A side-by-side is an off-highway vehicle with seats next to each other and automotive-style controls, typically a steering wheel and pedals. A conventional ATV has a straddle seat and handlebars. The seating and controls are the clearest way to tell them apart; labels such as “UTV” and “ROV” can overlap, so check a specific vehicle’s design and classification.
How is a side-by-side different from an ATV?

These are category-level descriptions, not specifications for every model. The U.S. Consumer Product Safety Commission (CPSC) describes an ATV in its federal statutory definition as an off-highway vehicle designed to travel on three or four wheels, with a seat designed to be straddled and handlebars for steering. The Occupational Safety and Health Administration (OSHA) describes UTVs, also called side-by-sides, as rough-terrain vehicles with occupants seated next to each other and a steering wheel. Are “side-by-side,” “UTV,” and “ROV” the same thing?
They are related terms, but they are not always exact synonyms. “Side-by-side” describes the seating arrangement and is commonly used for UTV-style vehicles. CPSC staff distinguishes utility task vehicles (UTVs) from recreational off-highway vehicles (ROVs) in its reporting, using criteria that include maximum speed and typical cargo or safety equipment. Marketing language can be less precise, so when a formal category matters, use the vehicle’s documentation and the terminology of the relevant regulator rather than assuming every label means the same thing. What should you check on a particular vehicle?
Names alone do not tell you how many people a vehicle may carry, how much cargo it can handle, or how it is classified. Before riding or hauling anything, check the owner’s manual and manufacturer labels for:

- Seating capacity and passenger restrictions.
- Payload and cargo-bed limits, if equipped.
- The vehicle’s classification and intended use.
- Any local requirements that apply to its registration, equipment, or operation.
The federal ATV definition addresses vehicles with the specified ATV design; it does not create one universal legal category or road-use rule for every side-by-side. Registration, licensing, age restrictions, required equipment, and road access depend on the location and the exact vehicle. Confirm current requirements with the relevant local authority. Can you drive an ATV or side-by-side on public roads?
Do not assume either type is road-legal. These are off-highway vehicles, and public-road use depends on local rules and the specific vehicle. CPSC advises keeping off-highway vehicles off roads except when crossing where permitted. Check your jurisdiction’s rules before using one on or across a public road. What safety precautions apply?
CPSC recommends hands-on instruction, carrying no more riders than there are designated seats, avoiding alcohol, choosing youth-appropriate models for riders under 16, and wearing a helmet and other protective gear. Those recommendations are a starting point; follow the specific vehicle’s manual and applicable local requirements.
In its workplace eTool, OSHA also advises following the manufacturer’s passenger limit, completing a T-CLOC inspection—tires and wheels, controls and cables, lights and electrical systems, oil and fuel, and chain and chassis—and using recognized, machine-specific safety training. What do the available injury figures say?
CPSC’s current safety information reports 2,448 deaths associated with off-highway vehicles in the United States from 2018 through 2020, including nearly 300 children younger than 16. It also estimates 94,700 OHV-associated injuries treated in U.S. hospital emergency departments in 2022. CPSC says ATVs accounted for 92% of OHV injuries over the five-year period it reports. These are category- and period-specific figures, not head-to-head risk rates showing that one vehicle type is more dangerous per vehicle or per ride.
