A robotaxi’s involvement does not, by itself, prove that its operator, vehicle manufacturer, or automated-driving-system provider was at fault. The company that ran the ride may not be the company that made or owned the vehicle, and California’s insurance and financial-responsibility rules do not guarantee a particular payout.
Who might be responsible after a California robotaxi crash?
Start by identifying the roles involved in the ride and the collision. Depending on the facts, potentially relevant parties may include the passenger-service operator, vehicle owner, vehicle or automated-driving-technology manufacturer, another driver, or more than one of them. California DMV permits and California Public Utilities Commission authority regulate different aspects of autonomous vehicles and passenger transportation; those roles do not necessarily belong to the same company.

These are parties to investigate, not a finding that any one of them is liable. The relevant evidence and legal theory depend on the particular crash.
What does California’s $5 million AV requirement mean?
California Vehicle Code section 38750 and the DMV’s adopted AV regulations require an AV manufacturer, in the specified regulatory context, to demonstrate financial responsibility of $5 million for judgments arising from AV operation. Qualifying ways to demonstrate it include insurance, a surety bond, or self-insurance. This is a regulatory financial-responsibility requirement—not an automatic payment to a crash victim, a guaranteed recovery, or the limit of every robotaxi’s operating policy.

For an individual claim, the applicable entity, financial-responsibility instrument, policy, and circumstances of the collision have to be established. The $5 million figure alone does not answer who pays or how much a claimant may recover.
Does TNC insurance cover a driverless robotaxi?
Not automatically. The CPUC’s transportation network company (TNC) overview describes insurance requirements tied to a participating driver’s app use. It lists at least $1 million in primary commercial coverage after a match is accepted and during the passenger trip. That is a TNC requirement for the specified periods, not a universal policy limit for driverless robotaxis.

To determine which framework may apply, establish whether the service was a TNC or another type of passenger service, whether a participating driver was involved, the vehicle’s operating status, and which policy or financial-responsibility instrument covered the relevant entity and event.
What evidence may matter?
California Vehicle Code section 38750, in the 2025 code text, calls for a separate mechanism to capture and store at least 30 seconds of pre-collision autonomous-technology sensor data when a vehicle collides while operating in autonomous mode. The statute says that data is to be preserved for three years.

This makes preservation of vehicle data a relevant issue, but it does not mean a claimant can obtain it informally or that the recording alone will establish fault. Collision, trip, and incident records may also be important. How to preserve and obtain particular records depends on the case.
- Identify the service operator, vehicle owner, and vehicle or AV-technology manufacturer.
- Determine whether the vehicle was operating in autonomous mode and whether the ride was a passenger service or a test operation.
- Record what injuries or property damage occurred and what collision, trip, and incident records are available.
- Find out which insurance policy or financial-responsibility instrument applied to the relevant entity and event.
- Ask how potentially relevant records and sensor data can be preserved and obtained through appropriate channels.
How do you report an incident involving a robotaxi?
The California DMV’s public incident page provides a route to report an incident or safety concern involving an AV on California public roads and points to the National Highway Traffic Safety Administration (NHTSA) complaint process. These are safety-reporting channels; a regulatory report is not a civil lawsuit and should not be treated as preserving every legal right or deadline.

The California Driver’s Handbook sets out general collision duties and reporting guidance, including a DMV report within 10 days in specified circumstances involving injury, death, or property damage. Those instructions are general driver guidance; they do not determine a company’s liability and may not map neatly to every injured passenger’s role. Check the official guidance for the situation that applies.

What should you do if you were involved in a real crash?
- Address immediate safety and collision reporting. Follow applicable emergency and reporting instructions for the circumstances. The handbook’s 10-day DMV reporting guidance applies only to the specified circumstances and roles it describes.
- Record the ride and vehicle details. Note the service used, trip status, vehicle identification details available to you, and any incident or trip records you have.
- Keep track of harm and available records. Document injuries or property damage and retain relevant collision, trip, and incident information.
- Get case-specific legal advice promptly. A qualified California attorney can assess potentially responsible parties, legal theories, deadlines, and how evidence may be preserved or obtained.
