France is the clearly verified national example: its current law sets a 2040 objective to end sales of new passenger cars and light commercial vehicles that use fossil fuels. That is a new-vehicle sales objective—not a requirement to scrap or stop driving cars already on the road. The European Union has a separate 2035 emissions framework for new cars and vans, while the COP26 declaration is a pledge to work toward zero-emission sales, not domestic legislation.
Which countries have a 2040 policy?
Among the policies established by the official sources cited here, France is the national 2040 case. Article 73 of France’s Mobility Orientation Law sets the objective of ending sales by 2040 of new passenger cars and light commercial vehicles using fossil fuels. The law’s French wording is: “La fin de la vente des voitures particulières et des véhicules utilitaires légers neufs utilisant des énergies fossiles, d’ici à 2040.” Read Article 73 of the law.
This does not establish that France is the only country with a 2040 ambition. It means France is the national example supported here by a current statutory provision; a longer country-by-country list would require checking each government’s current law or policy and identifying its legal status.
What France’s 2040 objective covers
The wording covers new passenger cars and light commercial vehicles that use fossil fuels, so it is broader than gasoline cars alone. Article 73 also sets a separate 2040 objective for new heavy vehicles used to carry passengers or goods when they use fossil fuels predominantly. These provisions sit within a wider objective of complete decarbonization of land transport by 2050. France’s Mobility Orientation Law, Article 73.

Does the EU ban petrol and diesel cars in 2035?
The EU has a different measure and a different date. Regulation 2023/851 revises the EU’s rules for the CO₂ performance of new passenger cars and vans. The European Commission describes the 2035 target as a 100% reduction in emissions for those new vehicles. This is an EU-wide fleet-emissions framework, not France’s national 2040 sales objective. Calling this a straightforward “ban” can obscure how the rule works: its legal mechanism is based on fleet-average CO₂ performance standards. The Commission’s “zero-emission” shorthand refers to the target outcome; it should not be confused with a direct rule telling current owners to stop using their cars.

Will existing gasoline cars still be legal to drive after 2040?
France’s Article 73 concerns the sale of covered new vehicles. It does not say that owners must scrap existing gasoline or diesel cars, prohibit driving them in 2040, or establish a ban on used-car sales. Those questions are not settled by this clause and would require separate rules to answer.
What does the COP26 2040 commitment mean?
The COP26 declaration says its government signatories “will work towards all sales of new cars and vans being zero emission by 2040 or earlier, or by no later than 2035 in leading markets.” That is a declaration of intent by signatories, not a law that by itself changes domestic vehicle-sales rules. It should therefore be distinguished from France’s statutory objective and the EU’s regulation. Read the COP26 declaration.

How common are zero-emission new vehicles in the EU region?
The European Commission reported that zero-emission vehicles accounted for 14.5% of new car registrations and 6.4% of new van registrations in 2024 across the EU, Norway, and Iceland. These figures apply to those vehicle categories and that stated geography; they are not France-only or global shares. European Commission vehicle-emissions overview.
