If a used-car dealer’s statements about a vehicle or its price do not match the car, advertisement, or paperwork, save the evidence first, compare the specific claims with the signed documents and vehicle records, then ask the dealer in writing for a defined resolution. Report suspected deception to the Federal Trade Commission (FTC) and the relevant state consumer or dealer regulator if appropriate. A mismatch is a reason to investigate, not by itself proof of a legal violation. Return rights, warranty protections, remedies, and deadlines depend on the state and the facts.
What to do first if the dealer lied about the car or changed the price
Act while the advertisement, messages, and vehicle-specific records are still available. Keep the car and transaction evidence together, and avoid relying on an oral explanation when you can ask for a written one. These steps help clarify what was represented and what you agreed to; they do not determine whether the dealer broke the law.

- Save the records. Download or print the listing and advertisement, including screenshots with the date and the vehicle identification number (VIN) if shown. Save written out-the-door quotes, texts, emails, the purchase order, retail installment contract, add-on and financing documents, the Buyers Guide, warranty papers, payment records, and any written promise about the car or price. Record the VIN, odometer reading, names, dates, and a brief timeline of conversations and events.
- Write down the exact mismatch. Note what the dealer said or advertised, where and when it appeared, what the vehicle or final paperwork shows instead, and why the difference matters. Keep facts distinct from assumptions. For example, “the listing says no accident reported; the history report dated [date] shows a recorded accident” is more useful than “the dealer hid the accident.”
- Request a written explanation and a specific remedy. State what you want the dealer to do—such as correct a charge or address a condition—and give a reasonable response date. Keep a copy of your message and any response. There is no universal dealer dispute process or response deadline established by the federal guidance described here.
Do not discard or write on original paperwork. If a page is corrected or replaced, keep the earlier version as well as the new one. A dated, organized file makes it easier for a state consumer office, attorney, or other reviewer to understand the dispute.
How to check whether the dealer misrepresented the price
Compare the price in the advertisement with the written quote and the final signed paperwork. Do not treat every difference as the same kind of charge: a dealer fee, a government-required charge, an optional product, and a discount with an eligibility condition raise different questions.

| Compare | What to look for |
|---|---|
| Advertised price and eligibility terms | Was the advertised figure available to any consumer, or did it depend on a condition such as a particular financing arrangement or rebate eligibility? Save the wording that describes any restriction. |
| Written quote and purchase order | Identify the vehicle price, dealer fees, taxes and other government-required charges, add-ons, discounts, and any conditions. A written out-the-door quote helps show the total the dealer represented before signing. |
| Signed contract and financing papers | Check whether the vehicle price and listed products match what you approved. Separate the amount financed and total amount paid over the loan from the vehicle’s advertised price. |
| Optional products | Look for service contracts, protection products, or other add-ons. Compare their names and costs with the documents you signed and the options you recall accepting. |
The FTC says advertised prices should include mandatory dealer fees—the charges the dealer requires any consumer to pay—while government-required charges are treated differently. State rules may also govern fee disclosures, caps, or wording. The FTC’s Automobile Industry Pricing Transparency FAQ illustrates the distinction: if a dealer advertises a $40,000 vehicle and charges any consumer an $85 document fee, the advertised price must be $40,085. That is an FTC illustration, not a typical fee or a current market estimate.
A low monthly payment does not show the whole cost. Review the annual percentage rate (APR), finance charge, payment amount and count, total amount paid over the loan, vehicle price, and add-ons separately. If a number in the contract is unclear, ask the dealer or finance company to explain it in writing and identify the document supporting the charge.
How to check condition, accident history, or other vehicle claims
For a dispute about condition or history, compare the dealer’s specific statement with the Buyers Guide, warranty documents, available vehicle-history information, and an independent inspection. These sources answer different questions and should not be treated as interchangeable.

Use records for the claim they can address
- Vehicle-history information may contain recorded title, accident, or odometer information. It typically does not identify mechanical problems, and the absence of a reported event does not establish that no such event occurred.
- An independent mechanic’s inspection can document observed condition and estimate necessary repairs. Ask for a dated written report that identifies the vehicle, describes findings, and separates urgent repairs from other recommendations. An inspection by itself does not prove what the dealer knew or whether a statement was legally deceptive.
- The Buyers Guide and warranty papers are important evidence about whether the dealer offered a warranty or sold the vehicle “as is,” and what coverage was described. Compare their terms with any specific oral or written promise.
Keep the report, inspection invoice, photographs, and repair estimates. If a problem is safety-related, prioritize safety and obtain appropriate professional advice before driving; preserve records of any necessary work. Do not assume a history report settles a mechanical-condition dispute.

What the federal Used Car Rule and Buyers Guide mean
The FTC Used Car Rule generally applies to dealers who sell or offer more than five used vehicles in a 12-month period. The federal rule does not apply in Maine and Wisconsin, which have similar state requirements. Covered dealers must display a Buyers Guide on used vehicles they offer and give the buyer the original or a copy at the sale.
The Guide indicates whether the dealer offers a warranty or sells the vehicle “as is,” and includes warranty details. FTC consumer guidance says the Guide must reflect changes negotiated in warranty coverage and overrides conflicting sales-contract terms about warranty coverage. Keep the Guide you received and compare it with the warranty document and contract; do not rely only on a salesperson’s summary.
An “as-is” notation does not automatically resolve every possible claim about what the dealer said or did. Warranty and “as-is” rules differ by state, and the effect of the paperwork depends on the transaction and applicable law. If the Guide is missing, appears inconsistent with the contract, or does not reflect a negotiated warranty, note the discrepancy and seek state-specific guidance rather than assuming a particular remedy.

- Identify the transaction: your name, purchase date, vehicle year and model, and VIN.
- Quote the representation: include the exact advertisement language, written quote, or promise, with the date and where it appeared.
- Describe the conflicting evidence: identify the contract line, inspection finding, history record, or other document that differs.
- Request a clear outcome: state the correction, explanation, or other resolution you are seeking. If you are asking to unwind the purchase or return the car, say so, but do not assume the dealer must agree.
- Set a reasonable response date: ask for a written response by that date. This is a practical request, not a universal legal deadline.
Keep the tone factual and preserve any reply. If the dealer offers a correction or settlement, read the terms before signing or accepting it, and keep a copy of any revised paperwork. When a loan or add-on is involved, make sure the proposed resolution explains how the relevant contract and charge will be handled.
Can you return a used car after buying it?
There is no universal federal three-day cancellation period for every used-car purchase from a dealer. FTC guidance says return and cancellation rights vary: some states require a right to cancel, while elsewhere a short return option may exist only if the dealer offers it. If the dealer promised a return period, locate the written policy and check its conditions, dates, and required steps. Ask the dealer to confirm any claimed policy in writing.
Do not assume that a disappointing purchase, a later-discovered problem, or an “as-is” label alone determines whether you can cancel. The answer may depend on the state, the exact representations, the sale documents, warranty terms, and other transaction facts. A state consumer-protection attorney or government consumer office can help assess potential rights and deadlines before you rely on a return option.

When filing, give a concise chronology and attach copies of the relevant listing, quote, contract pages, Buyers Guide, and vehicle-specific evidence. Keep your originals and save the complaint confirmation. Use the agency’s own directions for the materials it accepts; do not send more personal or financial information than requested.
A complaint can alert enforcement authorities to a possible pattern or violation, but filing one does not guarantee an individual refund, contract cancellation, repair, or other relief. If your immediate goal is to recover money or resolve a contract, ask a state consumer office or qualified attorney what options and deadlines apply to your transaction.

“The dealer changed the price after I arrived”
Put the advertisement, any written quote, and signed paperwork side by side. Identify the new amount and each reason given for it. If a mandatory dealer fee was added, compare it with the FTC’s advertised-price guidance and your state’s fee rules; separately identify taxes or other government charges and any genuine eligibility condition attached to a discount.

“The dealer added fees or products I didn’t agree to”
Match each line item on the purchase and finance documents to the documents you signed and any written selections. Ask the dealer to show where you authorized each optional product and explain any fee. A listed charge is evidence of what was included in the transaction, but the paperwork and applicable state requirements matter in assessing whether it was properly disclosed or authorized.

“The car is not as advertised”
Save the exact ad or promise and identify the particular claim that conflicts with the vehicle’s records or inspection. A general impression that the car was described too favorably is harder to evaluate than a specific statement about accident history, mileage, condition, or included equipment. An inspection can help document condition; it does not on its own establish the dealer’s knowledge.
What to have ready when seeking state-specific help
State law determines many warranty rules, potential remedies, complaint channels, and deadlines. Before relying on a right to cancel, warranty coverage, or a particular legal claim, gather the complete sale file and ask a state consumer-protection attorney or government consumer office to review the transaction.
- The advertisement, listing, written quote, and any dealer promises
- The purchase order, signed sales and financing contracts, add-on documents, and payment records
- The Buyers Guide and any warranty or service-contract documents
- The VIN, odometer reading, history information, inspection report, and repair estimates
- Your dated timeline, written complaint to the dealer, and the dealer’s response
Provide the state where the transaction occurred and the dates of purchase and discovery when asking about deadlines. Do not infer that a deadline is extended because you complained to an agency or are still negotiating with the dealer.
