The California DMV adopted that decision in December 2025 and proposed a 30-day suspension of Tesla’s California sales license, but stayed the suspension while Tesla made changes. In February 2026, the DMV said those changes were sufficient and did not suspend the license.
What the California DMV case decided
The case was a California state administrative proceeding about vehicle advertising—not a customer lawsuit seeking compensation. The DMV challenged Tesla’s use of “Autopilot” and “Full Self-Driving Capability” to describe advanced driver-assistance systems (ADAS). On December 16, 2025, the DMV announced it had adopted the administrative law judge’s proposed decision, which found the marketing misleading and in violation of California law. The ruling concerned how the features were named and described. It did not establish that Tesla vehicles were autonomous, determine that every owner had been personally deceived, or award damages to customers.
Why individual proof of harm was not required
The administrative law judge said the DMV could regulate vehicle advertising without proving that a particular person had actually been deceived or harmed. That is the agency’s authority in an advertising matter; it is not a finding that every customer experienced harm. TechCrunch’s report on the decision

Why California did not suspend Tesla sales
The proposed decision included a 30-day suspension of Tesla’s license to sell vehicles in California. The DMV stayed the suspension and gave Tesla 90 days to make changes. After that compliance period, California regulators concluded in February 2026 that Tesla had made sufficient changes and chose not to suspend the license. Associated Press report
The Associated Press reported that Tesla added “supervised” to Full Self-Driving and stopped using Autopilot in its California marketing. The DMV’s decision addressed its compliance requirements in this matter; it does not establish that all of Tesla’s marketing has been cleared in every jurisdiction.

How this differs from Tesla’s federal class action
In re Tesla Advanced Driver Assistance Systems Litigation is a separate federal case brought by customers over alleged misrepresentations about Tesla vehicles’ self-driving capabilities. On August 18, 2025, U.S. District Judge Rita F. Lin certified a class with modified definitions. The order addressed allegations that vehicles had the hardware needed for full self-driving and a promised cross-country drive. The court found the hardware statement sufficiently material for the relevant FSD purchaser class, but did not certify a class based on the cross-country-drive statement because the plaintiff had not shown common exposure to it. Class certification determines whether claims may proceed on a class-wide basis; it is not a final ruling that Tesla committed fraud or owes damages. The federal court’s order also discussed historical optional package prices of $3,000 to $15,000. Those are figures in the court’s historical record, not current Tesla prices or a current product specification.

Other Tesla litigation is not part of the DMV ruling
Tesla’s June 2026 Form 10-Q reported a proposed consumer class action filed June 4, 2026, concerning alleged statements about driver-assistance capabilities; Tesla said it intended to defend itself. The filing also described a distinct Florida product-liability case involving a 2019 crash, in which a jury awarded compensatory and punitive damages. Tesla said it appealed. The California outcome is therefore narrower than a finding that Tesla owes customers money: the DMV found the marketing violated state law, required corrective changes, and later decided not to impose the proposed sales suspension.
