Why Washington’s ‘Tesla Tax’ Sponsor Says the Law Is About EV Credits, Not Elon Musk

Washington’s HB 2077 taxes certain surplus zero-emission vehicle credits. Sponsor Joe Fitzgibbon says its purpose is to fund a broader EV transition, not target Tesla or Elon Musk.

Washington House Majority Leader Joe Fitzgibbon says the state’s tax on certain surplus zero-emission vehicle credits is meant to redirect part of their value toward wider electric-vehicle adoption—not to punish Tesla or Elon Musk. Tesla was described as the only automaker then above the law’s threshold, but the statute is written around qualifying manufacturers and credit activity, not Tesla by name.

Who is the lawmaker behind Washington’s Tesla tax?

Joe Fitzgibbon, a Democrat and Washington House Majority Leader, sponsored HB 2077 with Representative Nicole Macri. GeekWire interviewed Fitzgibbon about the measure on May 7, 2025, while lawmakers were considering it. He rejected the claim that the bill was personal retaliation against Elon Musk, saying: “That’s not what this bill is about.” GeekWire’s report describes both his rationale and the criticism the proposal drew.

Why did Fitzgibbon support taxing surplus EV credits?

Fitzgibbon argued that manufacturers with substantial zero-emission vehicle (ZEV) credit surpluses should contribute to the broader transition to electric vehicles. He said the ZEV program had created significant financial benefits for Tesla, and that some of that value could instead support charging infrastructure and incentives that help more people adopt EVs.

In the interview, he put the case this way: “Washingtonians would be better served and would have an easier time accessing electric vehicles if we invest in charging infrastructure and in incentives, than having 100% of these dollars go to Tesla’s bottom line.” He also said, “And the goal of the [zero emission vehicle] program was never to reward a monopoly.” These are Fitzgibbon’s arguments for the law, not evidence that the tax has produced the predicted investments or adoption gains.

What rationale does the law give?

HB 2077’s legislative findings describe ZEV credits as tradable and bankable tools that help manufacturers meet increasingly demanding clean-vehicle standards. The findings also say that surplus credits can generate windfall profits for companies that do not carry the same legacy internal-combustion production burden. The act’s stated intent is to tax those windfall profits and reinvest the funds in programs and incentives that promote cleaner vehicles and Washington’s climate goals. That formal rationale overlaps with Fitzgibbon’s case for infrastructure and incentives, but the statute—not any single interview comment—sets out the law’s stated purpose. What does the law tax, and was Tesla its only target?

The law covers specified activity involving surplus ZEV credits by qualifying manufacturers, including selling and banking credits and related treatment. It exempts manufacturers below a threshold tied to credits associated with 25,000 zero-emission vehicles or qualifying plug-in hybrid vehicles in a model year. The statutory language and its definitions govern exactly which activity and manufacturers qualify; the phrase “Tesla tax” is a nickname, not the law’s official name or a description of an exclusive target.

GeekWire reported in May 2025 that Tesla was the only automaker then above the statutory credit threshold. The article cited Washington Department of Ecology figures showing Tesla had more than 106,000 credits in the state in 2023, compared with more than 13,000 each for Volkswagen and Ford. Those are historical counts available to the report at that time, not current 2026 figures. GeekWire also reported that the proposed rates included 2% on sold credits and 10% on banked credits; the enacted statute should be consulted for full applicability and calculation details.

Did HB 2077 become law?

Yes. The Washington House passed the bill 52–45 on April 22, 2025, and the Senate passed it 28–19 on April 26. Governor Bob Ferguson signed it on May 20, 2025. It became Chapter 419, Laws of 2025, effective that same day. The Legislature’s official bill history records its passage and enactment; the Department of Revenue’s 2025 tax legislation page also lists SHB 2077 as effective May 20, 2025.

What were the competing arguments?

Supporters viewed the tax as a way to capture some value from unusually large credit surpluses and fund EV infrastructure or incentives. Critics argued that taxing credits could weaken a market-based compliance system, raise costs for manufacturers that need credits to meet standards, or discourage EV sales. Craig Segall, an independent consultant and former California Air Resources Board deputy executive officer, told GeekWire: “What Washington is proposing to do here is make it significantly harder to get more electric vehicles on the road.” Rivian public policy director Hannah Steinweg wrote that the measure “undercuts a proven, market-based policy and risks creating ripple effects” in other states.

The dispute is about the incentives and costs the policy may create: whether taxing surplus activity reduces windfalls without undermining the credit market, and whether the resulting revenue benefits the wider EV transition. GeekWire reported a Washington estimate of nearly $78 million for the 2025–2027 biennium, with projections expected to more than double later. That was a contemporary forecast, not collected revenue. The available reporting does not establish post-enactment effects on revenue, credit prices, vehicle prices, or EV adoption.
