Why the USPTO Refused Tesla’s Robotaxi Trademark as “Merely Descriptive”

The reported refusal concerned trademark registration for specified goods or services—not a ban on using “Robotaxi.” Later filings have separate serial numbers and procedural histories.

The USPTO’s reported refusal concerned whether “ROBOTAXI” identifies Tesla as the source of specified goods or services—or simply describes what they are. The May 2025 report described a nonfinal office action, not a final ruling that Tesla can never register the term or is barred from using it. The records involve several different applications, so their dates and outcomes should not be treated as one continuous case.

What “merely descriptive” means in this case

In a trademark application, the examiner considers whether the applied-for wording tells consumers something about the goods or services listed in that particular application, rather than functioning inherently as a sign of their commercial source. The May 2025 report said the examiner regarded “ROBOTAXI” as descriptive of the applied-for offering. The precise scope of any refusal depends on the application and the wording of its office action.

This is a dispute about trademark registration—not a patent grant or denial. A refusal in an application does not, by itself, establish that Tesla has lost all rights to the word or cannot use it. It addresses registration for the goods or services in that application.

Why the May 2025 report was not a final ban

The report published May 8, 2025 described a nonfinal refusal. That procedural step gives an applicant an opportunity to respond; it is not a final adjudication that the mark can never be registered. A response can be followed by further examination or other proceedings, and an application’s later status must be checked in its own file.

The report should not be generalized into a decision covering every Tesla ROBOTAXI application. Each serial number is a separate record, and a refusal, response deadline, or later proceeding in one file does not automatically apply to the others.

The form says the response deadline would be six months from the action’s issue date. The cited record does not establish this application’s eventual outcome.
Serial no. 99185848 As of September 10, 2026, TTABVUE listed a pending opposition, proceeding no. 91310278, involving Tesla’s application. Cihan Turan is listed as plaintiff. This is a separate proceeding, not the reported May 2025 descriptiveness refusal.
Serial no. 99032366 In the same TTABVUE record, this appears as a pleaded application with a suspension-letter status. It is not the same application as serial no. 99185848.

The October 2025 office-action search results identify separate actions, but the official PDFs were not available in the cited record for verifying exact wording or goods-and-services descriptions. Those details should not be inferred from the search-result index.

How to read the February 2026 extension request

The extension request for serial no. 98795389 documents a procedural step, not a decision on the merits. It records Tesla’s request for additional response time and identifies November 20, 2025 as the office-action issue date. It does not show what Tesla later argued, whether the USPTO accepted those arguments, or the application’s eventual disposition.

What the September 2026 opposition does—and does not—mean

The TTABVUE entry dated September 10, 2026 lists an opposition as pending under proceeding no. 91310278, involving application serial no. 99185848. An opposition is a separate record from an examining attorney’s descriptiveness refusal. The same entry’s reference to serial no. 99032366 as a pleaded application does not merge that application into Tesla’s file or establish its outcome.

How to verify a particular Tesla ROBOTAXI filing

Before drawing a conclusion about a filing, match the serial number and inspect that application’s own record. Compare the mark format, listed goods and services, office-action date and type, response history, and current status. For an opposition, also identify the TTAB proceeding number and distinguish the challenged application from any other application pleaded in the proceeding.
