WA Safety Cameras: Phone and Seatbelt Enforcement by Location

WA safety cameras detect phone use, incorrectly worn seatbelts and speeding. Mitchell Freeway phone and seatbelt infringements are scheduled to begin 1 December 2026.

Yes. Western Australia’s safety cameras can detect drivers using or holding phones, drivers and front-seat passengers without correctly worn seatbelts, and speeding. The key difference is location: phone and seatbelt detections from the new Mitchell Freeway cameras remain in a caution period through 30 November 2026, while those offences are already subject to fines and demerit points at other operating safety-camera sites.

What WA safety cameras detect

The Road Safety Commission says its cameras can detect multiple offences at once:

  • Drivers using, holding, or resting a mobile phone on their body while driving.
  • Drivers and front-seat passengers who are not wearing a seatbelt or are wearing it incorrectly.
  • Speeding.

There are two types of camera: large yellow trailers that can be moved around Western Australia, and fixed cameras installed at permanent sites. The Commission’s 24 September 2026 update listed ten operating trailers and fixed cameras on the Kwinana Freeway and Mitchell Freeway. When fines apply depends on the camera location

The new Mitchell Freeway cameras have a temporary education period for phone and seatbelt detections. The Commission says those detections receive caution notices through 30 November 2026, with infringements scheduled to begin on 1 December. Speeding enforcement at those sites began on 1 June 2026.

At other safety-camera locations, the caution period ended on 7 October 2025. Fines and demerit points have applied there since 8 October 2025. The start date for one offence at one location should not be assumed to apply to every camera or offence.

Yellow camera trailers are mobile, so their operating locations can change. Check the Commission’s current safety-camera page for its latest list rather than assuming a trailer remains at a particular site.

What drivers may do with a phone

WA guidance allows a driver to use a phone as a driver’s aid, such as GPS, only when it is secured in a mount attached to the vehicle and the driver does not hold or touch it. A mount does not make other phone handling legal.

The Road Safety Commission lists a $500 fine and three demerit points for holding, touching, or resting a phone on any part of the body while driving. It lists $1,000 and four points for serious illegal use, including creating, sending, or looking at a text, email, social post, photo, video, or similar content. Seatbelts must be worn correctly by drivers and passengers

Drivers must ensure passengers are appropriately restrained, and it is an offence to travel without a seatbelt or wear one incorrectly. A belt worn under the arm or off the shoulder is treated as an unrestrained occupant for the penalty table.

The fine is not one flat amount for every seatbelt offence. The Commission’s examples include a $550 penalty and four demerit points for an unrestrained driver, with higher driver penalties when additional passengers are unrestrained. An unrestrained passenger aged 16 or over is listed at $550. The amount depends on who is unrestrained and the number of occupants involved; consult the Commission’s seatbelt guidance and penalty table for the relevant case.

What counts as incorrect use

A seatbelt needs to be properly positioned to restrain its wearer. For example, wearing the shoulder portion under the arm or letting it sit off the shoulder is not treated as compliant use under the Commission’s penalty guidance.

What the published camera figures do—and do not—show

Government figures describe detections, camera-reported rates, and review outcomes; they are not interchangeable measures.

  • More than 380,000 offences during the eight-month caution period: The Western Australian Government reported this in 2025, before fines and demerit points began. It itemized 26,800 people without a seatbelt, more than 88,000 wearing one incorrectly, and close to 97,000 with a phone in hand. These were detections, not a count of convictions or fines.   • About an 80 per cent decline in the captured offence rate: In an announcement dated 24 April 2026, the Government said the rate of seatbelt and mobile-phone offences captured had fallen by about 80 per cent since Kwinana Freeway cameras began in February 2025, alongside state-wide trailers. This is a government-reported camera detection rate, not independent proof that cameras caused an equivalent population-wide reduction. Government announcement, 24 April 2026
  • Seatbelt review requests and successful appeals: A 10 March 2026 Legislative Council answer reported 2,194 review requests involving driver and passenger seatbelt infringements, and 934 successful appeals in passenger cases involving failure to wear a belt or incorrect adjustment. The 2025 caution-period total and the 2026 reported rate decline cover different periods and measures, so they should not be read as a direct before-and-after comparison.

Appeals and what is not established about later withdrawals

The March 2026 parliamentary answer also said the Road Safety Commission was undertaking a broad review of the legislation, processes, and systems governing driving offences. Later opposition releases alleged withdrawals and abandoned prosecutions, but the official camera program page and the parliamentary answer do not confirm those newer totals or explain their evidentiary basis. The current number and legal status of any such cases therefore cannot be established from those official sources.

Where camera infringement money goes

The Western Australian Government says all money from safety-camera infringements goes to the Road Trauma Trust Account, which is required to fund projects and programs aimed at reducing injuries and deaths on WA roads. Government announcement, 8 October 2025
