Tesla, Autopilot disengaged approximately 1.65 seconds before impact, according to a timing fact the parties did not dispute in a June 2025 federal court order. That timing does not establish who or what initiated the disengagement, or by itself prove what caused the crash.
Which crash and lawsuit does the allegation concern?
The case is Benavides v. Tesla, arising from an April 2019 crash at an intersection in Key Largo, Florida. A Tesla Model S driven by George McGee struck Naibel Benavides Leon and Dillon Angulo. Benavides Leon died; Angulo was seriously injured.
The plaintiffs alleged that Tesla’s Autopilot design and warnings contributed to the collision. Tesla disputed that account and argued McGee caused the crash after becoming distracted when he dropped his phone. Those were opposing case theories, not findings established merely by the fact of the crash.
What does the 1.65-second timing establish?
A June 26, 2025 U.S. District Court order records that the parties did not dispute that Autopilot disengaged approximately 1.65 seconds before impact. In other words, the court record describes the system as disengaged shortly before the collision, rather than engaged at the moment of impact.

The interval is not, on its own, an explanation of how that happened. It does not establish whether the driver or a system event initiated disengagement, what warnings were issued or perceived, whether there was time for an effective intervention, or whether Autopilot contributed to the collision. Calling it a deliberate Tesla shutdown goes beyond what that timing fact establishes.
What did the jury decide?
At trial, the plaintiffs argued that Autopilot should have warned McGee or braked, and that its use should have been restricted to more suitable roads. Tesla argued that McGee alone caused the crash. On August 1, 2025, the jury found Tesla partly responsible and awarded damages.

The verdict is distinct from the earlier timing fact and from the parties’ trial arguments. Tesla filed post-trial motions, and a February 2026 court order documents post-trial proceedings. That information does not establish that the case was finally resolved; the latest disposition is not established here.

NHTSA reporting is not a finding of fault
NHTSA’s Standing General Order requires reporting for qualifying crashes involving specified Level 2 driver-assistance or higher automation systems that were engaged during or immediately before a crash, when the order’s other criteria are met. The requirement collects information; it does not decide that a system was defective or caused a particular collision. A reporting time window is not proof of causation.

Other investigations provide context, not a finding about this crash
NTSB reports on other Tesla crashes describe Autopilot as partial driving automation and, in those individual investigations, discuss driver inattention or overreliance alongside system limitations or design choices. They can help explain why supervision matters, but they are not findings about the Key Largo crash.
Tesla’s FSD reporting uses a separate method
Tesla’s public FSD (Supervised) safety report says its own collision-rate method counts a crash if FSD was active at any point in the five seconds before it, including when a driver disengages or the system aborts shortly before impact. That is Tesla’s stated method for its FSD reporting; it is not the Autopilot case record, NHTSA’s reporting rule, or an independent determination of what caused this collision.
