Tesla and Owen Diaz, a Black former worker at the company’s Fremont, California, factory, settled Diaz’s racial-discrimination lawsuit in March 2024. The reported filing said the agreement resolved all claims, but did not disclose its amount or other terms. The $3.2 million in the headline refers to the jury’s 2023 verdict before the settlement—not the amount Diaz received.
What the $3.2 million figure represents
At a 2023 retrial limited to damages, a federal jury awarded Diaz $175,000 in compensatory damages and $3 million in punitive damages. Together, those awards total $3.175 million, commonly rounded to $3.2 million. They were the jury’s verdict, not a disclosed settlement payment. The court record describes the retrial award.
Compensatory and punitive damages
Compensatory damages are intended to address harm to the plaintiff; punitive damages are intended to punish particularly wrongful conduct and deter similar behavior. The jury’s award included both categories, but the later settlement’s undisclosed terms mean the public record described in the settlement report does not establish what, if anything, Tesla paid under each category or in total.
How the case reached the retrial
- 2017: Diaz filed suit over alleged racial discrimination at Tesla’s Fremont factory.
- 2021: A jury awarded him $137 million. A judge later reduced the award to $15 million, and Diaz sought a new trial rather than accept the reduced amount.
- 2023: A second jury considered damages and awarded $175,000 in compensatory damages and $3 million in punitive damages. Post-verdict motions and cross-appeals followed.
- March 2024: Tesla and Diaz settled, resolving the claims.
The Associated Press reported the settlement and the earlier verdict history in its March 16, 2024 account. Reuters also reported in November 2023 on the post-verdict proceedings, including denial of a request for another trial: Investing.com’s report.

What was alleged about the workplace
Diaz alleged that during roughly nine months working at Tesla’s Fremont factory, coworkers repeatedly used racial slurs and subjected him to other racist abuse, and that Tesla failed to stop the conduct after he complained. Those are allegations made in the case and reported in connection with it; the confidential settlement does not, by itself, establish each alleged incident.

According to the Associated Press, the filing characterized the agreement as a “final, binding settlement agreement that fully resolves all claims.” The filing described in that report did not disclose the settlement amount or other terms. The available reporting also does not say that the settlement included an admission of liability. Therefore, the $3.175 million jury award—and the rounded $3.2 million figure—should not be described as Diaz’s settlement payout.
