Do I need a lawyer after a car accident?
Not every person needs a lawyer to make an insurance claim. You may be able to handle a straightforward matter yourself, but legal advice can be useful when the consequences or process are difficult to assess. Consider contacting a lawyer if:

- You have significant, ongoing, or disputed injuries.
- Fault is contested or more than one person may be responsible.
- An insurer denies the claim, disputes the amount, or asks you to accept a release.
- You are unsure which policy or claim route applies.
- A government entity may be involved, or a special notice deadline might apply.
- You need help understanding the effect of shared fault or the terms of a settlement.

What should you preserve after a crash?
Care and safety come first. When it is safe and practical, collect and keep records that may help establish what happened and how the crash affected you:
- Police or crash reports, photographs of the scene and vehicles, and witness names and contact details.
- Medical records, bills, receipts, and information about treatment.
- Repair estimates, vehicle-damage records, and other relevant expenses.
- Information about missed work and lost earnings.
- Insurer letters, emails, claim numbers, and notes of calls or other communications.

How does a lawyer deal with the insurance company?
The route depends on whose policy may cover the loss. A first-party claim is made under your own policy; a third-party claim seeks payment from another driver’s insurer. These relationships can involve different rights and duties. In a third-party claim, the insurer’s primary obligation is to its own policyholder, according to the Illinois Department of Insurance.

A lawyer may help organize documentation, communicate with an insurer, negotiate, and assess a denial or offer. You should still comply with notice requirements in your own policy and avoid inaccurate or misleading statements. How should you assess a settlement offer?
Potential losses can include medical expenses, vehicle damage, missed earnings, pain, and future losses, depending on the facts and applicable law. A lawyer can help evaluate the documentation and what the proposed settlement resolves. The Illinois Department of Insurance warns that signing a release can make the offered amount the only amount recoverable from the driver and insurer for the released claims. How much does a car accident lawyer cost?
Fee arrangements vary. Arizona State Bar guidance says many personal-injury lawyers use contingency fees, while hourly and set-fee arrangements also exist. A contingency arrangement generally ties the lawyer’s fee to a recovery, but it does not necessarily mean the client owes nothing if there is no recovery: litigation expenses may be treated separately from the fee.
Read the written agreement for the fee calculation and its base, which costs may be advanced or reimbursed, who pays expenses if there is no recovery, and which parts of the matter the lawyer will handle. The agreement may specify whether representation covers bodily injury, vehicle damage, benefits under your own policy, negotiation, litigation, or an appeal. When should you contact a lawyer?
Contacting a lawyer promptly can give you time to understand your options and preserve records, especially if injuries are serious, fault is disputed, or an insurer seeks a release. Do not wait for settlement discussions to conclude before checking the applicable filing and notice deadlines. A lawyer can help identify which dates apply and whether a special rule may affect them.
How long do you have to file a car accident lawsuit?
There is no single nationwide deadline. Limitation periods can differ for bodily injury and property damage, and claims involving government entities may have separate notice or filing rules. Tolling, a claimant’s age, and other circumstances can also matter. These examples illustrate state variation; they are not a substitute for checking the law where the crash occurred:

Fault rules differ too. Illinois describes recovery generally when the claimant is 50% or less at fault; Texas says no damages are paid if the claimant is 51% or more at fault. What should you clarify before hiring a lawyer?
Ask for the terms in writing, including the scope of representation and how fees and expenses work. If only part of the matter is covered, clarify who will handle the rest. For example, an ethics opinion from the State Bar of North Carolina illustrates that an engagement may be limited to an injury claim while leaving property damage outside the representation, subject to that jurisdiction’s rules and client consent; it is not a nationwide rule.
