Yes—usually, if the specific car is at least 25 years old from its date of manufacture. The National Highway Traffic Safety Administration (NHTSA) allows a vehicle that has reached that age to enter without meeting every U.S. Federal Motor Vehicle Safety Standard (FMVSS), even when it was originally built for another market. You must document the vehicle’s manufacturing date and declare the correct basis on NHTSA Form HS-7.
That safety exemption is only one part of the process. The Environmental Protection Agency (EPA) applies separate emissions rules, and a vehicle that clears federal import requirements still may not qualify for a title or registration in your state. A younger, nonconforming Skyline GT-R needs a much narrower eligibility route involving an NHTSA determination and, generally, a Registered Importer (RI).

Evidence you should obtain before purchase
Ask the seller for clear photographs of the manufacturer’s date label and the chassis or vehicle identification markings. Keep the original export documents and any title or registration records that identify the same car. If the factory date label is missing, NHTSA identifies other possible evidence, including a first-sale invoice, an old registration document, or a statement from a recognized vehicle historical society. Evidence should relate to the individual vehicle, not merely to the Skyline generation.

EPA emissions law is a separate gate
The EPA’s 21-year pathway
EPA describes a separate age-based provision for vehicles that are at least 21 years old. To use that route, the engine must be identical in model and configuration to the engine originally installed in the vehicle. “Identical” is stricter than merely having the same displacement or a similar engine family: modifications, swaps, control systems, and configuration differences can affect whether the requirement is met.
EPA strongly encourages importers to contact its Imports Hotline before importing when equivalence is uncertain. Its current guidance is available at EPA’s vehicle and engine import page. Obtain that confirmation before the car is loaded rather than relying on a seller’s description of the engine as “stock.”

How the two federal tests interact
Meeting EPA’s 21-year condition does not replace NHTSA’s safety requirement. Conversely, a 25-year-old Skyline that qualifies for the NHTSA FMVSS exemption still needs an appropriate EPA declaration or another emissions basis. Treat the agencies as two separate gates.

What happens if the Skyline is younger than 25?
You need a vehicle-specific federal route
A nonconforming Skyline under 25 generally cannot enter simply because the model is popular or because another car from the same generation has been imported. NHTSA’s process generally requires a specific eligibility determination and an RI, or an RI contract, to bring the vehicle into compliance. The RI is responsible for the safety modifications, certification and supporting paperwork required for that route.
The cited R33 exception is narrow
NHTSA’s Skyline-specific FAQ identifies R33 GTS/GTR passenger cars manufactured from January 1, 1996 through June 30, 1998 under Vehicle Certification Package (VCP) 32. That production window is not a blanket exemption for every Skyline, every GT-R, or every R33 outside the listed scope. Why a younger car can be a high-risk purchase
If a car is not clearly covered by an existing eligibility determination, you may face an RI search, engineering and modification costs, certification work, storage charges, or refusal of entry. Do not ship first and ask an RI to solve the problem later. Obtain written confirmation of the route and the importer’s scope of work while the car is still overseas.

An R34 GT-R is not automatically legal or illegal solely because it is an R34. Apply the same individual-car test: if the vehicle has reached 25 years from its manufacture date when it is entered, the NHTSA age exemption may cover FMVSS compliance, subject to documentation. If it is younger, you need a specific NHTSA eligibility basis and the required RI process; the R33 VCP-32 dates do not establish eligibility for an R34.
EPA review remains separate. Verify the engine’s model and configuration for the 21-year EPA provision, or arrange an ICI pathway or other valid EPA exemption. Then check the destination state’s title and registration rules before committing to transport.

Step-by-step: verify a Skyline before you buy or ship
- Collect the identity file. Obtain the VIN or chassis number, exact manufacture date, generation and trim, title or export records, and photographs of every identification label. Ask for a cold-start and engine-bay record if you need to establish that the installed engine appears original, but do not treat photographs alone as an EPA equivalence determination.
- Calculate the NHTSA age at entry. Count 25 years from the documented manufacture date to the anticipated customs entry date. If the anniversary has not occurred, stop and investigate the eligibility-determination and RI route.
- Check NHTSA eligibility information. For a younger nonconforming car, verify that the exact model and production period are covered. For the R33 dates listed by NHTSA, confirm the car is actually an R33 GTS/GTR passenger car manufactured between January 1, 1996 and June 30, 1998.
- Establish the EPA basis. For the 21-year route, confirm that the engine is identical in model and configuration to the original. If there is an engine swap, turbo conversion, aftermarket control unit or uncertainty, contact EPA before importation.
- Choose the compliance professionals. A younger nonconforming vehicle generally needs an RI for safety work; emissions work may require an ICI. A company that sources or ships Japanese cars is not automatically an RI or ICI. Ask for the firm’s legal role, written scope, insurance, fees and responsibility for certification.
- Prepare the declarations. Work with your customs broker or importer to select the correct NHTSA Form HS-7 basis and the corresponding EPA declaration or form. The basis must match the vehicle’s real facts, not the seller’s shorthand description.
- Complete the federal entry plan before loading. EPA says nonconforming vehicles need ICI arrangements for modifications, testing and certification, or a valid exemption, before shipment. Confirm who will hold the documents and who will respond to a customs query.
- Check the destination state. Ask the state motor-vehicle agency about title, inspection, equipment and registration requirements for an imported right-hand-drive or gray-market vehicle before paying the balance.
Forms, customs entry and the consequences of a bad declaration
U.S. Customs and Border Protection (CBP) requires the applicable NHTSA declaration, including Form HS-7, at import. CBP’s personal-vehicle guidance is available at CBP vehicle import requirements. Your broker will also need the EPA entry paperwork and the documents supporting the age or compliance basis.
Keep a single, consistent file: the purchase contract, export certificate, title or registration history, manufacturer date evidence, VIN or chassis photographs, RI or ICI contracts, and any agency correspondence. A mismatch between the chassis number on the date evidence and the number on the shipping documents can delay release even when the car itself is old enough.

Federal import legality does not guarantee a state title
NHTSA, EPA and CBP determine federal import and entry issues. The state where you intend to register the Skyline controls its own title, inspection and registration process. Requirements can differ by state and may include equipment inspections, proof of ownership, odometer documentation, insurance eligibility, or restrictions on vehicles that were never certified for the U.S. market.
Get the state’s answer in writing or from the responsible agency before shipping. A customs release is not a promise that a county clerk, inspection station or state motor-vehicle office will issue a title.
