Tesla publicly urged drivers to contact the Dutch vehicle authority, RDW, in support of its FSD Supervised application. RDW asked people not to contact it and said the messages would have no effect on its schedule. The campaign is documented; evidence that it changed the regulatory outcome is not established. As of 7 October 2026, the Netherlands has a provisional approval, some other countries have separately recognized it, and EU-wide authorization remains unconfirmed in the available official record.
Is Tesla FSD approved in Europe?
Not on a single, EU-wide basis established by the available records. RDW issued provisional EU type approval on 10 April 2026, but that approval is valid in the Netherlands. Other countries can recognize it separately, which is different from an EU-wide decision.

The country count needs careful dating: Tesla’s 1 September post referred to five EU countries, while the Czech ministry’s later statement described Czechia as joining the Netherlands and five others. The newer official account establishes that later count, but does not provide a country-by-country list here.
Did the EU approve FSD on 6 October?
The available evidence does not establish that it did. A report published before the 6 October committee meeting, citing the European Commission’s draft agenda, said the committee was scheduled to continue discussions on the Dutch request under Article 39 and listed no vote. That is evidence about the planned agenda, not what happened at the meeting. Without a post-meeting official record, it would be inaccurate to say that the committee voted, approved the request, or rejected it.

Can Tesla owners contact regulators to push for approval?
RDW’s response to the 2025 campaign was that people should not contact it about the application: such messages consumed customer-service time and would not affect its schedule. The authority also said it does not share application details. The documented campaign shows Tesla asked for public support; it does not demonstrate that public messages altered RDW’s assessment or the European decision process.
What does Article 39 approval mean?
RDW describes Article 39 of Regulation (EU) 2018/858 as an exemption route for new technologies. The Dutch approval alone does not create EU-wide validity. The process RDW outlined separates the manufacturer’s application and national assessment from the later European decision:

- Demonstrate compliance: The manufacturer first has to demonstrate regulatory compliance to a type-approval authority.
- Submit a Commission application: A member state then submits an application to the European Commission.
- Committee decision: The responsible committee votes. RDW says a majority is required for EU-wide validity.
- If there is no majority: The Dutch approval remains valid in the Netherlands, while other member states may decide independently whether to recognize it in their territories.
This is why “approved in Europe” can obscure three distinct situations: Dutch provisional type approval, a separate national recognition, and EU-wide authorization.
What did RDW assess, and what do the safety figures show?
RDW’s 17 June 2026 account describes a regulator assessment that went beyond accepting Tesla’s conclusions at face value. RDW reviewed European vehicle data, checked Tesla’s collection and analysis methods for completeness, verifiability and accuracy, and had its own data experts independently review Tesla’s statistical analysis. It also conducted tests with its own equipment.

RDW said it had completed more than 3,000 hours of testing and more than 1,000 test runs, and that its assessment included 1.8 million kilometres of European FSD Supervised driving. These are figures reported by RDW in 2026. The authority also said it increased required post-approval reporting from annually to monthly.
Separately, RDW reported that nearly 40,000 Teslas equipped with FSD Supervised had driven approximately 24 million kilometres in the Netherlands without relevant incidents since approval, as of its 17 June 2026 statement. That is a regulator-reported snapshot at that date, not a current rolling total or a standalone estimate of how much the system reduces crash risk.

Tesla’s 1 September post claimed a 4.1-times lower crash likelihood across 102 million kilometres in five EU countries. That is a company-published comparison, not an independent regulator finding. Tesla’s own dashboard warns that fleet-wide comparisons do not directly control for factors including traffic density, weather, road surface, time of day and scenario complexity. It also notes possible driver-selection effects and residual confounding, and characterizes its results as observational associations rather than causal estimates from a randomized experiment. Those qualifications matter when interpreting Tesla’s safety claims.

No. RDW said, “A vehicle with FSD Supervised is not self-driving.” It describes the system as driver-controlled assistance: the driver remains responsible and must stay in control. RDW says the system monitors the driver’s eyes and availability to take over; insufficient attention can trigger alerts and temporarily prevent use.

The Czech Transport Ministry classified FSD Supervised as SAE Level 2 driver assistance. It said the driver must remain engaged, supervise continuously and be ready to take control. Neither the Dutch approval nor national recognition transfers driving responsibility from the human driver to the vehicle.
