Bertrandt U.S. sued Fisker Group in federal court, alleging it was left unpaid for engineering work tied to Fisker’s planned Pear electric vehicle and Alaska pickup. The $12.9 million sought in the complaint was Bertrandt’s damages demand—not a court award—and the available court record does not establish how its separate bankruptcy claim was ultimately resolved.
What the lawsuit is about
Bertrandt U.S., Inc., a U.S. subsidiary of German engineering firm Bertrandt AG, filed Bertrandt U.S., Inc. v. Fisker Group Inc., No. 2:2024cv11152, in the U.S. District Court for the Eastern District of Michigan on April 30, 2024. The contract complaint concerned engineering and development work for two planned Fisker vehicles: the Pear, a lower-cost EV, and the Alaska pickup. Its claims are allegations, not findings that a court established as true. The district-court docket records the case and its procedural history.
What Bertrandt says Fisker agreed to pay
Pear development
TechCrunch’s account of the complaint and attached agreement says Bertrandt entered a Pear design-and-development agreement with Fisker in May 2022, valued at more than $35 million. That figure is the reported value of the agreement, not the amount Bertrandt said remained unpaid. TechCrunch’s report describes the agreement and the allegations.
Alaska pickup work
Bertrandt alleged that Fisker later requested similar work for the Alaska pickup. According to the complaint as reported by TechCrunch, there was no formal written Alaska agreement, but Fisker agreed to Bertrandt’s $1.66 million quote.

How much Bertrandt claimed Fisker owed
Bertrandt alleged that Fisker stopped paying at the end of August 2023 and left invoices unpaid through January 31, 2024. It claimed an invoice balance of $7,061,443. Bertrandt also said that at a February 6, 2024 meeting, Fisker acknowledged liability for those invoices and agreed to promptly pay $3,685,000 as a partial payment; Bertrandt alleged that payment never arrived. Both the alleged acknowledgment and the promise are Bertrandt’s account, as reported from its complaint—not independent court findings. TechCrunch reported these figures and allegations.
The complaint sought $12,919,443 in total. Bertrandt described $7,061,443 as unpaid invoices and sought another $5,858,000 for alleged lost profits, delay costs, and incidental damages. Its lawyers wrote in the complaint: “Fisker has been unjustly enriched at the expense of Bertrandt.” The full amount was a demand for damages, not a judgment or an amount shown to have been paid. Other alleged contract breaches
Bertrandt also alleged that Fisker’s pause of Pear and Alaska development work breached the parties’ obligations and caused delay costs. Separately, it said it demanded on April 22, 2024 that Fisker return its intellectual property and confirm in writing that it had retained no physical or electronic copies. The complaint alleged Fisker did neither. These assertions, too, remain allegations in the complaint. TechCrunch summarized these claims.
What happened after the complaint
Fisker answered the complaint and asserted a counterclaim on May 31, 2024; Bertrandt answered the counterclaim on June 11. Fisker Group filed for Chapter 11 bankruptcy on June 17. On June 20, the district court recorded notice of the bankruptcy and administratively stayed the civil case. The stay paused proceedings in that lawsuit; it was not a ruling on the merits and does not, by itself, show that Bertrandt’s claim was extinguished. Did Fisker’s bankruptcy resolve Bertrandt’s claim?
No claim-level outcome is established by the cited district-court docket, the SEC filing, or the bankruptcy-plan milestone. Verita’s case site records that Fisker’s liquidation plan was confirmed on October 16, 2024, with an effective date of October 17, 2024, but those dates do not establish whether Bertrandt’s particular bankruptcy claim was allowed, paid, or otherwise resolved. The district-court action and the bankruptcy process are distinct; confirmation of a liquidation plan alone is not evidence of the disposition of this individual claim.
