The Road to AV Safety Has Potholes: What U.S. Drivers Should Know

Autonomous-vehicle safety is a matter of operating limits and evidence, not a simple yes or no. Here is how U.S. crash reporting, testing, road conditions and federal rules fit together.

Are self-driving cars safe yet? There is no single yes-or-no answer: safety depends on the vehicle’s capabilities, where and when it operates, how it handles unusual situations, and what evidence is available about its performance. In the United States, crash reporting and testing frameworks provide useful safeguards, but they do not amount to a finished national rulebook or a simple safety score. Potholes are a useful reminder that real roads vary; federal sources do not publish a national figure for pothole-caused autonomous-vehicle crashes.

What does “autonomous vehicle” mean—and is it the same as driver assistance?

People often use “AV,” “self-driving,” and “driverless” as if they describe one capability. They do not. An automated driving system (ADS) performs the driving task within its defined operating conditions. Advanced driver-assistance systems (ADAS), by contrast, assist a human driver; the driver remains responsible for supervising the road and responding when the system cannot handle a situation.

A vehicle or service may be described as autonomous without being able to drive everywhere, in every weather condition, or without a human fallback. To understand what a particular claim means, ask what the system actually does, where it is allowed to operate, and who must take over if it reaches its limits. A driverless ride service in a mapped area is not evidence that the same vehicle can manage every road or condition.

How are autonomous-vehicle crashes reported in the United States?

What NHTSA’s Standing General Order covers

The National Highway Traffic Safety Administration (NHTSA) requires covered entities to report qualifying crashes involving an ADS under its Standing General Order. According to NHTSA’s order page, a report is triggered when an ADS was in use at any time within 30 seconds before the crash and the event meets specified criteria. Those criteria include a fatality, a vulnerable road user being struck, airbag deployment, a vehicle being towed away, or hospital transport. The order’s requirements were amended for a third time, effective June 16, 2025; NHTSA makes submitted incident information available for public review.

Why incident counts are not a safety rating

The order creates a reporting and oversight mechanism, not a complete measure of safety or fault. The set of covered entities and reportable crashes is limited by the order’s scope and triggers. A raw count also lacks essential context unless it is considered alongside exposure—such as miles or trips—and the system’s operating domain, time period, and circumstances of each event. The 30-second ADS-use window matters too. Counts from systems operating in different places, conditions, or amounts of traffic are not directly comparable, and a reported crash does not by itself establish who caused it.

NHTSA’s Standing General Order page also invites anyone who witnesses an automated-vehicle safety issue to submit a complaint to the agency or call its Vehicle Safety Hotline at 888-327-4236. A complaint is a way to bring a concern to NHTSA; it is not the same thing as a crash report filed under the order.

Can AVs handle potholes and bad roads?

No authoritative national figure in the cited federal material quantifies crashes caused by potholes in autonomous vehicles. It would be misleading to claim a national pothole crash rate or to infer from a reported collision that a pavement defect caused it.

Still, pavement is a sensible part of the safety question. A deep pothole, patchwork repairs, standing water, faded lane markings, glare, a temporary work zone, unusual road geometry, or a person stepping into the roadway can change what the vehicle’s sensors perceive and what its driving system must do. These are examples of conditions engineers may need to consider; they are not evidence that any one condition has caused a particular number of AV crashes.

Road and weather limits belong in a system’s operating domain: the places and conditions in which it is designed and permitted to drive. A safety claim should therefore say more than “it passed testing.” Readers need to know what road types, locations, speeds, lighting, and weather the evidence covers, and what happens when the vehicle encounters conditions outside those boundaries.

What testing is needed to show that a robotaxi is safe?

NHTSA’s published-report index describes an “Automated Driving System Testable Cases and Scenarios” framework that partitions the ADS performance space and connects evaluation to modeling, simulation, track testing, and open-road testing. No single setting can establish how a system will perform across every possible situation. The useful question is whether evidence spans relevant scenarios and whether the conditions tested resemble the service the vehicle will actually provide.

Evidence dimension What a reader should look for
Scenario coverage Does evaluation include ordinary traffic as well as rare or hazardous events and degraded-road conditions?
Testing setting Is the evidence from modeling, simulation, a closed track, a public-road pilot, or commercial service? Each setting answers different questions.
Human role Is there a safety driver, remote assistance, a fallback-ready user, or no onboard operator? Who is expected to intervene?
Operating domain What geography, road classes, speeds, weather, and lighting conditions are included—and excluded?
Outcome measures Are results reported in terms such as collisions, interventions, injury severity, traffic-law compliance, or system availability? What exposure and conditions accompany them?

For example, a vehicle completing a public-road pilot with a safety driver provides evidence about that pilot and its safeguards. It does not, on its own, demonstrate driverless performance across other regions, roads, or conditions. A credible safety case combines evidence from multiple environments with a clear account of remaining limits.

What federal safety requirements and ratings apply?

Mandatory vehicle standards

Federal Motor Vehicle Safety Standards are mandatory requirements for vehicle compliance. In an April 29, 2024 announcement, the U.S. Department of Transportation said: “NHTSA finalized a new Federal Motor Vehicle Safety Standard that will make automatic emergency braking (AEB), including pedestrian AEB, standard on all passenger cars and light trucks by September 2029.” The date refers to the announced compliance timeline for new passenger cars and light trucks; it does not mean every vehicle already on the road has AEB.

Consumer information through NCAP

NHTSA’s New Car Assessment Program (NCAP) provides consumer testing and safety-rating information; it is distinct from mandatory standards. In a November 18, 2024 decision, NHTSA described a staged roadmap adding crash-avoidance, crashworthiness, vulnerable-road-user, and overall-safety information, with implementation planned to begin in model year 2028. This expanded rating program can help shoppers compare vehicles, but it is not a certification that an ADS can operate safely in every domain.

What should you check before trusting a “driverless” safety claim?

  • Identify the system: Is the claim about ADAS that supports a human driver or an ADS that performs the driving task within stated limits?
  • Find the operating domain: Check the service area and any stated road, speed, weather, and lighting restrictions.
  • Clarify the fallback: Determine whether a person in the vehicle, a remote operator, or another mechanism is responsible when the system cannot continue.
  • Look for comparable evidence: Ask what settings and scenarios were tested, what outcomes were measured, and what exposure those outcomes represent.
  • Read incident information with context: NHTSA’s public reports can inform scrutiny, but reporting criteria and missing exposure figures mean raw totals are not a stand-alone comparison of safety.

Federal reports to Congress and the Standing General Order show active oversight, not a completed, universal national AV rulebook. For a current complaint about an automated vehicle, NHTSA accepts reports through its safety complaint process and Vehicle Safety Hotline; for a safety claim, the most meaningful answer remains specific to the ADS, its operating domain, and the evidence behind it.
