The agency recorded eight complaints, one injury incident and an estimated 6,813 vehicles in the population under review. The probe examined an alleged safety problem; it did not, by itself, establish a defect or order a recall.
What the Fisker Ocean probe was about
NHTSA’s Office of Defects Investigation (ODI) opened preliminary evaluation PE24013 on May 8, 2024. The subject was “Inadvertent Automatic Emergency Braking” in the 2023 Fisker Ocean. ODI said it was examining reports of braking without an apparent roadway obstruction, with sudden deceleration and inadequate warning or driver input.
The opening resume described a range of reported events: “The braking applications range from momentary, partial application resulting in rapid loss of speed to full application, which brings the vehicle to a complete stop in the travel lane.” ODI said the evaluation’s purpose was to determine the potential problem’s scope and severity and assess possible safety issues—not to announce that a defect had been confirmed. NHTSA’s PE24013 opening resume records the allegations and investigation scope.

These are counts in the opening record, not an estimate of how often the event occurs or the probability that an Ocean will experience it. The population figure is the number ODI estimated for the evaluation, not a denominator that makes the complaint count a measured risk rate.

Sean O’Kane’s May 10, 2024 TechCrunch report said three of the eight complaints involved reported injuries. That description differs from NHTSA’s resume, which records one injury incident and one injury. The figures describe different reporting accounts and should not be treated as interchangeable counts.
Why it was called the fourth federal safety probe
TechCrunch characterized PE24013 as Fisker’s fourth federal safety investigation and identified three earlier subjects: loss of braking, vehicle rollaway, and doors that would not open. “Fourth” refers to the sequence of investigations described in that May 2024 report; it does not mean NHTSA opened a fourth probe in 2026 or that four investigations were active at the same time.

The label alone does not establish that the probes shared evidence, outcomes or remedies. The subject of PE24013 was unexpected AEB activation, not the separate braking-loss allegation.
Was PE24013 a recall, and what happened later?
No. A preliminary evaluation is an investigation into allegations, not a recall or a final determination that a safety-related defect exists. NHTSA explains that consumer complaints can help prompt an investigation; a recall follows a determination by the manufacturer or NHTSA that a vehicle presents an unreasonable safety risk or fails minimum safety standards. Investigations can close after recall recommendations or when a safety-related defect is not identified. See NHTSA’s recall and investigation information.

A 2026 LegalClarity account says PE24013 closed in January 2025 because NHTSA lacked sufficient information after Fisker’s remaining staff were dismissed. It also says the closure was not a finding that no safety-related defect existed. The official closure notice was not available in the material supporting this article, so this later status is attributed to LegalClarity rather than presented as directly verified from an NHTSA notice. How this investigation differs from Ocean recalls
Other Ocean safety actions addressed distinct issues. They are not outcomes of PE24013 and should not be confused with the AEB allegations.

How Ocean owners can check for open recalls
Use the vehicle’s VIN to check whether a recall repair remains outstanding. NHTSA’s VIN lookup shows unrepaired recalls for a specific vehicle; its year, make and model lookup provides broader recall information. A model-level result does not confirm whether a particular vehicle’s repair has been completed, and NHTSA says vehicle lists for recent recalls may change as VINs are added.
