BYD Is One Step Closer To Selling Cars In America

The Supreme Court’s tariff ruling brings BYD marginally closer to the U.S. market, but it does not clear the company to sell passenger cars in America.

The Supreme Court’s February 20, 2026 tariff ruling removes one obstacle that could have complicated a future BYD passenger-car launch in the United States. It does not, however, make BYD cars cheap to import, authorize a U.S. showroom network, or confirm that BYD intends to sell its passenger vehicles here.

The practical change is narrower: tariffs imposed under the International Emergency Economic Powers Act (IEEPA) are no longer enforceable on that legal basis. BYD would still face separate trade barriers, vehicle regulations and a political environment that has kept the company away from the American retail market so far.

What the Supreme Court actually decided

In Learning Resources, Inc. v. Trump, the Supreme Court held that IEEPA does not give the president authority to impose tariffs merely because the statute allows the government to “regulate importation.” The Court said tariffs require clearer authorization from Congress.

That decision invalidated the IEEPA-based reciprocal tariffs and fentanyl-related tariffs. It was a ruling about statutory authority, not a blanket declaration that all presidential tariffs are unconstitutional or that imported Chinese cars can now enter the United States duty-free.

That distinction matters for BYD. Several other U.S. trade measures rest on different statutes and were not erased by the decision.

In other words, the ruling removes one layer of uncertainty, but it leaves BYD facing the two most obvious import charges: the 100% Section 301 Chinese-EV tariff and the separate 25% automobile tariff. Those headline rates should not be treated as a precise final transaction cost because customs treatment, vehicle classification, parts, logistics and other fees can affect the calculation. They do show why a conventional China-to-U.S. import strategy remains commercially difficult.

Why this could still matter to BYD

The decision could help BYD in two ways.

  1. It narrows the tariff risk. A future administration cannot rely on IEEPA alone to impose the same type of broad tariffs. That makes the trade-policy landscape somewhat more predictable than it was when the case was pending.
  2. It creates room for a different entry strategy. If BYD eventually manufactures vehicles or qualifying components outside China, it might avoid some China-specific exposure. That would not automatically eliminate U.S. tariffs or other restrictions, but it could make the economics less punitive than importing finished Chinese-built EVs.

Neither point amounts to a launch announcement. BYD Americas CEO Stella Li has previously said the company was “not planning to come to the US” with passenger vehicles, citing the complexity of the market and its political environment. The company has a U.S. commercial presence, including electric buses and related operations, but that is not the same as selling BYD passenger cars through American dealers.

Mexico is not yet BYD’s American shortcut

Manufacturing in Mexico is often presented as the obvious route around Chinese import tariffs. That possibility remains unconfirmed for BYD passenger cars.

Mexico’s president said in 2024 that there was no BYD factory project at that time, despite reports that the automaker was studying potential locations. In February 2026, BYD was reported to be among the bidders for a Nissan–Mercedes-Benz plant in Mexico. Being a bidder is not the same as winning the facility, operating it, obtaining production approvals or building vehicles there for the U.S. market.

Even a confirmed Mexican plant would not automatically guarantee U.S. access. BYD would need to establish what vehicles and parts were produced there, satisfy applicable rules of origin, comply with U.S.-Mexico-Canada Agreement requirements where relevant, and navigate the separate political and regulatory restrictions aimed at Chinese connected-vehicle technology.

The connected-vehicle rule may be the larger problem

Tariffs are only one part of the problem. The Commerce Department’s connected-vehicles rule restricts certain vehicles and components connected to China or Russia.

For model year 2027, Chinese or Russian connected-vehicle manufacturers generally cannot sell connected vehicles in the United States when those vehicles incorporate covered vehicle-connectivity software or hardware. The hardware prohibition begins for model year 2030. For covered components without a model year, the hardware restriction begins on January 1, 2029.

The rule is especially important for a modern EV because connected functions are built into the product rather than added as an optional accessory. Vehicle operating systems, telematics, communications modules, remote services and data systems can all become part of the compliance analysis. A BYD vehicle assembled in Mexico would therefore not necessarily solve the problem if it still used covered Chinese-origin technology or remained subject to the rule’s manufacturer restrictions.

This does not mean every vehicle with any Chinese part is automatically barred. The exact result depends on the rule’s definitions, the manufacturer’s status, the relevant software or hardware and the model year. It does mean that a future BYD launch would require a detailed technology and supply-chain compliance plan, not simply a new final-assembly location.

What would have to happen before Americans could buy a BYD car?

A realistic U.S. launch would require several separate decisions and approvals:

  1. BYD would need to commit to passenger cars. There is currently no announced U.S. passenger-car launch plan.
  2. The company would need a viable production and import model. That could involve importing vehicles, building them in Mexico, partnering with another manufacturer or using a combination of approaches.
  3. It would need to address tariffs. Importing a Chinese-built EV would still expose the vehicle to the 100% Section 301 tariff and the separate 25% automobile tariff.
  4. It would need to pass U.S. vehicle requirements. Cars sold in America must meet federal safety, emissions and other applicable requirements, in addition to state-specific rules such as California’s requirements.
  5. It would need a retail and service network. BYD’s bus operations do not provide the dealer, parts, warranty and repair infrastructure required for a nationwide passenger-car business.
  6. It would need a connected-vehicle compliance strategy. The company would have to determine whether its vehicles, software and hardware could be sold under the Commerce Department’s model-year restrictions.

Does the ruling make a BYD showroom more likely?

It makes a future entry somewhat less legally complicated, but the effect should not be overstated. The ruling removes the possibility that BYD would be exposed to IEEPA-based tariffs that lacked congressional authorization. It does not remove the tariffs specifically aimed at Chinese EVs, the automobile tariff, the connected-vehicle restrictions or the practical cost of building a U.S. retail operation.

It also does not change BYD’s public position. Unless the company announces a passenger-car launch, confirms a manufacturing site and explains how it will comply with U.S. trade and technology rules, there is no firm basis for predicting that BYD cars will soon appear at American dealerships.

The most defensible reading of “one step closer” is therefore a legal and strategic one: one barrier has been removed, giving BYD more options. The finish line—an approved, commercially viable and officially announced U.S. passenger-car business—remains much farther away.

The Supreme Court’s IEEPA ruling is a modest opening, not a green light. BYD is no longer facing one category of tariff risk, but Chinese EV tariffs, the separate automobile tariff, connected-vehicle rules and the absence of a confirmed U.S. launch plan still stand between the company and an American showroom.
