What does a car accident lawyer do?
Depending on the case and the agreement, a lawyer may review how the crash happened, assess the claim, communicate or negotiate with insurers, and bring a lawsuit if needed. That work can matter when the evidence, injury, insurance, or timing issues are difficult to manage alone. But there is no established statistic here showing that hiring a Texas car accident lawyer produces a better outcome than handling a claim without one.
Do you need a car accident lawyer in Texas?
There is no rule that every crash requires a lawyer. A straightforward claim with clear fault, resolved minor injuries, and responsive insurance may be manageable without counsel. Consider consulting a lawyer if one or more of these factors applies:

- The other driver, insurer, or witnesses dispute who caused the crash.
- Your injuries are serious, require continued treatment, or have uncertain long-term effects.
- Available insurance is unclear, disputed, or may not cover the full loss.
- Important evidence needs to be gathered or interpreted.
- A deadline to file suit may be approaching.
- You are having difficulty managing insurer communications or evaluating a proposed resolution.
These are practical decision points, not a legal test for whether representation is necessary. You can consult a lawyer without committing to hire one.
How does fault affect a Texas car accident claim?
Texas applies proportionate-responsibility rules in covered tort actions. Under Texas Civil Practice and Remedies Code §33.001, “a claimant may not recover damages if his percentage of responsibility is greater than 50 percent.” In other words, the statutory bar applies when the claimant is more than 50 percent responsible—not when responsibility is exactly 50 percent.

A lawyer may investigate and present evidence about how responsibility should be allocated, but the outcome depends on the evidence and the factfinder. This rule concerns recovery in a covered claim; it does not by itself determine what benefits may be available under your own insurance policy.
How long do you have to sue after a car accident in Texas?
Texas Civil Practice and Remedies Code §16.003 generally requires a personal-injury lawsuit to be brought no later than two years after the cause of action accrues. See the Texas statute.

Accrual, exceptions, the parties involved, and the type of claim can affect the analysis. Sending a demand or negotiating with an insurer does not necessarily preserve the right to sue. If timing is uncertain, get legal advice promptly rather than waiting for negotiations to end.
What insurance coverage should you check?
A claim against the other driver and a claim for benefits under your own policy are different routes. Texas auto policies generally include personal injury protection (PIP) and uninsured/underinsured motorist (UM/UIM) coverage unless the named insured rejects the respective coverage in writing. The applicable statutes are in Texas Insurance Code Chapter 1952; the Texas Department of Insurance consumer guide explains these coverages.

Personal injury protection
PIP can pay specified reasonable expenses related to an accident, subject to the policy and statutory conditions. Check your declarations and endorsements to confirm whether the coverage is in force, its limits, and how to make a claim.
Uninsured/underinsured motorist coverage
UM/UIM coverage can apply to qualifying losses involving an uninsured or underinsured vehicle, subject to policy terms and statutory conditions. Review your policy documents rather than assuming the coverage applies to a particular crash.
The general rules do not establish what coverage any individual has. Your declarations, endorsements, limits, and policy conditions determine the details of your own policy.
