Can Self-Driving Cars Legally Operate Near Schools? Rules and Safety Requirements Explained

Federal law does not categorically ban an FMVSS-compliant automated vehicle from public roads, but that is not blanket permission near schools. State AV authorization, local controls, the vehicle’s operating domain and school-bus rules decide whether a specific trip is legal.

Usually, but not automatically. U.S. federal law does not categorically prohibit a self-driving vehicle from testing or deploying on a public road when it complies with every applicable Federal Motor Vehicle Safety Standard (FMVSS). That federal position is not blanket permission to use every road beside every school. State autonomous-vehicle laws, local traffic controls, the vehicle’s approved operating conditions, and rules for crossings and school buses determine whether a particular trip is lawful. A definite answer requires the state, locality, vehicle and route.

What the short answer means

Legality near a school is governed by several layers at once. The federal government sets vehicle-safety requirements through the National Highway Traffic Safety Administration (NHTSA). States regulate many aspects of operating an automated vehicle on public roads, and cities or counties may control local roads, signs and permits. The car must also be capable of performing the driving task only within its stated operational design domain (ODD)—the road, speed, weather, geographic and other conditions for which its automated driving system (ADS) was designed.

Therefore, “near a school” is not a nationwide legal category with one special answer. A school-adjacent road may have a posted reduced speed, a flashing school beacon, a traffic signal, a marked crossing, a crossing guard, a temporary closure or a school-bus stop. Each control applies according to the law of that jurisdiction. An ADS does not receive an exception merely because no human is sitting behind a conventional steering wheel.

NHTSA’s Report to Congress: NHTSA Rulemakings Related to Automated Driving System-Equipped Vehicles (May 2024) states: “Currently, there are no Federal laws or regulations that prohibit the testing or deployment on public roads of an AV that complies with all applicable FMVSS.” The qualification is essential: compliance with FMVSS is a vehicle-safety condition, not a federal authorization for every route, operating mode or school zone.

What rules apply on a school-adjacent road?

Posted school-zone controls

School-zone speed limits, active hours, flashing beacons and temporary signs are set under state and local traffic law. The exact speed and schedule differ by jurisdiction, so a national number would be misleading. The ADS must detect and follow the sign, signal or other control that governs that road at that time. If the route’s ODD does not support the required conditions—such as a particular temporary traffic pattern—the vehicle should not enter in automated mode.

Crossings and people directing traffic

A marked crosswalk, pedestrian signal or crossing guard creates a road obligation independent of whether the vehicle is automated. The system must yield, stop or proceed as the applicable signal and traffic law require. A crossing guard’s direction may control traffic at the scene even when it differs from the normal signal cycle. A vehicle that cannot reliably recognize or respond to those instructions is outside a safe operating condition for that route.

School-bus stop signals

School-bus stopping rules vary by state and by whether the roadway is divided. The relevant trigger is commonly the bus’s activated red warning lights and extended stop arm, but the distance, lane coverage and divided-highway exceptions are state-specific. Pennsylvania’s Department of Transportation, for example, requires motorists to stop at least 10 feet from a school bus with its red lights flashing and stop arm activated, while describing circumstances in which opposing traffic separated by a physical barrier may continue. That 10-foot rule is a Pennsylvania example, not a national standard.

How the federal framework works

FMVSS are vehicle-safety standards

NHTSA administers federal motor-vehicle safety law and publishes FMVSS in Title 49, Part 571 of the Code of Federal Regulations. These standards address matters such as crash protection and equipment performance. NHTSA’s May 2024 report says no federal law or regulation categorically bars public-road testing or deployment of an AV that meets all applicable FMVSS. The report also says standards written for conventional vehicles need modernization for automated driving systems.

That statement does not mean every self-driving vehicle is federally approved. A manufacturer or operator still has to establish that the particular vehicle complies with the standards that apply to its design, and other federal obligations may apply. The federal statement also does not displace state registration, insurance, testing or deployment rules, nor does it override a local road closure or posted school control.

Occupant-protection rule

The U.S. Department of Transportation’s 2022 final-rule summary, Occupant Protection for Vehicles With Automated Driving Systems, updated safety standards to account for ADS-equipped vehicles that may not have traditional manual controls. It sought to preserve the existing level of occupant crash protection where possible. This is a vehicle-construction and occupant-protection rule; it does not grant permission to drive a particular school route.

Status of federal ADS guidance

A Federal Register notice dated July 31, 2026, said NHTSA was preparing updated guidance on safe development and deployment of ADS and described the 2017 Automated Driving Systems 2.0: A Vision for Safety document as the agency’s most recent safe-development and testing guidance at that notice date. Guidance is not the same as a route permit or a state traffic rule. Treat the notice as a snapshot of federal guidance status on that date, not as a promise that later agency action has occurred.

What states and localities can require

State authorization and operating duties

NHTSA’s 2017 ADS 2.0 guidance explains that vehicles on public roads are subject to both federal and state jurisdictions. States generally handle operation matters such as traffic rules, licensing or registration, insurance, testing and deployment conditions, while federal law governs vehicle safety standards. Local governments may add road-use restrictions or enforce posted controls within that framework.

State requirements differ. A state may require a human operator, a designated remote operator, a permit, a safety report, specific insurance, inspections or a registered autonomous-vehicle designation. Another state may use different terms or impose fewer or additional conditions. Whether ADS is engaged can matter, and the legal status of the vehicle—testing, demonstration or commercial deployment—can change the requirements.

Florida as a concrete example

Florida Statutes § 319.145 (2026 edition) requires a registered autonomous vehicle to be capable of operating in compliance with applicable Florida traffic and motor-vehicle laws whether or not its ADS is engaged. The statute also describes a response to certain ADS failures: a fully autonomous vehicle must achieve a minimal-risk condition when a qualifying failure leaves it unable to perform the driving task within its intended ODD, while a vehicle that is not fully autonomous must provide an alert and a response mechanism described by the law.

Florida’s wording illustrates how a state can address ordinary traffic compliance and system failures. It is not a federal standard and should not be treated as the rule in every state. A reader in another state must consult that state’s current statute, regulations and agency instructions.

Finding the governing state rules

The National Conference of State Legislatures’ Autonomous Vehicles Legislation Database, updated September 15, 2026, tracks state measures involving public-road operation, operator requirements, registration, inspections and testing. It is a useful starting point, but it is not a determination that a specific car may use a specific school-adjacent road. Confirm the controlling statute, regulation, agency guidance, permit conditions and local traffic controls before the trip.

Safety requirements an operator must verify

Confirm the vehicle’s operational design domain

Obtain the ADS’s stated ODD and compare it with the planned route. Check geographic boundaries, roadway types, speed range, weather and visibility limits, construction handling, required map coverage and any restrictions on complex intersections or unprotected crossings. If a school route includes conditions outside the ODD, the system should not be used there in automated mode. Do not assume that a service authorized in one neighborhood is authorized on every nearby street.

Verify the vehicle and operator’s legal status

  • Confirm the vehicle’s applicable FMVSS compliance and any federal exemption or approval that its design relies on.
  • Check state registration or designation for an autonomous vehicle and whether the trip is classified as testing, deployment or another category.
  • Confirm required insurance, inspection, reporting and permit conditions.
  • Determine whether a human occupant, trained safety driver or remote operator is required and what that person must be able to do.
  • Check local geographic, roadway, time-of-day or school-property restrictions.

Plan for normal school controls

Before departure, identify every school-zone sign, beacon, crossing, signal and bus stop along the route. Verify when reduced limits are active and whether a school calendar, event or temporary order changes the control. The ADS must be able to recognize the physical sign or signal and respond within the required stopping distance. A human supervisor, where required, must remain attentive to the road rather than treating automation as permission to disregard a control.

Plan for a system failure

State law may prescribe what happens when the ADS cannot continue. The response can include an alert, a request for human takeover, a controlled stop or another minimal-risk condition. Florida’s statute is an example of different treatment for fully autonomous and non-fully-autonomous vehicles. The exact trigger and response depend on the state and vehicle. Operators should know how the system reports a failure, where it can safely stop without blocking a crosswalk or bus stop, and who is responsible for responding.

How to check whether one specific trip is legal

  1. Identify the jurisdiction. Record the state, city or county, school-adjacent road and any roads crossed during the trip. Boundary changes can change the governing rules.
  2. Classify the vehicle and use. Note whether the car is fully autonomous or requires a human, whether ADS will be engaged, and whether the activity is testing, demonstration or deployment.
  3. Read the current state requirements. Use the state motor-vehicle agency, statutes, regulations and permits to verify registration, operator, insurance, inspection, reporting and failure-response duties.
  4. Check local controls. Inspect posted speed limits, beacon schedules, crossing arrangements, temporary signs, event restrictions and any local prohibition or permit condition.
  5. Check school-bus law. Confirm the stopping trigger, required distance, lanes covered and any divided-road exception in that state.
  6. Compare the route with the ODD. Exclude segments involving unsupported weather, road types, speeds, construction or mapping. A legal vehicle can still be unable to operate safely on a particular segment.
  7. Document the result. Keep the applicable permit or authorization, the route assessment, the vehicle’s operating limits and the emergency procedure available to the responsible operator.

Common situations and the controlling question

Situation Question to answer Why it matters
Reduced school-zone speed is flashing What speed, hours and activation rule does this jurisdiction post? The ADS must obey the active local control; there is no automatic AV exemption.
Children are in a marked crossing What do the signal, sign and crossing-guard directions require? Pedestrian-control rules apply to automated and human-driven vehicles alike.
A bus extends its stop arm What stopping distance and lane rule does the state use? State law determines the trigger and any divided-road exception.
The ADS reports a critical failure What alert, takeover or minimal-risk procedure does the state and vehicle require? Failure response is a legal and safety condition, not merely a manufacturer preference.
The route enters another municipality Do local restrictions or permits change at the boundary? Local road-use controls can differ even within one state.

Misconceptions that create legal risk

“Federal law allows all self-driving cars everywhere.”

Incorrect. The federal statement concerns an AV that complies with all applicable FMVSS and says there is no categorical federal prohibition on public-road testing or deployment. It does not certify every vehicle or remove state and local authority.

“A school zone is only a lower speed limit.”

Not necessarily. The legally relevant controls may include a time-based beacon, a crossing guard, a temporary closure, a signal, a crosswalk or a bus stop. The route assessment must account for all of them.

“Driverless means nobody is responsible.”

Responsibility may be assigned to the vehicle owner, manufacturer, deployer, remote operator or required human occupant under state law and the vehicle’s authorization. Removing a conventional driver does not remove compliance duties.

“A bus rule is the same in every state.”

It is not. Pennsylvania’s 10-foot example and its physical-barrier exception demonstrate why a state-specific rule is necessary. Do not import that distance or exception into another jurisdiction.

What to do when the answer is unclear

Do not rely on a generic “autonomous vehicles are legal” statement when the trip involves a school. Pause the deployment and ask the state motor-vehicle or transportation agency which authorization applies; review the city or county traffic order; and obtain the vehicle operator’s written ODD and failure procedure. If the route, vehicle status or school controls cannot be matched to a current rule, use a legally authorized alternative rather than assuming permission.

For a location-specific determination, the decisive evidence is the current state AV law, any permit or deployment condition, local posted controls, school-bus rules and the vehicle’s own operating domain. Those details—not the label “self-driving”—determine whether the particular trip can proceed.
