A proposed class action alleges that a used 2020 Tesla Model Y recorded miles faster than its owner’s driving could explain, bringing its mileage-capped warranty to an end sooner than expected. Tesla denied the material allegations, including that the software described in the complaint exists. The accessible case records do not establish that Tesla manipulated odometers or confirm a final outcome in the lawsuit.
What the lawsuit alleges
Nyree Hinton filed a putative class action in Los Angeles County Superior Court on February 10, 2025. Tesla removed the case to the U.S. District Court for the Central District of California on April 2, 2025, where it is listed as case 2:25-cv-02877. The complaint concerns a used 2020 Model Y Hinton bought from an unrelated third party.
According to the complaint, Hinton noticed what he considered abnormal mileage accumulation after service visits. He estimated his routine driving at about 20 miles a day and alleged that the odometer reached 50,000 miles around July 7, 2023, after which Tesla declined further warranty work. The complaint says a later suspension repair was estimated at about $10,000. These are the plaintiff’s allegations, not verified measurements or findings by a court.
The mileage figures in the complaint
Hinton’s complaint calculates an average of 55.54 miles per day from December 12, 2022, to February 6, 2023, and 72.35 miles per day from March 26 to June 28, 2023. It also compares the Model Y’s reported mileage with Hinton’s historical use of other vehicles. Those figures reflect the plaintiff’s calculations and comparisons; the available sources do not establish an independent odometer test.

The complaint’s explanation of the odometer
The complaint alleges that Tesla’s odometer system used predictive algorithms, energy-consumption data and driver-behavior multipliers rather than directly measuring distance. That is the plaintiff’s description of the system, not an independently verified account of Tesla’s odometer design.
What Tesla says and what the court record establishes
In its April 2, 2025 notice of removal, Tesla denied all material allegations, denied that the described software existed, and denied that Hinton suffered harm or was entitled to relief. A defense filing records Tesla’s position; it is not a decision on whether the claims are true.

The accessible case history does not provide a reliable final disposition. The Justia docket mirror lists a Tesla motion to dismiss in September 2025 and says its docket retrieval ended September 26, 2025. A Docket Nexus index lists entries dated September 28 and 29, 2026, including one labeled “Dismiss Case” and another labeled “Initial Order Setting R26 Scheduling Conference.” The index says it has no order stating a result and has not established whether the case is active or terminated. Those entries conflict on their face, and the underlying orders are not available in the records described here.
A March 12, 2026 Drive Tesla Canada report says Tesla sought dismissal with prejudice and summarizes the company’s arguments. That is reporting about a motion, not a judicial finding. The available information therefore does not support stating that the case has been finally decided.

What odometer fraud means under federal guidance
The National Highway Traffic Safety Administration (NHTSA) defines odometer fraud as “the disconnection, resetting or alteration of a vehicle’s odometer with the intent to change the number of miles indicated.” NHTSA also says, generally, that committing odometer fraud is a crime. Whether the behavior alleged in this lawsuit would meet that definition is a legal and factual question; the definition does not establish that Tesla committed fraud. NHTSA’s page displays estimates including more than 450,000 vehicles sold each year with false odometer readings, a 3.47% chance of odometer fraud during a vehicle’s first 11 years, and $1.06 million in increased consumer costs for passenger vehicles with rolled-back odometers. The page does not state the year for these figures. It also reports, without a year for the displayed totals, that the agency’s Office of Odometer Fraud Investigation has obtained more than 250 criminal convictions in more than 30 states, with fines totaling more than $2.8 million and court-ordered restitution exceeding $15 million.

What to do if your car’s mileage seems wrong
A mismatch between your driving estimate and an odometer reading is a reason to gather records, not by itself proof of manipulation. Compare the mileage history with evidence that can independently document use and service.

- Build a dated mileage record. Collect title documents, maintenance and inspection records, vehicle-history information, service invoices and any dated records showing the odometer. Note the date and mileage for each entry.
- Compare records with your own driving history. Check the odometer’s changes against commute, trip or other records where available. Keep estimates distinct from documented distances.
- Read the warranty terms. Check the written time and mileage limits and the service records relevant to the repair. A dispute about when coverage ended is separate from proof of why the odometer reading changed.
- Ask what evidence can explain the discrepancy. A mileage difference could reflect incomplete driving records or another measurement issue. The sources available for this Tesla case do not establish an independent test capable of distinguishing those possibilities.
- Contact the appropriate state enforcement agency if you suspect fraud. NHTSA advises consumers to report suspected odometer fraud to the relevant state agency. It directs reports of large-scale schemes to its Vehicle Safety Hotline.
- Consider legal advice about an individual claim. NHTSA says its office does not pursue individual consumer claims and advises suspected victims to consult a private attorney about their rights and remedies.
