Thanh Phan, 51, died after an e-scooter struck him on a Perth CBD footpath on May 31, 2025. Alicia Kemp, the rider, initially was denied bail after the charge was upgraded following Phan’s death. The case later concluded with Kemp pleading guilty to dangerous driving causing death while under the influence; on December 12, 2025, she was sentenced to four years in prison.
What happened to Thanh Phan?
Phan was struck near the intersection of Murray and King streets while out for dinner on May 31, 2025. Later court coverage described the collision as occurring on a footpath. He died in hospital after surgery for brain swelling, ABC reported on June 3.
Phan’s family called for a review of governance and safety regulations around hired e-scooters. In a statement reported by ABC, they said they wanted changes “to help prevent further serious incidents that put lives at risk.”
Why was Alicia Kemp denied bail?
At a June 3, 2025 bail hearing, PerthNow reported the prosecution’s account that Kemp had a blood-alcohol reading of 0.158 per cent, was riding with a passenger, and had been estimated from footage to reach up to 25 km/h. The magistrate refused bail and remanded her in custody after the charge was upgraded following Phan’s death. These were details reported from the bail hearing, not the later sentencing blood-alcohol figure.

How did the case end?
In August 2025, Kemp pleaded guilty to dangerous driving causing death while under the influence. A secondary charge relating to injury to the passenger was dropped, ABC reported.
On December 12, 2025, District Court Judge Wendy Hughes sentenced Kemp to four years’ imprisonment. ABC reported the sentence was backdated to June 1, with parole eligibility after two years and a two-year driver’s licence disqualification. Parole eligibility does not establish that a person has been released.

At sentencing, ABC reported a blood-alcohol figure of 0.185 and a speed estimate of 20–25 km/h from footage or court evidence. Those figures belong to the sentencing coverage and should not be conflated with the 0.158 per cent reported from the earlier bail hearing. Judge Hughes told Kemp, “You, Miss Kemp, are the cautionary tale,” and said e-scooters “are not toys.”
ABC reported Phan’s wife, Loan Lee, said at sentencing: “Since his death, that team has been shattered.”
