A Tesla driver was arrested after a fatal April 19, 2024, crash in Snohomish County, Washington, but published accounts conflict over whether prosecutors filed a criminal charge. The driver told a state trooper he had been using Autopilot and looking at his phone; later reporting said vehicle data showed the car was operating on Full Self-Driving. The two system names are not interchangeable, and the available reporting does not establish a final criminal outcome.
What happened in the Snohomish County crash?
On April 19, 2024, a 2022 Tesla Model S struck motorcyclist Jeffrey Nissen, 28, who died at the scene. In its April 24 report, the Associated Press said a Washington State Patrol trooper’s probable-cause document described the driver hearing a bang and the car lurching forward as it hit the motorcycle. The driver told the trooper he had been using Autopilot and looking at his phone while the Tesla was moving.
At the time of that initial report, investigators had not independently verified the driver’s account of which system was in use. Subsequent reporting added a vehicle-data finding, described below.
Was the Tesla driver charged?
The driver was arrested on suspicion of vehicular homicide. Arrest, filing a criminal charge, and conviction are separate legal stages, and the accounts about this case do not agree on the second.

- April 24, 2024: The Associated Press described an arrest for investigation of vehicular homicide.
- April 26, 2024: The Smoking Gun reported that Washington court records showed the driver had been charged.
- January 2026: The Spokesman-Review reported that the driver had not been criminally charged and prosecutors were still reviewing the case.
The latest located status account is the January 2026 report. These published accounts leave the filing history unresolved; they do not establish a conviction or other final court disposition.
Was Autopilot on, or was it Full Self-Driving?
The early account and later vehicle-data reporting use different labels. The driver reportedly told the trooper he had been using Autopilot. In August 2024, an Associated Press story carried by Scripps News reported that Washington State Patrol investigators had determined from event-data-recorder information that the Model S was operating on Full Self-Driving at the time of the crash.

Those descriptions should not be collapsed into one. The first is the driver’s reported statement; the second is a later account of investigators’ vehicle-data finding. The reporting does not provide a basis to treat Autopilot and Full Self-Driving as synonymous or to add details about the system’s operation beyond those accounts.
What is known about the family’s lawsuit?
In January 2026, The Spokesman-Review reported that Nissen’s family had filed a wrongful-death lawsuit against Tesla in Snohomish County Superior Court. A lawsuit is a civil proceeding, separate from the criminal investigation. Claims made in the filing are allegations; the reported filing does not itself establish Tesla’s liability.

Did the Autopilot recall apply to this car?
The Associated Press reported that the crash occurred about four months after a Tesla recall covering more than 2 million vehicles. The recall addressed a system intended to ensure drivers paid attention while using Autopilot. AP said it was not known whether the Model S involved in Nissen’s death had received the software update. The reported information therefore does not establish that this vehicle was or was not updated, or that recall status caused or prevented the crash.

In November 2024 correspondence, the National Highway Traffic Safety Administration said Tesla’s public descriptions of Full Self-Driving Supervised were inconsistent with its stated driver-supervision requirements. NHTSA Division Chief Gregory E. Magno described such systems as “driver assist / support systems that require a vigilant, responsible driver to supervise their operation carefully and maintain constant readiness to intervene in the driving task.” This was regulator correspondence about Tesla’s communications and supervision requirements, not a case-specific finding about Nissen’s crash.

A separate National Transportation Safety Board investigation illustrates why system design and driver conduct can both matter in a crash investigation, but it does not decide what happened here. In its investigation of a 2018 Tesla and fire-truck collision in Culver City, California, the NTSB identified driver inattention and overreliance, Autopilot design that permitted disengagement from the driving task, and use inconsistent with manufacturer guidance and warnings among the probable-cause factors. Those findings concern that separate collision, not the Snohomish County case.
