accident attorney, comparing counsel, understanding contingent-fee terms, and preserving crash and insurance information.

A car accident attorney can advise and represent you in a crash-related legal matter, but not every collision calls for one. A conversation is especially worth considering after a serious crash involving injury or significant property damage, or when fault, insurance coverage, or the value of a claim is disputed. Your options and deadlines depend on the state and the facts.

When should you talk with a car accident attorney?

The American Bar Association (ABA) recommends talking with a lawyer after a serious accident involving personal injury or property damage. You may also want an assessment if injuries are serious or ongoing, more than one person may be responsible, the insurer disputes fault or coverage, or you are unsure what a settlement release would require you to give up. These are reasons to seek advice, not promises that a lawsuit or a particular recovery is warranted.

Personal injury claims are often negotiated with insurers and rarely go to trial, according to the ABA, but that general observation cannot predict how an individual claim will proceed. Get location-specific advice about deadlines and liability rules rather than assuming one national rule applies. ABA: Finding the Right Lawyer

What can an attorney do—and what decisions remain yours?

An attorney can advise you about legal issues, assess evidence, communicate or negotiate with an insurer, and pursue litigation when appropriate. If negligence is disputed in a lawsuit, a judge or jury evaluates the evidence under applicable law; the attorney does not decide who is at fault. Nor can an attorney control an insurer or guarantee that another party will pay.

A lawyer can help assess an offer and explain its implications, but you decide whether to accept it. A settlement commonly involves receiving money in exchange for dropping a claim or action, often by signing a release of further liability. Read and understand the release before signing, since it may end your ability to pursue further claims against the other side. ABA: Settling a Case

What are contingent fees?

In a contingent-fee arrangement, the attorney receives an agreed share of a recovery. The ABA gives “often one third” as a general example, not a required rate or a reliable national average. Percentages and permitted terms vary by agreement and state rules.

A contingent fee does not necessarily mean you owe nothing if there is no recovery. Filing fees, deposition costs, and similar case expenses may still be payable by you. Ask for the terms in writing and clarify how costs are handled before signing.

Questions to settle before signing

  • What percentage applies if the case settles, goes to trial, or is appealed?
  • Are expenses deducted from the recovery before or after the attorney’s fee is calculated?
  • Which costs might you owe even if there is no recovery?
  • Does the fee change if the case settles before filing or proceeds to trial?
  • What happens to fees and costs if the case resolves quickly or you change lawyers?

ABA Model Rule 1.5 says a contingent-fee agreement should be in a writing signed by the client and specify how the fee is calculated, including the applicable percentages and treatment of expenses. How do you choose a lawyer?

Compare more than the quoted fee. The ABA suggests considering location, accessibility, personality, time available, and experience with the relevant legal problem. A low or high fee alone does not show which lawyer is the right fit. Ask whether an initial consultation costs anything before booking. ABA: Finding the Right Lawyer

  • Who will handle the case day to day, and how will updates be communicated?
  • What experience does the attorney have with similar injuries or insurance disputes?
  • What are the fee percentage and expense terms at each case stage?
  • Which decisions remain yours, including whether to accept a settlement?

For help finding counsel, check your state bar or a local lawyer-referral service. Licensing and referral options are local, so confirm that a lawyer is authorized to practice in the relevant jurisdiction. ABA: Lawyer Referral

What should you document after a crash?

Prioritize safety. If anyone is injured, call emergency services. If a vehicle can be moved and it is safe to do so, move it out of traffic. Then, when safe, preserve details that may help with insurance or a legal assessment:

  • Names and contact information for drivers and witnesses, plus the other driver’s insurance details.
  • Responding officer information and any report details available to you.
  • The date, time, exact location, weather, road conditions, and visible scene details.
  • Photos of the vehicles and scene, or a sketch if photographs are not practical.

The National Association of Insurance Commissioners (NAIC) also recommends contacting your insurer promptly, keeping notes of conversations, asking questions, and requesting written explanations of claim decisions. You do not need to feel rushed into accepting an offer. If a claim-handling or settlement disagreement remains unresolved, the NAIC suggests contacting your state insurance department. Why do state rules matter?

Negligence generally concerns whether someone failed to use reasonable care, assessed against the evidence and applicable law. States differ in how a claimant’s share of fault affects a recovery. The ABA describes comparative fault as common, but that does not establish the rule in every state. Deadlines, insurance processes, lawyer licensing, and fee rules also vary, so confirm the rules for the state connected to your claim rather than relying on a generic percentage or deadline.
