Tesla’s Full Self-Driving Marketing Mistake May Be Hard to Undo—but Its Technology Isn’t Proven Irreversible

California regulators found Tesla’s earlier autonomy-suggesting marketing misleading, but the record does not prove its FSD technology is impossible to improve. Here’s what drivers should know.

Tesla’s biggest established mistake around Full Self-Driving is not a technical choice proven impossible to reverse. It is the way its earlier product names could make drivers think the cars were more autonomous than they were. California regulators found that marketing misleading under state law; Tesla changed its California language and avoided a threatened 30-day suspension of its dealer and manufacturer licenses. That record makes the reputational problem real, but it does not prove that Tesla’s technology cannot improve or that any hardware decision is beyond correction.

What California found—and what Tesla changed

The state’s finding concerned marketing

On December 16, 2025, the California Department of Motor Vehicles said it adopted an administrative law judge’s proposed decision that Tesla’s use of “Autopilot” and “Full Self-Driving Capability” for advanced driver-assistance features was misleading and violated state law. The DMV said vehicles with those features could not operate autonomously when the original advertisements ran and could not do so at the time of its decision.

The distinction matters: the finding addressed how Tesla described the features, not whether a particular engineering approach could ever be improved. It is also a California state finding, not a ruling that automatically applies in every jurisdiction.

The threatened license suspension was avoided

On February 17, 2026, the California DMV said Tesla had stopped using “Autopilot” in California vehicle marketing and modified its “Full Self-Driving” language to clarify that supervision is required. The agency said those corrective actions meant Tesla avoided a 30-day suspension of its California dealer and manufacturer licenses.

Does Tesla Full Self-Driving drive itself?

Tesla’s support page calls the feature “Full Self-Driving (Supervised)” and says it works under the driver’s supervision. The name does not change the driver’s responsibility. The National Highway Traffic Safety Administration (NHTSA) says: “At this time, even the highest level of driving automation available to consumers requires the full engagement and undivided attention of drivers.” NHTSA also explains that it avoids the term “self-driving” because it can lead consumers to misunderstand their role.

In practical terms, do not treat the feature as a substitute for an attentive driver. The regulator’s guidance describes the responsibility expected of consumers; it does not promise that a driver-assistance system will handle every road, situation, or error without intervention.

Is the mistake really too late to correct?

That depends on what “mistake” means. Tesla has already changed its California marketing, so the specific use of the disputed names there has been corrected. But changing labels does not automatically erase the expectations created by years of autonomy-suggesting language. That reputational and consumer-understanding problem may be harder to repair than a website or vehicle listing.

The official record summarized here does not establish that Tesla’s camera-based or other technical strategy is irreversible, that its hardware cannot be changed, or that Full Self-Driving cannot improve. Proving any of those claims would require technical evidence about system performance and limitations, the feasibility and cost of hardware retrofits, and results across defined operating conditions. A marketing decision by itself cannot answer those engineering questions.

How to read Tesla’s safety claims

Tesla’s safety report says collision incidence is lower when FSD (Supervised) is engaged than during manual driving, and describes its data sources and methodology. That is a company-presented comparison, not by itself an independent finding that FSD causes fewer crashes. The result should be assessed with attention to how the driving miles and collision events are counted, which drivers and conditions are represented, and whether the comparison groups are equivalent.

Tesla’s safety page cites more than 40,900 U.S. road fatalities in 2023, attributing that figure to NHTSA. Tesla also presents injury and fatality estimates that extrapolate its current FSD collision reductions to national travel and injury or fatality data for 2024. The company’s calculation assumes that fewer collisions would mean fewer injuries and fatalities. Those are Tesla estimates based on an extrapolation and assumption, not observed national FSD injury or fatality totals or an independent causal finding.

What the Cybercab inquiry does—and does not—show

On September 4, 2026, NHTSA announced an audit query to assess the basis for Tesla’s self-certification that Cybercab complies with federal motor vehicle safety standards. An audit query is an inquiry, not a finding that the vehicle fails those standards. It adds a current federal compliance question to the broader autonomy debate, but it does not settle whether Tesla’s existing driver-assistance technology can be improved or whether its design choices are permanent.

What consumers should take away

  • Read the current label literally: Tesla’s support page describes FSD as supervised, and NHTSA says consumer driving automation requires full driver engagement and undivided attention.
  • Separate marketing from engineering: California found earlier Tesla naming and advertising misleading; that finding does not prove the technology is technically unfixable.
  • Keep company safety claims in context: Tesla reports its own comparison and extrapolated estimates; neither should be mistaken for independent proof of a causal safety benefit.
  • Distinguish inquiry from outcome: NHTSA’s Cybercab audit query asks about the basis for self-certification; it is not a noncompliance determination.

Tesla’s support page also states that its FSD transfer program ended on March 31, 2026. That is a dated product-policy detail, not evidence about the system’s autonomy or its technical prospects.
