If you have received paperwork alleging dangerous driving, check the exact document and its instructions, note every date and deadline, and contact a solicitor experienced in serious motoring or criminal defence cases promptly. Do not ignore the notice or assume that a standard response period applies: the document you received determines what you must do next. This guidance is for England and Wales; criminal procedure differs in Scotland, Northern Ireland and other jurisdictions.
Start with the paperwork, not assumptions
People often use “summons” as a general term for court papers, but the document may have a different formal name and its own instructions. The Criminal Procedure Rule Committee’s defendant guidance, published on GOV.UK on 12 August 2026, is a useful procedural resource for England and Wales, including for people without a lawyer. It does not replace advice about your charge, evidence or choices in your individual case.

- The exact name and wording of the document.
- The offence wording, including the section or legal provision if shown.
- The court named on the papers and any case reference.
- The hearing date and time, if one is listed.
- Any response deadline, attendance requirement or other instruction.
- Any enclosed forms, correspondence or information about how to respond.
Read the whole pack, including the reverse sides of pages and any separate enclosures. If something is unclear or appears inconsistent, note the question and raise it promptly with a solicitor. Do not infer that a deadline is flexible, or that a familiar-sounding notice follows the same timetable as another type of notice.

In particular, distinguish the document’s title from the allegation it describes. A summons, requisition or another notice may have different instructions. The word “summons” used in conversation or online does not establish which procedure applies. The exact notice and its directions—not a general timetable you have heard about—control your next steps.
Get advice promptly and preserve relevant material
A dangerous-driving allegation is serious: a conviction can expose a driver to custody and a mandatory driving ban. A solicitor who handles serious motoring or criminal defence matters can consider the allegation, the paperwork, the evidence and the procedural choices in context. The available official guidance does not support a universal recommendation to plead guilty or not guilty; that decision requires advice based on the particular case.
When looking for legal help, relevant practical considerations include the solicitor’s experience with serious motoring cases, whether they can advise in the area where the case is being heard, how soon they are available, and their fees. The research for this article does not compare providers or establish typical fees, so ask directly what the proposed service covers and what it will cost. A general legal resource or office supply is not a substitute for advice about a live charge and its deadlines.
While arranging advice, preserve material that may help explain what happened or clarify the allegation. This is sensible preparation, not a guarantee that an item will be admissible, persuasive or decisive.
- Keep the complete court paperwork and all related correspondence.
- Preserve photographs, dashcam footage and other video that may be relevant. Avoid editing or deleting original files.
- Keep relevant vehicle records and note where the vehicle was, who had access to it, and who may have been driving, if those matters are in issue.
- Write down the names and contact details of potential witnesses, along with what you believe they may have seen. Avoid coaching anyone or asking witnesses to align their accounts.
- Make a factual timeline while events are still fresh, distinguishing what you personally remember from what you learned later.
Give the solicitor the full paperwork and be candid about facts that may seem unhelpful as well as those you think support your position. Do not destroy, alter or conceal potentially relevant material. If you are unsure whether something matters or how to handle it, ask the solicitor.

Understand what dangerous driving means
The Crown Prosecution Service describes the offence under section 2 of the Road Traffic Act 1988 by reference to section 2A. The legal test is whether the driving fell far below the standard expected of a competent and careful driver and whether it would have been obvious that driving in that way was dangerous.
The CPS gives examples that include racing, excessive speed or aggressive driving; ignoring traffic lights, road signs or warnings from passengers; dangerous overtaking; and driving while impaired by drink or drugs, including prescription drugs. They are examples of conduct that may be relevant—not a finding about your case, and not a checklist that determines guilt by itself. The allegation must be assessed against its actual facts and evidence.

Do not decide the strength of a case solely by comparing it with one example or by your own view of whether a manoeuvre was “careless.” The charge concerns the legal test described above. A solicitor can explain how the alleged conduct and available evidence relate to that test.
Know the potential consequences without predicting the outcome
The Sentencing Council for England and Wales’ dangerous-driving guideline is effective from 1 July 2023 and was last updated on 5 October 2026. It classifies the offence as triable either way and gives the following figures. They describe the guideline and statutory consequences, not a prediction of the sentence in an individual case.

The court determines the outcome in the case before it. The offence range is not a promise that a particular sentence will be imposed, and the maximum is not the expected result in every case. The relevant circumstances and a person’s history matter; discuss them with a solicitor rather than trying to calculate an outcome from the headline figures alone.

Do not confuse a summons with a Single Justice Procedure Notice
A Single Justice Procedure Notice (SJP notice) is a distinct process, not a generic name for a court summons. GOV.UK describes it as a way for a magistrate to decide a minor criminal offence without the defendant going to court. Its stated response period is 21 days from the date on the SJP notice.

It should not be applied to a dangerous-driving summons or another document just because it arrived by post or asks for a response. Dangerous driving is triable either way under the Sentencing Council guideline, so check the title and instructions on the document you actually received and take legal advice. If you are unsure what kind of notice it is, show the entire document to a solicitor promptly rather than relying on an online description or an assumed deadline.
Follow the hearing and response instructions
Do not ignore a listed hearing, response requirement or deadline. Follow the directions in your paperwork, and attend when required. If you cannot attend or have a problem meeting a deadline, contact a solicitor urgently about whether an application or other step is needed. Do not assume that explaining the problem after the date has passed will resolve it, or that you can change a hearing date without formal action.
The precise notice governs the steps in an individual case. This article cannot establish what response is required from a document it has not seen, and the general SJP timetable is not a substitute for reading the papers. Keep a record of any communications about the case and make sure the solicitor has enough time to advise before a deadline or hearing.
Questions to take to a solicitor
A first conversation is more useful when you can identify the allegation and the immediate procedural position. You do not need to reach your own legal conclusions first. Provide the paperwork and ask questions tied to what it says.

- What evidence or records should I preserve or provide?
- What facts or issues need to be clarified before deciding how to respond to the allegation?
- What are the possible procedural choices, and what are the consequences of each?
- How could the potential driving disqualification and extended re-test affect me if I am convicted?
These questions are a starting point, not a substitute for case-specific advice. Do not enter a plea simply because of a general article, a comparison with another driver’s case or pressure to make a quick decision without understanding the papers.

If you dispute being the driver, tell the solicitor that clearly and promptly, and provide the complete notice and any information that may help identify who was using the vehicle. Ask what the paperwork requires you to do and how to respond accurately. Do not ignore the allegation because you were not stopped by police, believe you do not own the vehicle, or think another person was driving. The right response depends on the exact papers and facts, so avoid guessing or making a statement you cannot support.
Being unsure who was driving, not owning the vehicle, or not having been stopped at the time are reasons to explain the circumstances to your solicitor—not reasons to assume the notice can be disregarded. Keep relevant vehicle records and any information about access to the vehicle, but do not speculate or present uncertain recollections as established facts.
Keep the jurisdiction in view
The procedural guidance, SJP description and sentencing figures described here concern England and Wales. Scotland and Northern Ireland have different criminal procedures, and other countries have their own laws and deadlines. If the court or alleged offence is outside England and Wales, do not use the deadlines or procedural descriptions here as instructions; obtain advice appropriate to that jurisdiction.

Does the 21-day Single Justice Procedure deadline apply to a dangerous-driving summons?
