Can California’s SB 1246 Keep Robotaxis Clear of Emergency Responders?

California’s SB 1246 aims to improve robotaxi accountability and emergency response, but its requirements are not scheduled to take effect until 2028.

When a driverless vehicle blocks a street or delays first responders, the problem is not only whether its software can drive safely. Someone must know where the vehicle is, communicate with responders, and help clear the obstruction. California’s SB 1246 sets new operational duties intended to address those gaps—but it is scheduled to take effect by July 1, 2028, so it is too soon to know whether it will keep robotaxis out of the way in practice.

What California’s SB 1246 requires

SB 1246 focuses on the people and response systems around autonomous vehicles (AVs), not just the vehicles’ driving software. California Senator Dave Cortese, the bill’s sponsor, described the law as taking effect by July 1, 2028. The official legislative summary and the sponsor’s account identify several obligations and enforcement measures:

  • Remote drivers: They must be based in the United States and hold a U.S. driver’s license.
  • System-wide failures: AV companies must notify local jurisdictions about vehicle locations and status during a system-wide failure.
  • Local incident support: Companies must provide local incident technicians, and the official legislative summary describes immediate dispatch obligations for certain incidents and requests.
  • Emergency obstruction: Local penalties may apply when an AV blocks first-responder operations during an emergency for more than 30 minutes.
  • Reporting: Response-time reporting will increase.

The 30-minute period is a threshold described by the sponsor as a trigger for possible local penalties. It is not a reported average obstruction time, a guarantee that a vehicle will be cleared within 30 minutes, or evidence of how often such incidents occur. Cortese said, “California has embraced autonomous vehicles, but we cannot embrace innovation at the expense of public safety.”

How SB 1246 fits with California’s existing AV rules

SB 1246 is not California’s first rule addressing AV readiness or contact with first responders. On April 28, 2026, the California Department of Motor Vehicles announced a separate set of adopted AV regulations. The DMV described requirements for phased testing and deployment, safety-case documentation, first-responder interaction plans, access to manual overrides, two-way communications with a 30-second response time, and updated training.

That 30-second figure is a regulatory response-time requirement described by the DMV, not a measured result showing how quickly companies or vehicles actually respond. The two frameworks address related but distinct parts of oversight:

Oversight area What the framework addresses
Vehicle and operating readiness DMV rules describe phased testing and deployment, safety-case documentation, manual-override access, and updated training.
First-responder interaction DMV rules include a first-responder interaction plan and two-way communications with a 30-second response-time requirement.
Local incident support SB 1246 requires local incident technicians and describes immediate dispatch obligations for specified incidents and requests.
System-wide failure information SB 1246 requires companies to notify local jurisdictions about vehicle locations and status during system-wide failures.
Enforcement and reporting SB 1246 allows local penalties for qualifying emergency obstruction lasting more than 30 minutes and increases response-time reporting.

The DMV’s announcement of its adopted regulations describes its own framework. These rules and SB 1246 together show why AV oversight involves both vehicle readiness and what happens when a vehicle needs help on a public road.

Why robotaxi oversight involves several public agencies

A robotaxi operation combines an autonomous vehicle with paid passenger service, and the road itself is public infrastructure. A 2024 analysis authored by RAND researchers and published by Governing describes California’s DMV as overseeing AVs and vehicle safety, the California Public Utilities Commission as regulating commercial passenger service, and transportation agencies as responsible for infrastructure and highways.

Those responsibilities help explain why an incident can require coordination rather than a single agency’s response. A local government may need usable information about a disabled vehicle, a first-responder crew may need an immediate way to reach the operator, and state agencies oversee different aspects of the vehicle and service. The 2024 analysis is useful background on that division of roles, not a current inventory of every regulatory detail.

What will determine whether the law works

The new duties create obligations, but their public-safety value will depend on how they operate on the ground. Local authorities will need status information that helps locate affected vehicles; technicians and remote personnel will need to respond when asked; and agencies will need a workable way to apply penalties and evaluate response-time reports.

Reporting will matter only if it allows meaningful evaluation. To compare operators such as Waymo, Tesla, and Zoox fairly, readers would need comparable incident counts alongside fleet size, operating geography, miles or trips, response times, and incident severity. The TechCrunch Mobility issue published October 2, 2026 names those companies, but the available material does not establish comparable incident rates or support a safety ranking among them.

Can we tell yet whether SB 1246 will keep robotaxis clear?

No. The law’s key requirements are scheduled to take effect by July 1, 2028, which is in the future relative to the October 2026 publication date. The cited sources do not provide a measured obstruction rate or an evaluation of SB 1246’s effects. After implementation, incident and response-time reporting may help show whether emergency disruptions fall; the law’s passage alone cannot establish that result.
