States and Local Governments Sue Over Trump’s Weakened CAFE Standards

A 26-member state and local coalition has asked the First Circuit to review the Trump administration’s weakened fuel-economy standards for new cars and light trucks. A separate environmental-group lawsuit is also reported.

On October 2, 2026, California Attorney General Rob Bonta announced that a coalition of 26 states, counties and cities had petitioned the U.S. Court of Appeals for the First Circuit to review the Trump administration’s rule weakening federal fuel-economy standards for new cars and light trucks. The coalition alleges that NHTSA failed to meet the law’s “maximum feasible” standard; that claim has not been decided by a court. Separately, the Associated Press reported that five environmental groups also sued over the rule.

What the coalition is challenging

The case concerns the National Highway Traffic Safety Administration’s Corporate Average Fuel Economy program, commonly called CAFE. Under the final SAFE Vehicles Rule III, the Department of Transportation says NHTSA reset CAFE standards for passenger cars and light trucks for model years 2022 through 2031. DOT argues the earlier standards went beyond what Congress required.

The change is about the standards automakers must meet across their fleets, not a mileage promise for every vehicle or driver. An industry fleet average is not the same as the fuel economy a particular car achieves in everyday driving.

Why the states and local governments say the rule is unlawful

The coalition argues that the Energy Policy and Conservation Act of 1975 requires NHTSA to set standards at the “maximum feasible” level. In the California Attorney General’s description of the statute, that judgment must account for technological feasibility, economic practicability, the effects of other motor-vehicle standards and the need to conserve energy. The coalition says NHTSA did not properly apply that requirement.

The modeled fleet baseline

The coalition alleges that NHTSA distorted its analysis by excluding existing electric vehicles from the modeled baseline fleet. It says that choice affected the agency’s assessment of what standards were feasible and what their costs and benefits would be. This is the challengers’ account of the agency’s analysis, not a court finding.

The cost-benefit dispute

California’s announcement says the rule’s analysis omits nearly $220 billion in fuel savings that the coalition says would have resulted under the earlier standards. That figure is the coalition’s characterization of savings allegedly lost; it is not an agreed government estimate or an amount established by a court.

What DOT says the rule will do

DOT defends the rule as a balance among affordability, consumer choice, energy conservation and safety. In the agency’s announcement, NHTSA Administrator Jonathan Morrison said, “This rule restores integrity to the national fuel economy program, balancing vehicle affordability and energy conservation goals while improving safety on our roadways.” Those are the administration’s rationale and projections, not measured outcomes.

The Associated Press reported a different comparison for the 2031 fleet average: about 34.9 mpg under the new rule versus a projected 50.4 mpg under the preceding standards. That is a comparison between the new rule’s reported target and a projection under the prior standards—not a measurement of what every driver will get. The different comparisons answer different questions: DOT’s 30.1-mpg figure is for model year 2024, while AP’s 50.4-mpg figure is a projection under the earlier standards for model year 2031.

These estimates cannot be added up into a single net-benefit figure. They come from different parties, use different baselines and reflect disputed assumptions. AP also reported that environmental groups and experts dispute the administration’s contention that weaker requirements necessarily lower vehicle costs or lead more people to buy new cars.

How the environmental groups’ case differs

The state-and-local coalition’s First Circuit petition is distinct from a separate challenge reported by the Associated Press. AP identified five environmental plaintiffs: the Center for Biological Diversity, Conservation Law Foundation, Environmental Defense Fund, Public Citizen and Sierra Club. The available reporting describes the groups’ suit separately; it does not establish that they joined the states’ filing.

AP reported that no rule requires automakers to sell electric vehicles or consumers to buy them. Rather, EVs, hybrids and more efficient gasoline vehicles were incentivized by rules and standards. That distinction is relevant to the broader argument over whether the federal standards limit consumer choice or shape which vehicle technologies automakers have incentives to offer.

What the lawsuit means for drivers now

The case challenges a federal rule governing automakers’ fleetwide fuel-economy standards; the filing itself does not set an individual vehicle’s mileage, purchase price or fuel bill. DOT’s cost and safety figures are forecasts, while the coalition’s fuel-savings figure is an estimate of what it says the prior standards would have delivered. Neither side’s figures establish what a particular buyer will pay or save.

As of October 3, 2026, the reported state-and-local challenge is a petition for review, not a court ruling. The available announcements and coverage do not establish a decision or hearing date. The legal question is whether NHTSA’s rule satisfies the statutory “maximum feasible” requirement and the challengers’ other claims under the Administrative Procedure Act and the Energy Policy and Conservation Act.
