There is no single highest legal tint that applies across the United States. The darkest film you can legally use depends on the state where the vehicle is registered or operated, which window the film is on, and sometimes the type of vehicle or a specific exception. The short answer for any driver is the lowest visible light transmission (VLT) figure that the current law for that state allows on that particular window, and that figure is only meaningful once you know the state and the window.
What “highest” means in tint law
Tint darkness is measured as VLT, the percentage of visible light that passes through the window and any film on it. A higher VLT means a lighter window. A lower VLT means a darker window. So the question “what is the highest legal tint” is usually answered by looking for the lowest VLT the law permits. Many state rules are written the other way around, as a minimum VLT that the glass and film together must still meet. A rule requiring 35% VLT, for example, allows nothing darker than 35%.
Two more terms appear in most statutes. Reflectivity limits control how mirror-like the film can look from outside the vehicle. Some states also cap reflectivity separately from VLT, so a film that meets the VLT floor can still be non-compliant.
Why no single national maximum exists
Tint rules are set by individual states, and each state can divide the vehicle into several zones with different limits. A complete answer depends on four variables:

- Jurisdiction. The state where the vehicle is registered or regularly operated sets the rule.
- Window location. Windshield, front side windows, rear side windows, and the rear window are often treated differently.
- Vehicle class. Some states apply different allowances to multipurpose vehicles, vans, or buses.
- Exceptions. Medical exceptions and other exemptions can change the answer for a specific driver, usually with documentation.
A compiled 50-state table was not verified for this guide, so the examples below should not be read as a national summary. They show how much the answer changes from one state to the next.

The table lists the official limits identified for five jurisdictions. Each row names the source and date, and “not stated” means the cited text did not set a value for that cell.

Virginia’s rules are not stated in this guide because current statutory text for Virginia was not confirmed. Check the Virginia Code and the state’s motor-vehicle agency before relying on any figure for that state.
Delaware changed its front-window and rear-window rules in 2026
Delaware is the clearest example of why older summaries go stale. The Delaware Code has long allowed film on the front side windows and side wings if it has a VLT of 50% or greater. The wording reads, in part: “Window tint or other material may be applied to the side windows to the immediate right and left of the driver and side wings forward of and to the left and right of the driver, if the window tint or other material has a visible light transmission of 50% or greater.”

The enacted text of Substitute Senate Bill 255 keeps the 50% front-side requirement. It also specifies no VLT requirement for rear side windows or the rear window, which means a numeric VLT floor no longer applies to those windows under that text. This guide covers only the windows named in the enacted text. Confirm with the Delaware Division of Motor Vehicles that no other provision applies to your vehicle before choosing a rear-window film.
Windshields follow a separate rule
Windshield film is almost always handled differently from side and rear glass. Where a state allows tint on the windshield, the allowance is usually a strip along the top edge. Nebraska and Delaware refer to the AS-1 line, which is the manufacturer’s marking on most factory windshields that indicates the highest point the top strip may reach. Massachusetts limits its allowance to the uppermost six inches and bars any encroachment on the driver’s direct forward view. Do not assume a side-window percentage applies to a windshield.

Factory glass affects the final number
Most vehicles already have some tint or factory glass, and the transmission of that glass is part of the total. A film’s package VLT describes the film alone. The number that matters for compliance is the combined transmission of the glass and the film together, which is why a film labeled at a compliant VLT can still produce a window that fails the state limit. Ask the installer to confirm the measured result on your actual glass before the work is done.

Exceptions are where the simple VLT rule most often breaks down. Delaware’s code text allows a medical-necessity statement, which is a formal document tied to a medical condition, not a general preference. Other states may have similar exemptions, and some vehicle classes, such as certain vans and buses in Nebraska, have their own allowances. Because the documentation requirements differ by state, obtain the form, the issuing standard, and any expiration rule from the state agency before relying on an exception.

How to confirm the rule for your vehicle
- Identify the state where the vehicle is registered and where it is mainly driven. The registration address and the operating location both matter.
- Find the current statute or official DMV guidance for that state, and note the date on the document. Check whether a more recent amendment has taken effect, as Delaware’s 2026 change did.
- Look up each window separately: windshield, front side windows, rear side windows, and rear window. Record the VLT minimum, any reflectivity limit, and any mirror or vehicle-class condition.
- Check the exceptions section and decide whether one applies. If it requires a medical document, confirm the required wording and who may sign it.
- Ask the state motor-vehicle agency or a qualified local authority to confirm the rule in writing if the statute is unclear for your vehicle type.
- Before installation, ask the shop for the combined VLT of the glass and film on your vehicle, and keep the invoice and any exemption paperwork in the car.
Choosing film without guessing
Automotive window tint film is sold with a stated VLT, and that number is useful for planning. It does not establish legality on its own. Match the film’s specifications against the applicable current rule for each window, then account for the factory glass and the reflectivity limit where one applies. A film that suits one state’s front-side rule may fail another state’s rear-window or reflectivity limit, so the film choice should follow the rule, not the other way around.
