Whether police may take, hold, immobilize, forfeit, or destroy a vehicle depends on the state, the exact charge, and the statute used. The state laws discussed here authorize action for specifically defined conduct such as felony speeding to elude arrest, illegal racing, street takeovers, and certain repeat offenses. They do not create a nationwide rule allowing police to crush a car merely because its driver exceeded the speed limit.
Seizure, impoundment, forfeiture and crushing are different events
News reports and casual conversation often use “seized,” “impounded,” “confiscated,” and “crushed” as if they mean the same thing. Legally, they can describe separate stages with different requirements and remedies.

| Term | What it generally means | What it does not automatically mean |
|---|---|---|
| Seizure | Authorities take custody of the vehicle, sometimes while a criminal or civil case is pending. | It does not by itself transfer ownership or authorize destruction. |
| Impoundment or immobilization | The vehicle is stored or disabled under a statute, administrative action, or court order, potentially for a specified period. | It is not the same as a final forfeiture. |
| Forfeiture | A legal process can transfer the vehicle or its proceeds to the state, subject to the governing law and protected interests. | Forfeiture does not automatically mean the vehicle will be destroyed. |
| Destruction or crushing | A separate disposition in which the vehicle is destroyed. | The statutes described in this article do not make crushing an automatic consequence of a speeding offense. |
A car can therefore be held before a case ends, released after a hearing, forfeited after statutory conditions are met, or disposed of in another way authorized by law. The document you receive should identify which event has occurred and what hearing or claim procedure applies.
Why an ordinary speeding ticket is usually different
The laws discussed here are offense-specific. They target conduct that legislatures have treated as substantially more dangerous or repeated than a routine civil speeding citation. Examples include felony speeding to elude arrest, organized or exhibition racing, drag racing, street takeovers, and repeat qualifying violations.

A citation for exceeding the posted limit, without the additional facts required by a particular statute, does not automatically satisfy those seizure or forfeiture provisions. The same word—“speeding”—can appear in very different charges. A prosecutor might allege felony eluding, racing, or another crime rather than ordinary speeding, and the legal consequences can change with that charge.
Because the laws are state-specific, an answer that is accurate in North Carolina may be wrong in Florida, Washington, Ohio, Oregon, another state, or another country. Identify the location of the stop, the statute number on the citation or complaint, and whether the allegation is a civil infraction, misdemeanor, or felony before drawing a conclusion.
How the cited state laws differ
| Jurisdiction and law | Conduct covered | Potential vehicle action | Important procedure |
|---|---|---|---|
| North Carolina, G.S. 20-28.3 | A person charged with felony speeding to elude arrest under G.S. 20-141.5(b) or (b1), among other listed situations. | Seizure and impoundment when statutory conditions are met; a forfeiture process may follow. | Probable-cause grounds, magistrate review, notice to certain owners and lienholders, and procedures for release or forfeiture. |
| Florida, 2025 Fla. Stat. § 316.191 | Specified racing, drag-racing, and street-takeover offenses. | Impoundment or immobilization under stated conditions; a forfeiture route for certain repeat violations. | For court-ordered impoundment or immobilization, notice is specified for a different registered owner and recorded lienholders. |
| Washington, RCW 46.61.748 | Racing. | Impoundment for a vehicle used to commit racing; a subsequent qualifying racing conviction after a prior impoundment can lead to forfeiture. | The forfeiture provision requires a conviction and a finding that the vehicle was used as specified, plus notice and an opportunity to claim an interest. |
| Ohio, ORC § 4503.234 | Criminal forfeiture under enumerated criminal provisions. | A court can order seizure and direct the vehicle’s disposition after forfeiture. | Notice goes to known interest holders, and certain lienholder or ownership interests are protected. |
| Oregon, ORS Chapter 809 | Distinct statutory grounds, including some repeat impaired-driving and suspended-driving circumstances. | Separate impoundment and seizure-forfeiture mechanisms listed in individual sections. | The specific section controls eligibility, procedure, notice, and release requirements; the chapter is not a general speeding rule. |
This comparison illustrates variation rather than an exhaustive survey. It cannot determine what will happen in a particular case without the applicable state law and facts.

North Carolina: felony speeding to elude can trigger seizure
What the statute covers
North Carolina General Statutes § 20-28.3(a1) states: “A motor vehicle is subject to seizure if it is driven by a person who is charged with the offense of felony speeding to elude arrest pursuant to G.S. 20-141.5(b) or (b1).” The language is tied to a felony charge and to the statute’s other listed conditions; it is not a rule for every speeding citation.

What happens after a seizure
The statute provides for probable-cause grounds and magistrate review. It also addresses notice to certain owners and lienholders and establishes processes through which a vehicle may be released or a forfeiture case pursued. A registered owner who was not driving, or a lender with a recorded security interest, should read the notice carefully rather than assume that the driver’s charge ends the owner’s rights.
Questions to ask in a North Carolina case
- Does the charging document actually allege felony speeding to elude under G.S. 20-141.5(b) or (b1)?
- Which magistrate or court reviewed probable cause, and when is any review or hearing scheduled?
- What release conditions and filing deadlines appear in the seizure or impoundment notice?
- Are the registered owner and every recorded lienholder listed correctly?
Florida: racing, drag racing and street-takeover provisions
Covered conduct
The 2025 version of Florida Statutes § 316.191 addresses specified racing, drag-racing, and street-takeover offenses. The statute allows impoundment or immobilization under defined conditions and provides a forfeiture route for certain repeat violations. A single ordinary speeding ticket is not the same allegation as one of those listed offenses.
Notice to owners and lienholders
For court-ordered impoundment or immobilization, the law specifies notice to a different registered owner and to recorded lienholders. That distinction matters when the driver is not the title holder. The notice should identify the order, the agency holding the vehicle, the applicable hearing or claim process, and any deadline for contesting the action or seeking release.
Why the repeat-offense language matters
Because the forfeiture route is tied to certain repeat violations, the state must establish the statutory history and the facts required by the particular provision. Do not assume that an earlier traffic ticket, even one involving speed, automatically qualifies as a prior racing or street-takeover violation.

Washington: impoundment for racing and a later forfeiture path
Initial racing impoundment
RCW 46.61.748(1) provides: “A vehicle used to commit the crime of racing is subject to impoundment as provided for in chapter 46.55 RCW.” The trigger is the crime of racing and the required statutory procedure, not simply a high speed alleged in isolation.
When forfeiture can become possible
Washington’s specified forfeiture provision concerns a subsequent qualifying racing conviction after a prior impoundment. It requires the conviction and a finding about the vehicle’s use in the offense. That sequence is materially different from an immediate, automatic loss of the car after a first speeding stop.
Claiming an interest
The statute provides notice and an opportunity for an interested person to claim an interest. It also sets claim-notice periods. Missing the period stated in the notice can jeopardize a claim, so an owner, co-owner, or lienholder should preserve the notice and obtain advice promptly.

Ohio Revised Code § 4503.234 concerns criminal forfeiture under enumerated criminal provisions. Rather than treating every traffic violation as a forfeiture case, it authorizes a court order in the circumstances listed by the statute. The court order authorizes seizure and directs how a vehicle ordered forfeited is to be disposed of.

The statute requires notice to known interest holders and recognizes certain protected ownership or lienholder interests. A lender or owner who did not participate in the charged conduct should document the purchase, title, payment history, and security interest and follow the procedure stated in the notice. The existence of a forfeiture order does not eliminate the need to examine whether a protected interest applies.
Oregon: separate grounds in Chapter 809
Oregon Revised Statutes Chapter 809 contains distinct impoundment and seizure-forfeiture provisions. The identified examples include some repeat impaired-driving and suspended-driving circumstances. Each section supplies its own offense, eligibility rules, and procedure. The chapter should not be read as a blanket authorization to seize or destroy a vehicle for ordinary speeding.
In an Oregon case, locate the exact section cited by the agency or court. Check whether it requires a prior conviction, a repeat event, a particular owner status, a hearing, or a specific release condition. The chapter’s general subject heading is not enough to establish that a particular vehicle can be taken.

Can police keep the car before the criminal case ends?
Some statutes expressly allow custody while the case is pending. That temporary seizure or impoundment is legally different from a final forfeiture. The practical consequences can still be serious: storage charges may accrue, access to personal property may be limited, and a vehicle needed for work or family care may be unavailable.

Read every paper from the seizing agency, magistrate, prosecutor, and court. Look for:
- the exact statutory section and offense description;
- the date and location of any probable-cause, impoundment, or forfeiture hearing;
- the deadline to request release, contest the seizure, or file an ownership or lien claim;
- the storage location, identification number, and instructions for retrieving personal property;
- the name of the agency or court that must receive a response.
Do not assume that waiting for the traffic or criminal case to finish automatically preserves a vehicle claim. The seizure procedure may have a separate deadline.
What owners and lienholders should do immediately
- Identify the charge. Obtain the citation, complaint, arrest affidavit, or indictment and copy the statute number exactly.
- Confirm the jurisdiction. State law, and sometimes a local court order, controls the authority being used.
- Determine the vehicle’s legal status. Ask whether the paper describes seizure, impoundment, immobilization, forfeiture, or a proposed disposition.
- Check title and liens. Gather the certificate of title, registration, purchase contract, loan documents, and proof of insurance. Verify that notice was sent to every required interest holder.
- Calendar every deadline. Record hearing dates and claim periods from the notice itself. Keep the envelope and delivery details.
- Request the agency’s procedure in writing. Ask where a release request, claim, or objection must be filed and what documents are required.
- Obtain jurisdiction-specific legal advice. A lawyer can evaluate probable cause, statutory eligibility, innocent-owner or lienholder protections, and the effect of a conviction or dismissal.
Does forfeiture mean the car will be crushed?
No automatic connection appears in the statutes described here. Forfeiture addresses ownership or proceeds; destruction is a separate disposition. A statute may tell a court or agency what to do with a forfeited vehicle, but that authority must be identified in the governing law and order. The cited provisions do not establish that crushing is the mandatory result of ordinary speeding, racing, or every forfeiture.
Use precise language when speaking with an agency or lawyer. Ask, “Is this a temporary impoundment, a seizure pending a hearing, a forfeiture case, or a destruction order?” The answer determines which document, deadline, and remedy matter.
Common mistakes that can cost an owner a remedy
- Relying on the word “speeding.” The decisive issue may be a felony-eluding, racing, or repeat-offense allegation.
- Treating impoundment as final forfeiture. A temporary hold and a permanent ownership transfer require different analysis.
- Ignoring notices addressed to the driver. Owners and lienholders may have separate rights and deadlines.
- Assuming a lender will handle everything. A lienholder’s protection does not necessarily replace the owner’s obligation to respond.
- Waiting for the criminal case. Vehicle procedures can move on their own timetable.
- Assuming destruction is authorized. Request the exact statutory and court authority for any proposed disposal.
Bottom line for a speeding-offense vehicle seizure
Police may legally seize or hold a vehicle in some jurisdictions when the alleged conduct fits a specific statute—such as felony speeding to elude arrest, racing, a street takeover, or a qualifying repeat offense. The laws discussed here do not support the broad claim that an ordinary speeding ticket lets police take and crush a car. To know what can happen in an individual case, match the state, exact charge, statutory section, vehicle ownership, and procedural notice, then act before the stated hearing or claim deadline.
