Sometimes—but only within a specific operator’s approved service area. A robotaxi is legal for passenger trips when its operator has the required federal vehicle status, state and local permissions, and a mapped operating domain that includes both your pickup and destination. A driverless-looking car on a public street may instead be testing, mapping or carrying employees. Check the operator’s live service map and app immediately before booking: neighborhood boundaries, invitations, airport access and booking channels can change without a citywide announcement.
What “legal” means for a robotaxi
Robotaxi legality is not a single nationwide yes-or-no label. Several layers of authorization must line up for your particular trip.

Federal vehicle rules and exemptions
Federal law sets vehicle safety standards and allows the National Highway Traffic Safety Administration (NHTSA) to issue exemptions or other approvals. For example, NHTSA’s 2026 action for Zoox granted a temporary exemption covering portions of eight Federal Motor Vehicle Safety Standards (FMVSS). The exemption runs from July 31, 2026, through July 31, 2028, and permits up to 2,500 vehicles annually for two years under the terms of that action. This is a vehicle-level authorization; it does not automatically create passenger service in every state or city.
State and local operating permission
States and municipalities can add requirements for autonomous-vehicle testing, deployment, drivers, inspections, licensing, registration and operating practices. NHTSA identifies these state and local rules as potential conditions or barriers. An operator can therefore be federally compliant yet unable to offer public rides on a particular street, in a particular county or at a particular airport.

Testing is different from passenger service
A testing permit generally allows an operator to evaluate an automated-driving system under specified conditions. A deployment or commercial authorization is the permission relevant to carrying ordinary paying riders. California’s Department of Motor Vehicles separates autonomous-vehicle testing permits from deployment authorizations. Its September 17, 2026 listing includes Tesla Robotaxi LLC, Waymo LLC and Zoox Inc. among permit holders, but the listing itself is not a promise that every vehicle from those companies accepts public bookings in every California community.
How autonomous the vehicle really is
Level 4 is geofenced automation
NHTSA describes Level 4 as a system that performs all driving tasks only inside limited service areas. Within that domain, the automated driving system is intended to handle the trip without a human driver continuously driving. Outside the domain, the system is not designed to operate as a consumer robotaxi. That is why a service can be legal downtown but unavailable two suburbs away.
Level 5 is not a consumer option
Level 5 would operate universally, on any road and in any normal driving condition, without a limited service area. NHTSA says this level is not available for consumer purchase. A vehicle that can drive itself in one mapped city should not be described as an autonomous car that can legally take you anywhere.
“Driverless” does not mean “without people”
Vehicles may use remote assistance, customer-support staff or fleet operations teams even when no safety driver sits in the front seat. Other programs may still have a safety driver during testing or limited pilots. Before you ride, read the operator’s current explanation of in-car support, remote assistance, emergency procedures and whether a human may be present. A car seen operating with a person behind the wheel may be collecting test data rather than providing the same service offered through the public app.

On October 14, 2026, Waymo announced that anyone could download its app and ride in Tampa, San Diego and San Antonio without an invite code. That announcement changes access status, not the underlying geofence: a qualifying city can still contain streets, buildings or pickup zones that the app will not serve.
How to check whether your address is eligible
Use the following process immediately before every important trip. A service map viewed days earlier can be out of date.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errors- Open the operator’s official app. Do not rely on a vehicle sighting, a social-media post or a general city list.
- Enter both endpoints. Type the exact pickup address and destination, including a building entrance or designated curb when the app requests one.
- Inspect the pins. The app should accept both locations inside the highlighted service area. If either pin is outside the boundary, the ride is not available as entered.
- Check market access. Look for labels such as open to everyone, invite-only or gradually onboarding riders. A city can appear on a service list while your account is still waiting for access.
- Confirm the booking channel. Waymo uses its own app in most listed markets; in Austin and Atlanta, its listed rides are available through Uber. Downloading the wrong app can make a legal service appear unavailable.
- Read the pickup instructions. Construction zones, one-way streets, gated properties and event controls can move the legal pickup point to a nearby curb.
- Recheck shortly before departure. Road closures, weather, demand, software restrictions or a temporary operational pause can remove an otherwise eligible trip.
Airport rides need a separate authorization check
A citywide or regional approval does not necessarily include an airport. Airports control their own curbs, commercial-vehicle access, staging areas and passenger pickup rules. Nevada illustrates the distinction: in August 2026, the Nevada Transportation Authority approved autonomous-vehicle network applications from Tesla Robotaxi, Waymo and Aviari, including an authorization for up to 5,000 fully autonomous vehicles during the first 12 months for Tesla Robotaxi. Airport service still required authorization from the Clark County Department of Aviation.
Before booking an airport trip, search the operator’s airport-specific instructions in the app and verify both arrival and departure procedures. The approved pickup point may be a particular garage, terminal island or rideshare area rather than the curb outside baggage claim. Allow extra time if the vehicle must navigate a designated meeting zone.
Public, invite-only and staged access
Open public service
Open service means a qualifying account can request a ride without a special invitation, subject to the operator’s age, payment and account rules. The October 14, 2026 expansion made Tampa, San Diego and San Antonio available to anyone downloading the app, while still requiring an eligible pickup and destination.

Invite-only launches
Invite-only programs restrict bookings to selected residents, employees, research participants or existing users. Seeing the vehicles in your neighborhood does not create eligibility. If the app asks for an invite code, there is no lawful workaround through a different pickup address unless the operator explicitly permits that arrangement.

What to verify before getting in
Robotaxi rules differ by operator and can change as the service expands. Review the current rider policy for:
- Seat belts: Every passenger normally must buckle up, and the vehicle may not begin moving until required restraints are fastened.
- Children: Check minimum ages, supervision requirements and whether you must provide and install a child safety seat. Do not assume a vehicle supplies one.
- Mobility devices: Confirm wheelchair or scooter dimensions, ramp access and whether a specific accessible vehicle must be requested.
- Luggage: Trunk capacity and loading rules may limit large, oversized or unusually shaped bags.
- Pets: Service-animal protections and ordinary pet policies can differ. Read the current rule before dispatch.
- Emergency stops: Learn how to contact in-car support, request a safe stop and report a medical or security emergency.
- Account rules: Age, identity verification, payment method and phone requirements may apply even when the market is open to everyone.
Price, wait time and reliability: what is—and is not—known
Fares, estimated pickup times, cancellation terms and vehicle availability are dynamic. They can vary by operator, neighborhood, time of day, demand and weather. No single authoritative current statistic supports a fair cross-city comparison of robotaxi fares, wait times or safety against conventional taxis. Treat the quote and estimated arrival shown in your app as the relevant figures for your trip, not as a permanent market average.
Keep a backup option when the trip is time-sensitive. A temporary service pause, road closure, event surge or unavailable pickup zone can occur even inside a mapped market. A conventional taxi, rideshare or public-transit plan may be necessary if the app cannot dispatch a vehicle.

Common situations and the right response
“I see autonomous cars, but the app says unavailable.”
The cars may be testing, mapping, repositioning or operating under a different authorization. Check the official map and your exact endpoints; do not infer passenger eligibility from street activity.
“The destination is just outside the boundary.”
Do not ask the vehicle to cross the geofence. Book to an approved drop-off point only if the operator’s app accepts it, then arrange a separate legal connection for the remaining distance.
“The app offers a pickup at the airport, but no curb location.”
Look for terminal-specific instructions or contact in-app support. Airport access may be restricted to a designated lot or garage even when the airport appears selectable.
“I am visiting a listed city.”
Eligibility follows the pickup address and account status, not your home city. Enter the hotel, station or venue address and verify the market’s onboarding rules before relying on the ride.

Frequently asked questions
Can I ride a robotaxi if my city is not on the operator’s list?
Usually not. A vehicle may be testing nearby, but public rides require an approved service domain and an accepted booking for both endpoints.
Do I need a special driver’s license?
Passenger requirements are set by the operator and local rules. A rider generally books as a passenger, but account age, identity and supervision rules can still apply. Read the current policy in the app.
Is a robotaxi automatically legal because it has no driver?
No. Driverless operation is a technical mode, not a blanket legal status. Federal vehicle authorization, state and local permissions, and a valid mapped service area must all apply to the trip.

Frequently Asked Questions
Can a robotaxi pick me up outside the mapped zone if I call support?
Only if the operator expands or temporarily authorizes that location. Support cannot normally override a geofenced service boundary.
Are robotaxi fares regulated like taxi-meter rates?
The applicable pricing and transportation rules depend on the jurisdiction and operator. Check the fare, cancellation terms and disclosures shown before you confirm the ride.
What should I do if the vehicle cannot complete my trip?
Follow the in-app support and safe-stop instructions, move to a safe location when directed, and arrange backup transportation if the service ends before your destination.
The Bottom Line
Robotaxis are legal and usable only where a specific operator has the necessary federal, state and local approvals and the app accepts both ends of your trip. Treat the live pickup map, access notice and airport instructions as the final authority—not a car sighting or a citywide headline.
