Tesla says drivers must actively supervise it, keep their eyes on the road and remain responsible for safe operation. The feature is available only in approved markets and on eligible vehicle configurations. Those requirements are important, but they do not establish one Europe-wide answer to who would be liable after every crash: that depends on the country, the circumstances and the applicable insurance and legal rules.
What Tesla means by Full Self-Driving (Supervised)
The name can sound like a promise that a car will drive itself. Tesla’s actual description is narrower: currently enabled features require active driver supervision and “do not make the vehicle autonomous.” Tesla describes functions such as following a route, changing lanes, navigating around other vehicles and objects, and making turns. Those capabilities do not replace the driver’s role.

Tesla’s support material says the driver must use additional caution, remain attentive, and retain responsibility for the vehicle’s speed and control whether Full Self-Driving (Supervised) is enabled or not. Its subscription agreement is equally explicit: the feature requires active supervision with eyes on the road, and the user and authorized drivers are responsible for safe operation and traffic violations. The branding is not permission to disengage.

That means the driver should not treat the feature as permission to read, use a phone, sleep, or stop monitoring traffic. The operational point is not merely to be present in the driver’s seat: the driver must continue to watch the road and be able to respond if the system does not handle a situation safely.

What supervision requires in practice
Think of the system as assistance while you perform the driving task, not as a substitute for that task. Tesla’s agreement specifies eyes on the road. The cited materials do not establish a universal rule that drivers must keep both hands continuously on the steering wheel in every situation; follow the instructions and alerts shown in the vehicle, and do not use the absence of a hands-on alert as evidence that monitoring is unnecessary.
- Keep watching. Monitor the road, other road users and the vehicle’s behavior rather than relying on the feature to notice every hazard.
- Be ready to take control. If the vehicle’s action is unsafe, inappropriate or inconsistent with the road, intervene as needed. The driver remains responsible for control and speed.
- Use it only when lawful and appropriate. Tesla’s agreement says use must be safe and legal. A feature’s presence in the car does not establish that it is permitted or available in every location.
- Remain accountable for ordinary driving obligations. Tesla’s agreement identifies safe operation, speeding, tolls, parking and other traffic violations as responsibilities of the user and authorized drivers.
These points apply when the feature is engaged; Tesla’s support page also says the driver retains responsibility whether it is enabled or not. If the vehicle prompts the driver to take action, that is not a handoff that removes responsibility—it is a reason to respond.
Is Tesla Full Self-Driving available in Europe?
Availability is limited by regulatory approval, country, vehicle configuration and software. Tesla’s global product page says the feature is available only in selected markets and that regulatory approval and other factors affect whether all features are available. Its broader country list includes the Netherlands, Lithuania, Estonia, Denmark, Belgium, Slovenia, Czech Republic and Croatia, among other markets. That product-page list should not be treated as proof that a subscription can be bought in every one of those countries.

Tesla’s subscription support page lists the Netherlands, Lithuania, Estonia, Denmark, Belgium and Slovenia as European markets for monthly subscriptions. This is a snapshot of Tesla’s published list as of October 9, 2026, not a guarantee of continuing eligibility. The subscription list is narrower than the countries appearing on the product overview. Check the current subscription page and the options shown for your own vehicle before assuming availability.

For the latest published market information, see Tesla’s Full Self-Driving (Supervised) overview and its FSD subscriptions support page. A country being listed does not settle whether a particular car, account, software version or use case qualifies.
How European rules help explain the distinction
The phrase “self-driving” is not, by itself, a regulatory classification. EU Regulation (EU) 2019/2144 distinguishes an “automated vehicle,” designed to move autonomously for certain periods without continuous driver supervision but with driver intervention still expected or required, from a “fully automated vehicle,” designed to move autonomously without driver supervision. The definitions help clarify why a system that assists with some driving functions should not automatically be understood as one that permits the person in the driver’s seat to disengage.

Those definitions do not independently classify every Tesla software version or regional vehicle configuration. A reader should not infer from the product name, a feature demonstration, or these broad EU categories that a particular deployment has been approved as fully automated.

UN Regulation No. 157 concerns Automated Lane Keeping Systems and includes driver-availability recognition and override provisions. Its existence illustrates that approval and technical requirements depend on the system category. It should not be read as blanket approval for Full Self-Driving (Supervised).

The clearest practical answer is that the driver should expect to retain responsibility for supervising and operating the vehicle. Tesla’s support and subscription materials place responsibility for safe operation and traffic violations on the driver. UN Regulation No. 171 likewise retains driver responsibility for driver-control assistance systems within its scope. A driver therefore should remain attentive and ready to intervene even while the feature is active.

A collision’s outcome can depend on the country’s law, what happened, the vehicle and software configuration, what the driver and system did, applicable insurance terms and the evidence available. For an actual claim, consult the relevant insurer and a qualified lawyer in the country concerned. Do not rely on the feature’s name, its status at the moment of a crash, or a general EU definition as a complete answer to liability.
What to check before relying on the feature
- Confirm local and vehicle eligibility. Check Tesla’s current regional information and the options available for your own account and car. Approval and subscription-market status are not the same as confirmation that every vehicle configuration qualifies.
- Check the car’s configuration and software. Tesla says availability can vary by hardware, software version, region, model, trim and model year, and that a required software update may be needed.
- Read the current in-vehicle instructions and applicable terms. Tesla’s subscription agreement and support information explain its supervision and responsibility expectations. The agreement page’s cited terms were last updated in March 2025; consult the current page rather than assuming the wording cannot change.
- Drive as the responsible operator. Keep your eyes on the road, monitor the car and surroundings, and be prepared to manage speed and control. Do not let the product name or feature activation change your attention to driving.
- For a crash or legal dispute, preserve the specifics. The broad sources do not decide a particular case. The country, circumstances, vehicle and software configuration, insurance terms and event evidence all matter to a jurisdiction-specific assessment.
Tesla’s Full Self-Driving (Supervised) support page describes feature functions and driver responsibilities. Its additional resources and FSD subscription agreement set out the contractual language; the page cited here was last updated March 2025.
