Yes, police may seek a warrant to take a Tesla and search camera footage stored in the car if they believe it could contain evidence. In Oakland, police sought warrants to tow Teslas parked near homicide scenes in 2024. One owner arrived as officers were loading the car, offered the footage, and police released it. That reporting documents specific warrant applications—not a rule that any nearby Tesla can automatically be seized.
Why police might want a nearby Tesla
A parked car can be a potential witness without its owner being suspected of a crime. In its August 31, 2024 report, the San Francisco Chronicle described Oakland police seeking Teslas near crime scenes because their outward-facing cameras might have recorded useful footage. The report said officers sought at least three tow warrants in July and August 2024.
In one case involving a homicide investigation near the Oakland airport, an officer sought a warrant to seize a Tesla from a hotel parking lot so its footage could later be searched under an additional court order. The owner arrived while the vehicle was being loaded and offered the video; police released the car. The Chronicle also described other Oakland incidents involving warrants to tow Teslas, including a Model X parked near a fatal shooting. These examples are from one city and one period; they do not establish what officers may do in every jurisdiction.
The privacy concern extends to people who have no connection to an investigation. Saira Hussain, a staff attorney at the Electronic Frontier Foundation specializing in government surveillance, told the Chronicle: “That obviously puts third parties — people who are not involved at all — in the crosshairs of investigations.”

Can a Tesla record what happened?
Not necessarily. Whether a car has footage depends on its mode and whether the recording system was triggered. The Chronicle described Sentry Mode as operating when a car is empty and locked, with clips saved to a USB drive in the glove box. A nearby Tesla is therefore only a possible source of evidence, not proof that usable video exists.
If you own a Tesla, understand where your vehicle stores its recordings and how to preserve footage you want to keep. The reporting identifies a USB drive but does not establish a particular model, capacity, or compatibility. A storage device does not change police authority or prevent footage from being obtained through lawful process.

Searching the car is different from asking Tesla for data
Police may be pursuing two distinct kinds of evidence: footage stored in the vehicle, or information held in Tesla’s systems. A physical search of local storage is not the same as a request to Tesla for account- or VIN-associated data.

Tesla’s Customer Privacy Notice, updated February 2026, says driving-generated vehicle data is not associated with a person’s identity or account by default, and that camera AI data is processed in the vehicle by default. It says consent is required for camera recordings used for fleet learning, with an exception for safety-critical events such as a collision or airbag deployment. The notice also describes disclosures for legal obligations and lawful government requests. These are Tesla’s stated practices; they do not establish that every camera clip stays in the car or that Tesla can never produce data.

In a response included in the Senate’s automaker privacy correspondence, Tesla said U.S. government and law-enforcement requests require a valid subpoena, warrant, court order, or similar legal instrument, and that the company may object to, challenge, or reject requests when appropriate. The letter also says customers can request data Tesla holds that is associated with their account or VIN. This is Tesla’s description of its process, not an independent legal guarantee.
In an April 30, 2024 release, Senators Ron Wyden and Edward Markey said their inquiry found that five automakers—GM, Ford, Honda, Stellantis, and Tesla—required a warrant to provide location data to law enforcement. They said Tesla was the only company in their review that notified owners about government demands; the release also said other automakers disclosed some location data in response to subpoenas. That is the senators’ account of company responses available at the time, not a current audit of all automakers.

What the law does—and does not—settle
The specific nationwide question—whether police may seize a privately owned Tesla merely because it was near a crime—has no single answer established by the cited sources. The relevant rules can depend on jurisdiction, the facts, the warrant, what police are seeking, and whether they want local footage or records from Tesla. The Oakland examples involved officers seeking warrants; they do not show that proximity alone always authorizes a seizure, or that officers can never act without a warrant.
The Driver’s Privacy Protection Act, 18 U.S.C. § 2721, concerns personal information obtained from state motor-vehicle records. It allows disclosure for certain government functions and legal proceedings, among other listed uses. It does not by itself resolve whether police may take a car to inspect locally stored camera footage. See the U.S. Code, 18 U.S.C. § 2721.

If police contact you about your Tesla
- If officers ask for footage: Clarify whether they are asking you to provide it voluntarily or acting under legal process. Do not obstruct officers or destroy evidence.
- If you receive a warrant or the car is taken: Keep the warrant and related paperwork, preserve communications, and contact a lawyer in the relevant jurisdiction for advice about your circumstances.
- If Tesla is asked for account data: That is a separate process from searching storage in the car. Tesla says it reviews government requests under its stated legal-process policy; the details of any specific request matter.
