The panel finding did not automatically end the duty.
What does the 40% EV tariff cover?
Türkiye’s Ministry of Trade says the additional 40% duty on electric vehicles from China has applied since 4 March 2023. The rate describes an additional duty on the covered EV imports; it is not, by itself, a complete calculation of the customs charge for a particular vehicle.
The applicable treatment for an individual import depends on its tariff classification, origin and any applicable exemptions, as well as the current official tariff schedule. Türkiye’s consolidated Decision 3351 page lists amendments through 11 July 2026 and contains tariff tables, but it does not resolve every tariff-line question or provide a complete landed-cost calculation.
Why is Türkiye imposing the duty?
The official material cited here establishes when the measure began and how it was treated in the WTO dispute, but does not establish a specific policy rationale for imposing it. It would therefore be speculative to attribute the duty to a particular domestic-industry or trade-policy objective.

What did the WTO panel find?
The dispute is WTO case DS629, “Türkiye — Measures Concerning Electric Vehicles and Other Types of Vehicles from China.” China requested consultations on 8 October 2024 over several measures, including the EV additional duties, import-permit requirements and duties on other Chinese vehicles.
The panel report circulated on 28 July 2026. For the EV additional duties, the panel found that they were inconsistent with GATT Article II:1(b) because they exceeded the tariff bindings in Türkiye’s schedule, and with Article II:1(a) because they afforded less favorable treatment than that schedule provided. These are panel findings; they should not be described as an adopted final WTO resolution.

Türkiye’s Ministry of Trade said on 15 September 2026 that it disagreed with aspects of the panel’s assessment and was considering the timing of appeal or review procedures. The ministry also said the report did not itself create an automatic compensation or payment obligation.
Is the 40% EV tariff still in effect?
The latest verified WTO procedural update, dated 25 September 2026, said China and Türkiye had requested more time and that the Dispute Settlement Body postponed consideration of the panel report until 27 October 2026. That scheduled date had not arrived as of 8 October 2026.

The report had not been adopted in that update, and the cited notices do not confirm that Türkiye withdrew the duty. The panel finding alone did not automatically revoke it. Because the current procedural and tariff position may change, importers should check the latest WTO docket and official Turkish tariff schedules rather than assume either that the duty has ended or that a particular vehicle necessarily incurs exactly 40%.

No. The 2023 measure concerns covered electric vehicles from China. A separate measure, Decision 8639, concerns China-origin passenger cars classified under tariff heading 8703. Adopted on 8 June 2024 and effective from 8 July 2024, it sets a duty of 40% or US$7,000 per vehicle, whichever is higher, according to the Turkish Union of Chambers and Commodity Exchanges (TOBB) notice.

The measures have different dates, scopes and rate formulas. A vehicle’s classification and origin determine which tariff provisions may apply; the headline figures alone are not enough to determine its customs bill.
What importers should verify
- Confirm the vehicle’s exact tariff code and whether it qualifies as an EV or falls under heading 8703.
- Verify origin under the applicable rules; shipment from China alone does not establish a vehicle’s customs origin.
- Check the current official tariff tables and any applicable exemptions before estimating duties.
- Check the DS629 docket for procedural developments after the WTO’s 25 September 2026 notice.
